* 1. Adoption of Minutes - Regular Council Meeting of August 11, 2008
2. Public Hearing/Final Reading - Proposed Zoning Text Amendment
The First Reading of the following proposed ordinance was accomplished during the Council Meeting of July 28, 2008. Copies of the proposed ordinances are available at the entrance of the Council Chambers.
A.Appendix B - Zoning, Article 3 - District Regulations, Section 13 - Central Commercial Zone (C-2) and Section 14- Limited Central Commercial Zone (C-2A)
* 3. Utility Committee Report - August 11, 2008
A. Request for Alley Abandonment (paper) - 1124, 1128, and 1130 Forrest Avenue - Ennis Business Associates, L.L.C.
(Committee recommended favorable consideration of the paper alley abandonment to include the paper alley which runs 215 feet from Forrest Avenue in a southerly direction and 200 feet in an easterly direction to property now or formerly owned by Cardiology Consultants. Additionally, recommending and supporting a future parcel consolidation plan, as well as a site development plan, for the parcels; both final utility easements and a public access easement will be requested by the City of Dover during the site development process. (City Clerk's Note: In accordance with the City's Procedure for Alley Abandonments, a Resolution setting the Public Hearing for Monday, September 8, 2008 at 7:30 p.m. will be presented to Council for consideration for adoption.)
B. Update on the Expenditures to Resolve the Brown Water Issue
(Committee recommended acceptance of the report presented on the Water Quality Expenditure Update and commended staff for the clarity and information included in the report)
C. PACE/NAES Monthly Report (June) (Deferred by Committee 7/28/08)
(Committee recommended acceptance of the PACE/NAES Monthly Report for June. Members deferred discussion regarding the Dover 2030: Current Status of Proposal Process and Enhanced Reporting for FY2008 to the next committee meeting and noted that there are items discussed that will require further consideration by members at a future meeting)
* 4. Legislative, Finance, and Administration Committee Report - August 11, 2008
A. Comprehensive Review of the City’s Donation Policy and Contributions Provided by the City to Various Organizations
(Committee recommended that the budget team develop a new category, such as grant-in-aid, in addition to maintaining the current policy)
B. Request for Proposals - Banking Services Agreement
(Committee recommended awarding the City's banking services to Citizens Bank)
C. Proposed Resolution (Previously Ordinance #2008-37) Authorizing Staff to Permit Relocation of Non-Conforming Signs (South Governors Avenue)
(Committee recommended adoption of the proposed Resolution (previously proposed ordinance #2008-37) that would allow the City Planner to administratively approve relocation of legal non-conforming signs that must be relocated due to the South Governors Avenue improvements, so long as the degree of non-conformity not be increased and that a public hearing be set by Council prior to its adoption. Staff recommended setting a Public Hearing for Monday, September 22, 2008 at 7:30 p.m.)
D. Review of Job Description - City Assessor and Assistant City Assessor
(Committee recommended approval of the Job Descriptions for the City Assessor and Assistant City Assessor with the understanding that staff amend the job descriptions further upon review of the employment ad for the City Assessor to address the concerns mentioned by Mr. Ruane)
E. Space Plan Update
(Committee recommended acceptance of the Space Plan Update as presented)

A. Proposed Zoning Text Amendments
a-1. Ordinance #2008-38 - Appendix B - Zoning, Article 3 - District Regulations, Section 1 - One Family Residence Zone (First Reading at Council July 28, 2008 - Public Hearing Scheduled for September 22, 2008)
(Committee recommended that City Council and the Planning Commission deny and reject the petition to amend Subsection 1.14(d) of Appendix B - Zoning Ordinance, Article 3 - District Regulations, Section 1 - One Family Residence Zone, of the Dover Code, for the reasons as stated and made a part of the record) (Withdrawal of the proposed amendment and cancellation of the public hearing will be considered during the latter part of the meeting - see item #7)
a-2. Ordinance #2008-39 - Appendix B - Zoning, Article 5 - Supplementary Regulations, Section 10 - Open Space, Recreation and Other Public Facilities
(Committee tabled consideration of the proposed ordinance amending Appendix B - Zoning Ordinance, Article 5 - Supplementary Regulations, Section 10 - Open Space, Recreation and Other Public Facilities, Subsection 10.5 - Exemption)

7. Withdrawal of Proposed Zoning Text Amendment/Cancellation of Public Hearing
The First Reading of the following proposed ordinance was accomplished during the Council Meeting of July 28, 2008. The amendment was referred to the Planning Commission on September 15, 2008 and a Public Hearing was scheduled for September 22, 2008 at 7:30 p.m.
