CIVILIAN PENSION BOARD



The Civilian Pension Board met on August 22, 2007 at 2:29 p.m. with Chairman Hogan presiding. Members present were Mr. McGiffin, Mr. DePrima, Mr. Lucas, and Mrs. Rigby. Mrs. Braun and Mrs. Mitchell were absent.


AGENDA ADDITIONS/DELETIONS

Mr. Lucas moved for approval of the agenda, seconded by Mrs. Rigby and unanimously carried.


Civilian Pensions Approved by Human Resources Director and Finance Director

Members reviewed the civilian pensions that were approved by the Human Resources Director and Finance Director from January 1, 2007 through June 30, 2007.


No further action was taken.


Proposed Ordinance Amendment - Section 2-335 - Termination of Employment

Over the years the number of former employees who have not requested a refund of their general employee pension contributions has increased. For each of these former employees pension contribution statements are maintained for future reference and calculation of refund. All employees are provided upon resignation/termination a Statement of Intent requesting they advise the City of their intent with their contributions. Occasionally the request is not returned. According to Section 2-335. Termination of employment:

 

            (a)     Forfeiture of participation. Any participant whose employment is terminated prior to the date he becomes eligible for retirement benefits and is not reemployed by the city within five years shall forfeit his status as a participant in the pension plan and all accumulated credit for continuous service.

 

The Statement of Intent indicates that contributions will be refunded in 90 days of the date the notarized request is received. This language is not stated in the pension ordinance.

 

In reviewing Section 2-335. Termination of employment (e) of the General Employee Pension Plan, Staff recommended the following language modification:

 (e)       Request for Refund of Contributions. When an employee leaves the employment of the city and is entitled to withdraw his contributions, then he shall submit a written notarized request for a refund of these contributions before payment shall be made. The refund will be distributed on the ninety (90th) day after the notarized request for refund is received by the City of Dover.

 

            (f)        Pension contributions will be automatically refunded to all non-vested employees who do not return to active employment with the City of Dover within five years after the employee’s last day of employment.

 

Mrs. Peggy Teal, Assistant Finance Director, indicated that it does create an administrative problem if the contributions are not refunded after the five (5) year deadline.

 

 

 

 

Mr. Lucas moved to recommend adoption of the Proposed Ordinance Amending Section 2 -335 - Termination of Employment, as recommended by staff. The motion was seconded by Mrs. Rigby and unanimously carried.

 

Mr. Lucas moved for adjournment, seconded by Mrs. Rigby and unanimously carried.
