REGULAR MEETING

June 11, 1945

The Regular Meeting of the City Council of the City of Dover was held on the 11th day of June, 1945. The meeting was called to order by Mayor Woodford and on roll call the following members answered “Present”: Messrs. Downes, Carson, Keith, Burton, Hartnett, Hinkle, and Vane.

MINUTES

Upon motion of Messrs. Burton and Hinkle, the reading of the minutes of the last Regular and Special meetings was dispensed with.

CITY MANAGER’S REPORT

The City Manager’s Report for the month of May was read by the Clerk and accepted upon motion of Messrs. Burton and Hinkle.

Upon motion of Messrs. Keith and Downes, the City Council approved the recommendation of the City Manager to change water rent billings on properties where the water survey was in effect from billing in advance to billing in arrears. This new method of billing will change the amount of discount allowed from 10% to 5%.

Upon motion of Messrs. Keith and Hartnet, the City Manager was instructed to change the location of the new bath house at the swimming area. The change is being made from the present foundation site to a new site approximately 50 feet south of the dam embankment and the building foundation will be raised on a level with said embankment.

ALDERMAN’S REPORT

The Alderman’s Report for the month of May was read by the Clerk and accepted upon motion of Messrs. Keith and Burton.

A check amounting to $217.00 was turned over to the City Manager with the report of 30 arrests.

POLICE REPORT

The monthly report of the Chief of Police was read by the Clerk and approved upon motion of Messrs. Hinkle and Vane.

TAX REMITTED

Upon motion of Messrs. Hinkle and Vane, the poll tax of James Crowley was ordered removed from the record. It was also ordered that he shall not be assessed in future years in as much as he is 7 years old and has no income.

COMMITTEES

Rev. Wm. Edge representing the ministerial association, appeared before Council to report his findings in a conference with the National Recreational Committee of New York City. He reported what a survey by this organization of the recreational conditions of Dover would compose of.

REFUND ON WATER RENT

Upon motion of Messrs. Keith and Downes, City Council instructed the City Manager to refund to the People’s Congregationalist Church, all water rents paid by them above the normal billings for the past six months.

ORDINANCE

An Ordinance entitled “AN ORDINANCE REGULATING THE USE OF THE MUNICIPAL SWIMMING BEACHES UNDER THE SUPERVISION OF THE CITY OF DOVER AND PROVIDING RULES FOR THE USE THEREOF AND PENALTIES FOR THE VIOLATION FO SUCH RULES” was passed upon the following vote: Keith, yes; Burton, yes; Vane, yes; Hinkle, yes; Hartnett, yes; Carson, yes; Downes, yes.

AN ORDINANCE REGULATING THE USE OF THE MUNICIPAL SWIMMING BEACHES UNDER THE SUPERVISION OF THE CITY OF DOVE RAND PROVIDING RULES FOR THE USE THEREOF AND PENATIES FOR THE VIOLATION OF SUCH RULES.

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

SECTION 1.   That the following rules and regulations are hereby established for the sue of the swimming beaches under the supervision of The City of Dover, and it shall be unlawful for any person or persons to violate any of the said rules and regulations hereby established:

(a)       The rules and regulations hereby established shall be applicable to each of the beaches maintained by the City of Dover.

(b)       Where ever the term “facility” is used herein, the same shall be applicable to the swimming beaches, the bath houses, toilets, walks, roads, parking spaces and other facilities used in connection with either or both of the said swimming beaches.

(c)       Use of any swimming beach or facility used as such is confined to the area marked and laid off by properly designated lines, and it shall be unlawful for any person to go outside the designated areas for the purpose of swimming or bathing, and any person going beyond such limits shall do so at his or her sole risk.

(d)       All persons using any facility shall be properly clothed at all times.

(e)       All persons using any facility shall conduct themselves properly at all times and shall do no act or thing which shall jeopardize the life, limb or safety of another.

(f)        The use of obscene and/or profane language is prohibited.

(g)       No person shall enter or use any facility who has been using alcoholic liquors, wines or beer, and the drinking of alcoholic liquor, wines or beer is prohibited on or near any facility at any time.

(h)       Abuse of any facility or any part of the same is prohibited.

(i)        All persons are prohibited from swimming in front or back of the concrete dam adjacent to any facility, and said dam is to be used by the public only as a walk or approach to either facility.

(j)        No person or persons shall throw or drop any object or thing in the water of any facility or within one hundred yards thereof.

(k)       The supervision of each facility shall at all times be under the direction of the Mayor and the City Council of Dover Delaware, or its duly authorized officers and employees.

(l)        All persons using any facility at any time do so at their own risk.

(m)      Life guards will be on duty at such times as may be designated by the Mayor and City Council of Dover, and the orders, signals and commands of such life guard or life guards shall be obeyed.

(n)       There shall be posted in at least two prominent places on each facility the hours during which the beach or beaches on such facility are protected by life guards. No person or persons shall use such facility or any beach used in connection therewith when such beach is not protected by one or more life guards.

SECTION 2.   Any person or persons convicted of violating any of the provisions of Section 1 hereof or any of the rules and regulations therein and thereby established shall be fined not more than Twenty-five Dollars, or imprisoned for not more than thirty days, or be both fined and imprisoned at the discretion of the alderman or magistrate before whom said person or persons shall be convicted.

Upon motion of Messrs. Keith and Burton, the proposition of employing life guards for the new swimming area was left up to the City Manager and the Recreational committee.

HOTEL OPTION

Upon motion of Messrs. Hinkle and Downes, City Council voted to extend the option of the Vineta Hotel Operating Co. for six months beginning July 1, 1945 and ending January 1, 1946.

INSURANCE

Upon motion of Messrs. Hinkle and Burton, the City Manager was authorized to place a $6000.00 Damage Insurance Policy on the new switchboard

Upon motion of Messrs. Downes and Hinkle, City Manager was instructed to place a Public Liability Insurance Policy on Silver Lake Swimming Area, for the amount of $10000.00 damages for one person or $20000.00 for more than one person in any one accident. The price of this policy is to be approximately $170.00

COMMITTEE

Mr. H. E. Lynch, Attorney, appeared before Council representing the land owners on the east end of Sackarackin Avenue asking that the new sewer and street paving be continued through to the end of Sackarackin Avenue.

After some discussion, Council advised Mr. Lynch that they could not spend any more money in paving this street until it was developed by the building of homes on the east end of the street.
