REGULAR MEETING

                                                                                                            August 9th, 1937

            The regular meeting of the City Council of the City of Dover was held on the 9th day of August, 1937. The meeting was called to order by Mayor Woodford and on roll call the following members answered present: Messrs. Keith, Millman, LeFevre, Downes, Burton, Frear and Vane.

MINUTES

            Upon motion of Messrs. Burton and LeFevre, the reading of the minutes of the last regular meeting was dispensed with.

CITY MANAGER’S REPORT

            The City Manager’s report for the month of July was read by the Clerk and accepted upon motion of Messrs. Keith and Burton.

            Upon motion of Messrs. Keith and Burton, the City Council authorized the City Manager to grant an extension of time of 30 days on the notice to George M. Schwartz for removing or repairing the old buildings on Loockerman Street.

            Upon motion of Messrs. Keith and Burton, Council voted that the order be rescinded regarding the removal of the porch on the property of Mrs. Ina Freeman on Loockerman Street in-as-much as this porch as been inspected by two reputable carpenters and reported safe.

            Upon motion of Messrs. Downes and Millman, the City Manager was instructed to install an 8” water main south on South Governors Avenue from Gooden Street to Wyoming Avenue and to install fire plugs in that section.

            Upon motion of Messrs. Keith and LeFevre, the City Manager was authroized to make the proposition as outlined in the following letter to Mrs. R. S. McNeil regarding the purchase of the Silver Lake property:

Dear Sir:

            The City of Dover hereby offers to purchase of you and Sue G. McNeil, your wife, upon the terms and conditions hereinafter named, all the lands owned by you and Mrs. McNeil, which you purchased of Robert E. Lewis and wife, and commonly known as the Lewis Mill property, lying east of the City of Dover in Kent County, State of Delaware, including particularly all the water, water rights and lands covered by water, mill dam, mill gates, tillable land, lying to the west of the mill race between the said mill race and the low land and cripple land also including said low land, cripple and meadow and expressly excepting only from the lands purchased by you of and from the said Robert E. Lewis the dwelling house, together with the lot lying to the north of the dwelling house and east of the said mill race and also expressly excepting the mill, mill seat, warehouse, barn and stable, and the land lying between the said barn and the mill and a strip of land not in excess of fifteen feet lying to the north of the stable.

            The City agrees to pay therefor the sum of Dollars to be paid in case within thirty days after the acceptance of this offer.

            Upon the acceptance of this offer and within thirty days thereafter you agree to make, execute and deliver to the said The City of Dover a deed in fee simple for all the lands, water rights, land covered by water, mill dam, gates and all other property, the subject of this proposal or offer, free, clear and discharged of all liens and encumbrances.

            Said City agrees that you shall have the privilege of using for a period not in excess of ten years water through the mill race from said pond to the mill now operated by you or by the Dover Flour and Feed Mills as may be required by you, subject, however, to the conditions and understanding that the said City shall have priority in use of said water if an emergency or any condition should arise whereby there would not be sufficient water to supply the needs of the City as well as your needs.

            It is further understood and agreed that if you avail yourself of the opportunity of using said water from said pond through the said race that it will be your duty to maintain and keep said race without cost to the said City.

            Said City of Dover reserves the right to withdraw this offer at any time prior to acceptance.

            Acceptance must be in writing delivered to the office of the City Manager in the City Hall, Dover, Delaware, within ten days.

FINANCIAL REPORT

            The financial report for the month of July was read by the Clerk and accepted and approved upon motion of Messrs. Burton and Keith.

ALDERMAN’S REPORT

            The Alderman’s report for the month of July was read by the Clerk and accepted upon motion of Messrs. Burton and Vane. A check amounting to $57.00 was turned over to the City Manager with the report of eight arrests.

POLICE REPORT

            The report of the Chief of Police was read by the Clerk and accepted upon motion of Messrs. LeFevre and Downes.

COMMITTEES

            William B. Mitten appeared before Council asking that the City grade Sackarackin Avenue to a width of 38’ from curb to curb from State Street to the branch. Upon motion of Messrs. Keith and Millman, Council instructed the City Manager to open this street to the required width as set forth in the Jenkins plot. They also authorized him to move the garages belonging to Alden Smith and Louis Wallace back the required number of feet to give them a proper grade and to build ramps into same at the City’s expense.

PERMIT FOR CARNIVAL

            Upon motion of Messrs. LeFevre and Downes, the City Manager was authorized to issue a permit to the Robbins Hose Company to hold a street carnival on the Dover Plaza.

CONTRIBUTION

            Upon motion of Messrs. Frear and Downes, Council voted to contribute $100.00 to the Robbins Hose Company to help defray expenses for the State Convention of Volunteer Firemen, and upon motion of Messrs. Frear and Keith, Council voted to contribute $45.00 for the purpose of sending three members to the annual fire school.

ORDINANCES

            The following ordinance was adopted by Council on vote of:

AN ORDINANCE PROVIDING THAT LL PASTEURIZED MILK OR CREAM SOLD OR DISTRIBUTED IN THE CITY OF DOVER MUST BE PASTEURIZED WITHIN THE CORPORATE LIMITS OF THE CITY OF DOVER, DELAWARE

            BE IT ORDAINED By the Council of the City of Dover in Council met:

            SECTION 1.   That from and after the passage and approval of this ordinance it shall be unlawful for any person or group of persons, firm, association or corporation to sell or offer for sale as pasteurized milk or cream, or any milk or cream purporting to be pasteurized milk or cream, any milk or cream unless the same shall have been pasteurized within the corporate limits of the City of Dover and under the supervision of the Board of Health of the City of Dover; except that such milk or cream may be sold or offered for sale to dairies located within the corporate limits of the City of Dover that are equipped with pasteurizing equipment approved by the Board of Health. Nothing herein contained shall be construed to effect the rights of holders of permits at the time of the passage and approval of this ordinance to continue to hold or renew the same annually.

            SECTION 2.   Any person, firm, association or corporation violating any of the provisions of Section 1 hereof shall, upon conviction thereof, be fined not less than Twenty-five ($25.00) Dollars nor more than Fifty ($50.00) Dollars for each violation and may be imprisoned for a period not in excess of thirty (30) days.

AN ORDINANCE TO AMEND CHAPTER 5 OF THE ORDINANCES OF THE CITY OF DOVER RELATING TO FIRE DEPARTMENT.

            Be It Ordained By the Council of the City of Dover in Council Met:

            SECTION 1.   That Paragraph 2 of Section 2 of Chapter 5 of the ordinances of the City of Dover be amended as follows:

            (a)       By striking out the period at the end of said paragraph 2 and inserting in lieu thereof a semi-colon.

(b)       By adding at the end of said paragraph 2 of Section 2 of Chapter 5 the following:

Provided, however, that no apparatus or equipment belonging to the Fire Department

shall be removed beyond the City limits of the City of Dover without the consent thereto first had of and from the Chief Engineer or in his absence of the First Assistant Engineer or Second Assistant Engineer who may be in charge.

ANNUAL FINANCIAL REPORT

            The annual report of the financial standing of the City of Dover was presented to Council by a letter from the City Manager. This report was prepared by William M. Jefferis, CPA, who made the annual audit for the City as per regulations set forth in the Charter. This report was adopted upon motion of Messrs. Keith and LeFevre.

CANCELLATION OF OLD ACCOUNTS

            Upon motion of Messrs. Downes and Frear, Council authorized the City Clerk to remove from active accounts all City Taxes up to 1934.

            Council adjourned at 9:20 P. M.
