SPECIAL MEETING

December 6th, 1935

A special meeting of the City Council of the City of Dover was held on the 6th day of December, 1935.

The meeting was called to order by Mayor Woodford with the following members present: Messrs. Downes, Frear, Vane, Burton, Hinkle and Millman.

RESOLUTIONS

Mr. James A. Downes presented the following resolution and moved the adoption of the same and Mr. Jesse S. Burton seconded the motion:

WHEREAS, the City of Dover did on the second day of December A. D. 1935, receive bids for the erection and construction of an incinerator and sewage disposal plant from the following parties, to-wit:

            Virginia Engineering Co.

            George & Lynch

            Seaboard Contractors, Inc.

                                                            ; and

WHEREAS, after allowable deductions had been made according to the terms upon which such bids were received the Virginia Engineering Company, a corporation of the State of Virginia, was the lowest bidder in the amount of $107,482.00 and the said sum of $107,482.00 was the lowest and best bid for the erection and construction of said incinerator and sewage disposal plant according to the terms and specifications under which such bids were made and received; and

WHEREAS, it appears that said Virginia Engineering Company is a duly qualified and proper party making such bid and that such bid was pursuant to and in conformity with the plans and specifications relating to the erection and construction of said incinerator and sewage disposal plant.

NOW THEREFORE BE IT RESOLVED by the Council of the City of Dover that the bid of the said Virginia Engineering Company, a corporation of the State of Virginia, in the amount of $107,482.00 be and the same is hereby accepted; and

BE IT FURTHER RESOLVED, that the Mayor and Clerk of the Council of the City of Dover, under the corporate seal of the City of Dover, be and they are hereby authorized, empowered and directed to enter into a contract on behalf of the City of Dover and to execute such contracts or other instruments as may be necessary and proper in the acceptance of such bid for the erection and construction of said incinerator and sewage disposal plant according to the terms, plans and specifications contained in such bid.

Mr. James A. Downes presented the following resolution and moved the adoption of the same and Mr. Grover C. Frear seconded the motion:

WHEREAS, The City of Dover did on the second day of December A. D., 1935, receive bids for electrical work known as Contract “B” for the erection and construction of an incinerator and sewage disposal plant from the following parties, to-wit:

            E. L. Jones & Company

            T. K. Jones & Company

            Arrow Electric Company

            Elias Nusbaum Bros. Inc.

                                                            ; and

WHEREAS, after allowable deductions had been made according to the terms upon which such bids were received the Virginia Engineering Company, a corporation of the State of Virginia, was the lowest bidder in the amount of $2,061.73 and the said sum of $2,061.73 was the lowest and best bid for the erection and construction of said incinerator and sewage disposal plant according to the terms and specifications under which such bids were made and received; and

WHEREAS, it appears that said Virginia Engineering Company is a duly qualified and proper party making such bid and that such bid was pursuant to and in conformity with the plans and specifications relating to the erection and construction of said incinerator and sewage disposal plant.

NOW THEREFORE BE IT RESOLVED by the Council of the City of Dover that HTE bid of the said Virginia Engineering Company, a corporation of the State of Virginia, in the amount of $2,061.73 be and the same is hereby accepted; and

BE IT FURTHER RESOLVED, that the Mayor and Clerk of the Council of the City of Dover, under the corporate seal of the City of Dover, be and they are hereby authorized, empowered and directed to enter into a contract on behalf of the City of Dover and to execute such contracts or other instruments as may be necessary and proper in the acceptance of such bid for the erection and construction of said incinerator and sewage disposal plant according to the terms, plans and specifications contained in said bid.

The City Solicitor reported to the Council that on December 5, 1935, there was awarded by a Commission duly appointed therefore to Nettie S. Moore for the lands to be taken by the City of Dover for the purpose of erecting thereon a part of the incinerator and sewage disposal plant south of Water Street, this City, the sum of $750 covering all the damages sustained by the said Nettie S. Moore by virtue of the taking to the said lands by the City and that there were also costs taxed against the City in such proceeding amounting to $57.53 and requested that Council authorize the payment of the award to the said Nettie S. Moore in the amount of $750, together with the cost incident to the condemnation proceeding, amounting to $57.53.

Thereupon Mr. James A. Downes offered the following resolution and moved the adoption of the same which motion was seconded by Mr. Willard M. Hinkle:

RESOLVED that the Treasurer of the City of Dover be and he is hereby authorized, empowered and directed to pay to Nettie S. Moore or James M. Satterfield an John B. Hutton, her attorneys, the sum of $750 in full of th damages sustained by the said Nettie S. Moore for the taking of a part of the lands of the said Nettie S. Moore lying south of Water Street as determined in the condemnation proceedings and the award made thereunder on December 5, 1935; and

BE IT FURTHER RESOLVED that the Treasurer of the City of Dover be and he is hereby ordered and directed to draw a check to the order of Melvin Hopkins, attorney, in the sum of $57.53 covering the total cost, commissioners’ fees and witness fees incident to the said condemnation proceeding according to the schedule of cost submitted.
