REGULAR MEETING
January 14, 1935
The meeting was called to order by Mayor Woodford at 7:30 P.M. with the following members present: Messrs. Keith, Clark, Burton, Frear, Hinkle, Millman and LeFevre.
MINUTES
Upon motion of Messrs. Frear and Burton the reading of the minutes of the last regular meeting was dispensed with.
CITY MANAGER’S REPORT
Upon motion of Messrs. Keith and Clark, the City Manager’s report for the month of December was accepted as read by the Clerk and ordered placed in the minutes.
Upon motion of Messrs. Keith and Hinkle, the electric rates were accepted as recommended by the City Manager and he was authorized to put them into effect on the January billing. A schedule of the rates are attached hereto.
Upon motion of Messrs. Burton and Frear, the City Manager was authorized to continue the interceptor sewer as far as the main outfall in back of the Richardson and Robbins plant.
Upon motion of Messrs. Keith and Hinkle, the City Manager was authorized to install a sewer back of the East Coast Ice Plant in order to take care of the property on North and Clarence Streets when the City Manager deems it advisable.
A letter from Virgil B. Wiley, Supt. of Public School District, was read to Council asking that they install ornamental street lights in front of the High School. Upon motion of Messrs. Hinkle and Keith, the City Manager was instructed to install four lamp-posts in front of the school buildings.
ALDERMAN’S REPORT
The Alderman’s report for the month of December and fines collected amounted to $138 with 17 arrests, check for same being turned over to the City Manager. This report was accepted as read and ordered filed upon motion of Messrs. Keith and Burton.
POLICE REPORT
The report of the chief of police was accepted as read by the Clerk upon motion of Messrs. Keith and Clark.
FINANCIAL REPORT
The financial report for the month of December was accepted as read by the Clerk upon motion of Messrs.. Burton and Clark.
COMMITTEES
A committee representing East Dover Hills, which is a development east of St. Jones’ River, appeared before Council and Mr. H. H. Hanson asked in their behalf that the City of Dover take their property into the City limits. They were advised by Council that the proposition would have their careful consideration and that they would report to them at a later date.
AMENDMENTS TO CHARTER
Upon motion of Messrs. Keith and Millman, the City Clerk was instructed to notify the City Solicitor to have all bills ready to introduce to the State Legislature concerning the City charter and amendments thereto in time for the Mayor to call special meetings to consider these bills.
FIRE CHIEF’S REPORT
The report of the fire chief for the year 1934 was accepted as read by the Clerk and ordered filed upon motion of Messrs. Hinkle and Burton and the City Clerk was instructed to write a letter to the Robbins Hose Company expressing the appreciation of Council for the splendid work done.
CITY ELECTION
Mayor Woodford appointed Messrs. Thos. F. Clark, Thos. V. Keith and Alderman Burton to hold the City election at Kent County Court House on January 21st from one o’clock to four o’clock P.M. The following named were submitted by the City Clerk with nominating petitions accompanying, nominating the following members for election at the next City election: J. Wallace Woodford, Mayor; James A. Downes, Councilman for the first district; Curtis F. Millman, Councilman for the second district; Grover C. Frear, for the third district; Willard M. Hinkle, for the fourth district; and William Smith for Mayor.
After examining these petitions, the City Solicitor instructed the City Clerk that all petitions were filed in accordance with the City Charter with the exception of the petition of William Smith. Upon motion of Messrs. LeFevre and Keith, the City Clerk was instructed to have the following names printed on the official ballot for said election:

James A. Downes, Councilman 1st District
Curtis F. Millman, Councilman 2nd District
Grover C. Frear, Councilman for 3rd District
Willard M. Hinkle, Councilman 4th District
ORDINANCE
The following ordinance was passed by the City Council by the following vote: Messrs. Keith, yes; Clark, yes; Burton, yes; Frear, yes; Hinkle, yes; Millman, yes; and LeFevre, yes.:
AN ORDINANCE ESTABLISHING CERTAIN REGULATIONS FOR THE SALE AND DISTRIBUTION OF PROPHYLACTIC RUBBER GOODS AND ARTICLES FOR THE PREVENTION OF VENEREAL DISEASES AND INFECTIONS IN THE CITY OF DOVER, DELAWARE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF DOVER:
Section 1. It shall be unlawful for any person, copartnership, corporation, enterprise or association of any type (except such persons operating in such manner as is specified in Section 3) to sell, give away, or otherwise distribute to the public in stores, on streets, by vending machines, by peddling from house to house, or in any public place or office building, or in any manner whatsoever, within the corporate limits of the City of Dover, any appliance, drug or medicinal preparation intended or having special utility for the prevention of conception and/or venereal disease.
Section 2. It shall be unlawful for any person, copartnership, corporation, enterprise or association of any type to display or expose for sale, any appliance, drug or medicinal preparation, intended or having special utility for the prevention of conception and/or venereal disease, or to display or expose any containers or packages therefor descriptive or suggestive of the contents or to advertise the sale of the same on any placards, billboards, hand-bills, newspapers, periodicals, signs, or by any means of publication either visual or auditory, either individually or by broadcast, within the corporate limits of the City of Dover.
Section 3. The prohibition specified in Section 1 shall not apply to wholesale druggists, specifically licensed by the State of Delaware to the extent that such druggists are permitted to sell or distribute appliances, drugs and medicinal preparations specified in Section 1 (but only such as conspicuously bear the identification of the manufacturer thereon, or on the retail container thereof) only to regularly licensed drug stores; nor shall the prohibition specified in Section 1 of this ordinance, apply to the sale or distribution of such appliances, drugs or medicinal preparations by regularly licensed practitioners of medicine in the normal course of their professional activities; nor shall the prohibition specified in Section 1 of this ordinance, apply to the sale of such appliances, drugs or medicinal preparations by licensed drug store, provided such sales are made only from the prescription counters of such drug stores by registered pharmacists there employed, and only to persons more than eighteen years of age.
Section 4. Penalty for violation, whoever violates any of the provisions of this ordinance, shall, upon conviction before the Municipal Court, be adjudged to pay a fine of not less than $25.00 nor more than $200.00 each day’s violation shall constitute a separate offense.
Section 5. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
