                                                           REGULAR MEETING

August 27, 1962

The regular meeting of City Council was held Monday, August 27, 1962 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs Hayes, Holpp, Hill, Hughes, Mowlds, Turner, Walls and Zartman.

The invocation was said by the Rev. Robert L. McKim.

WESLEY COLLEGE REQUEST TO ABANDON ALLEY

A letter from Dr. Robert H. Parker, President of Wesley College, was read to Council. The letter requested that an alley running from Bradford Street to a North-South alley between Cecil and Mary Streets be abandoned by the City in order that the College could build a new men’s dormitory in that block. Joshua Twilley, attorney for the College, appeared before Council to answer any questions on the request. On motion of Mr. Hill, seconded by Mr. Zartman, the request was granted.

MINUTES

Minutes of the Council meeting of August 13, 1962 were accepted as read, but with the following changes:

That the motion of Zoning, which stated that Mr. Mowlds had seconded the motion, show that the motion had actually been seconded by Mr. Walls.

That the action taken on trailers to be used for classrooms show that Mr. Hill voted ‘No’.

The minutes of the Council meeting of August 20, 1962 were accepted as read.

PARKING AUTHORITY REPORTS

William R. Manter, Treasurer of the Dover Parking Authority, submitted to Council the Authority’s financial report for the fiscal year ended June 30, 1962. The report presented was not an audited statement, since the audit had not been completed. Mr. Manter also stated that the Parking Authority had not authorized him to give a progress report at this time, since a project was now underway and the success of this project could be jeopardized if the plans were made public at this time. On motion of Mr. Holpp, seconded by Mr. Walls, the reports of the Parking Authority were accepted as submitted.

PLANNING COMMISSION REPORTS

Myron U. Lamb, Secretary of the Planning Commission, reported that the request referred to the Commission by Council concerning the abandonment of an alley and part of a street bordering properties owned by William Holden should, in the opinion of the Commission, be denied. Since this decision was based on available information which indicated that the property would be used to extend a business which is now a non-conforming use, it was decided that more information was necessary before a decision could be made. The Clerk was directed to have this matter placed on the agenda for the September 10 meeting and the Mr. Holden and James Hughes, III, attorney for Mr. Holden, be notified of this action in order that they may present more complete information on the intended use of the property involved. Council also requested that the Planning Commission’s recommendation be submitted in written form.

Mr. Lamb also expressed the Planning Commission’s wish to have the contract with Raymond & May Associates, which now expires September 1, 1962, extended for one month. This extension would be used for a preliminary study of the newly annexed area and its relationship with the existing Master Plan. On motion of Mr. Zartman, seconded by Mr. Walls, the contract will not be extended. Councilmen Mowlds, Turner, Hayes and Holpp voted ‘No’, thereby defeating the motion. On motion of Mr. Turner, seconded by Mr. Mowlds, the contract will be extended with the provision that at the new expiration date Raymond & May will have a report of their preliminary study of the newly annexed area. Councilmen Zartman, Walls, Hill and Hayes voted ‘No’, thereby defeating the motion. Mr. Hughes was absent during the voting on both sides of these motions.

WALLS CURB DEPRESSION

A letter from R. Lewis Walls requested permission to make a curb depression at his property at 107 North New Street for a driveway. On motion of Mr. Hayes, seconded by Mr. Hill, the request was granted.

SAFETY COMMITTEE

The Mayor named Councilmen Hayes, Hill and Walls to serve on the newly created Safety Committee, with Mr. Hayes serving as Chairman.

ANNEXATION RESOLUTIONS

Letters have been received from August and Katherine J. Schutte, E. C., Jr. and Eileen Lockwood, O. A. and Ethel C. Evans, and Ammon and Helen C. Kesselring requesting that their farms be annexed to the City of Dover. On motion of Mr. Holpp, seconded by Mr. Zartman, Council adopted the following resolution:

RESOLUTION PROPOSING THE INCLUSION OF AN AREA WITHIN THE LIMITS OF THE CITY OF DOVER AND CALLING FOR A SPECIAL ELECTION TO BE HELD IN SAID AREA.

WHEREAS, a recent Amendment to the Charter of The City of Dover authorized the Council to extend the boundaries of the said City after a special election of the qualified voters and real estate owners of the territory proposed to be annexed, and

WHEREAS, the Mayor and Council of the City of Dover deem it in the best interest of the City of Dover to include an area as hereinafter more particularly described within the limits of the City of Dover,

NOW THEREFORE BE IT RESOLVED:

1. That the following territory situate in East Dover Hundred, Kent County State of Delaware, as more particularly bounded and described by detailed description be annexed to the City of Dover:

            All that certain piece, parcel or tract of land now situated in East Dover Hundred, Kent County, State of Delaware more particularly described as follows:

PARCEL “A”

Beginning at the intersection of the southerly right of way of the Hazlettville Road with the easterly right of way line of Mifflin Road; thence with the said southerly right of way of the Hazlettville Road in a westerly direction to the easterly right of way of State Road No. 195; thence in a southerly direction with the said easterly right of way line of State Road No. 195 to the northerly line of the lands of R. W. Ackerly; thence with the said northerly line of the lands of Ammon Kesselring; thence with the said line of Ammon Kesselring in a southerly direction to the easterly right of way line of the Pennsylvania Railroad thence in a northerly direction with the said easterly right of way line of the Pennsylvania Railroad to the northerly right of way line of Webbs Lane; thence with the said northerly right of way line of Webbs Lane in an easterly direction to the easterly line of lands of Ammon Kesselring; thence with the said line of lands of Ammon Kesselring an also binding with lands of Bessie Dennison, Norman Cubbage, Governors Avenue and Norris Eddington four lines to the center of Puncheon Run; thence with the said center of Puncheon Run in a westerly direction to the easterly right of way line of the Pennsylvania Railroad; thence with the said easterly right of way line of the Pennsylvania Railroad in a northerly direction to the southerly direction to the southerly right of way line of the Hazlettville Road; thence with the said southerly right of way line of the Hazlettville Road in a westerly direction home to the place of beginning.

PARCEL “B” ---------------------

Beginning at the intersection of the easterly right of way line of State Street Extended with the center of Puncheon Run; thence with the said center of Puncheon Run in a westerly direction to the easterly right of way line of U.S. Route 13; thence with the said easterly right of way line of U.S. Route 13 in a southerly direction to the northerly right of way line of Coopers Road; thence with the said northerly right of way line of Governors Avenue Extended; thence with the said easterly right of way line of Governors Avenue Extended in a southerly direction to the northerly right of way line of Webbs Lane; thence with the said northerly right of way line of Webbs Lane in a westerly direction to the easterly line of lands of Ammon Kesselring; thence with said Ammon Kesselring lands and bounded by lands of Bessie Dennison, Norman Cubbage, Governors Avenue and Norris Eddington four lines to the center of Puncheon Run; thence with the said center of Puncheon Run in an easterly direction to the westerly right of way line of Governors Avenue Extended; thence with the said westerly right of way line of Governors Avenue Extended in a northerly direction to the northerly right of way line of Wyoming Avenue; thence with the said northerly right of way line of Wyoming Avenue to the easterly right of way line of State Street; thence with the said easterly right of way line of State Street in a southerly direction home to the place of beginning.

2. That an election be held on the 29th day of September A.D., 1962 between the hours of 1:00 P.M. and 7:00 P.M. at City Hall on the Plaza in Dover, Kent County, Delaware for the purpose of submitting the question of annexation of the above areas to the persons entitled to vote thereon.

3. That the election beheld and conducted pursuant to the provisions of the Charter of the City of Dover as amended.

4. That this Resolution be published in at least two issues of a newspaper published in the City of Dover at least two weeks prior to the date of said election.

Passed August 27,1962.

On motion of Mr. Holpp, seconded by Mr. Zartman, Council adopted the following resolution
