REGULAR COUNCIL MEETING

The Regular Council Meeting was held on November 23, 1998 at 7:30 p.m. with Council President Christiansen presiding. Council members present were Mr. Lambert, Mr. Pitts, Mr. Leary, Mr. Truitt, Mr. Carey, Mrs. Malone, Mr. Salters and Mr. Weller.

Council staff members present were Chief Faulkner, Mr. Lucas, Mr. O'Connor, Mr. DePrima, Mrs. Green and Mr. Rodriguez.

The invocation was given by Reverend Steven Wellman, followed by the Pledge of Allegiance, led by the Girl Scout Troop #506.

AGENDA ADDITIONS/DELETIONS

Mr. Leary requested the addition of item #2-A, to consider a request of the Police Department for an additional civilian employee. Mrs. Malone moved for approval of the agenda as amended, seconded by Mr. Carey and unanimously carried.

ADOPTION OF MINUTES - QUARTERLY OPEN TOWN MEETING OF NOVEMBER 2, 1998

The Minutes of the Quarterly Open Town Meeting of November 2, 1998 were unanimously approved by motion of Mrs. Malone, seconded by Mr. Weller and bore the written approval of Mayor Hutchison.

ADOPTION OF MINUTES - REGULAR COUNCIL MEETING OF NOVEMBER 9, 1998

The Minutes of the Regular Council Meeting of November 9, 1998 were unanimously approved by motion of Mrs. Malone, seconded by Mr. Carey and bore the written approval of Mayor Hutchison.

ELECTION OF OFFICERS - ROBBINS HOSE COMPANY

The Fire Line Officers of the Robbins Hose Company are elected annually on the third Monday of November. The following results from the November 16, 1998 Robbins Hose Company Election were read into the record, as follows:

                    First Assistant Chief            -         Donald Bates

                    Second Assistant Chief         -         Christopher Jacobs

                    Fire Line Captain #2            -         Jack Fortney

Mr. Leary moved for acceptance of the results as reported, seconded by Mrs. Malone and carried with Mr. Carey abstaining.

REQUEST OF POLICE DEPARTMENT - ADDITIONAL CIVILIAN EMPLOYEE (PC LAN TECHNICIAN)

Chief Faulkner submitted a request for an additional civilian employee for the Police Department. The position is for a PC LAN Technician (Pay Grade of GM19), to be totally responsible for the Police Department’s computer system and its network with the City’s Information Services Department and the State of Delaware.

Mr. Leary moved for approval of the request of the Police Department for an additional civilian employee, with a classification of PC LAN Technician. The motion was seconded by Mrs. Malone and carried by a roll call vote of eight (8) yes, one (1) no (Mr. Christiansen).

MONTHLY REPORTS - OCTOBER 1998

Mr. Leary moved for acceptance of the following monthly reports by consent agenda, seconded by Mrs. Malone and unanimously carried:

          Chief of Police Report

City Assessor Report

City Clerk/Alderman Report (Fines)

          Mayor's Report

General Fund, Cash Receipts & Budget Report

Water/Sewer Fund, Revenue & Budget Report

Electric Revenue Fund, Revenue & Budget Report

          Improvement and Extension Fund, Cash Receipts & Budget Report

          Internal Service Fund, Revenue & Budget Report

With reference to the Planning and Inspections Report, Mr. Salters questioned the estimated time for completion of the Dover Housing Authority’s Phase II Project for Derby Estates. Mr. DePrima advised members that completion of the project is scheduled for the end of November 1998 and appears to be on schedule. Responding to Mr. Pitts, Mr. DePrima stated that Derby Estates was previously Georgetown Square Apartments located in the Town Point development.

In response to Mrs. Malone, regarding the City Manager’s Report, Mr. O’Connor stated that the renovations at the Library have been completed. Mr. Leary visited the Library since the renovations have taken place and complimented staff on the project.

Mrs. Malone referred to the number of credit card payments for electric and water bills for the month of October totaling 425, which indicates that the program is successful.

Mr. O’Connor explained the remodeling planned for the main floor of Weyandt Hall, which will include change in lighting and a new layout to better accommodate the more than 7,000 customers that visit the Administrative Services Department per month.

Mr. Salters moved for acceptance of the Planning and Inspections Report and City Manager's Report. The motion was seconded by Mrs. Malone and unanimously carried.

FINAL READING - PROPOSED ORDINANCE

The First Reading of the following proposed ordinance was accomplished during the Council Meeting of November 9, 1998:

Request to General Assembly to Amend Section 49 - Payment and Collection of Taxes; Errors and Delinquents in Assessments

Mr. Leary moved that the final reading of the proposed ordinance be acknowledged by title only, seconded by Mr. Weller and unanimously carried.

Mr. Leary moved for adoption of the following ordinance, seconded by Mrs. Malone and carried by a unanimous roll call vote:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

That the General Assembly of the State of Delaware shall be requested to amend the Charter of the City of Dover by striking the fifth paragraph of Section 49, which section is entitled “Pay and Collection of Taxes; Errors and Delinquency in Assessments,” and by inserting the following paragraph in lieu thereof to read as follows:

The provisions of Title 9, Section 8705 shall be deemed and held to apply to all taxes laid and imposed under the provisions of this act.

ADOPTED: November 23, 1998

Mr. Weller moved to adjourn, seconded by Mrs. Malone and unanimously carried.
