REGULAR MEETING

May 10, 1982

The Annual Meeting of Council was held on May 10, 1982 at 7:30 p.m. with Mayor McDonough presiding. Members present were Messrs. Bewick, Tudor, Boaman, Hardcastle, Carey, Witt, Carroll and Richter.

In the absence of the Reverend J.H. Williams, Council Chaplain, Vice-Mayor Hardcastle offered the invocation.

ADOPTION OF MINUTES - REGULAR COUNCIL MEETING OF APRIL 26, 1982

The Minutes of the Regular Council Meeting of April 26, 1982 were unanimously approved by motion of Mr. Boaman, seconded by Mr. Bewick and bore the written approval of Mayor McDonough.

OATH OF OFFICE - MAYOR AND COUNCIL ELECT

The Honorable William G. Bush, III, Judge of the Superior Court, administered the oath of office to Mayor-elect Crawford J. Carroll and the following Councilmen:

RESOLUTION - MAYOR JOSEPH M. MCDONOUGH

Council unanimously adopted the following resolution:

WHEREAS, Joseph M. McDonough has served the City of Dover since February 10, 1975, when he took office as City Councilman; and

WHEREAS, Joseph M. McDonough was elected Mayor of the City of Dover and has served in that capacity from May 12, 1980 to May 10, 1982; and

WHEREAS, during his tenure as Mayor, the City settled three negotiating contracts among its employees and experienced a steady, orderly growth; and

WHEREAS, an additional burden was placed upon Joseph M. McDonough during the change in City Managers and through his leadership the City Government experienced a smooth transition to the new City Manager; and

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That the Mayor and Council of the City of Dover express their appreciation to Joseph M. McDonough for the time he has devoted and the leadership he has exerted to effectively run a progressive City.

2. That the Mayor and Council of the City of Dover extend their best wishes to Joseph M. McDonough in his future endeavors.

3. That the Mayor and Council of the City of Dover direct the City Clerk to make this resolution a permanent record of the City of Dover to show their appreciation for the leadership rendered by Joseph M. McDonough while serving the City of Dover.

Mayor Crawford Carroll presented Mayor McDonough with framed original of the resolution and a plaque depicting the City Seal and the years of services as Mayor of the City of Dover.

RESOLUTION - ROBERT D. BEWICK, JR.

Council unanimously adopted the following resolution:

WHEREAS, Robert D. Bewick, Jr., has served as a Councilman for the City of Dover from February 9, 1976 to May 10, 1982; and

WHEREAS, during his years as a Councilman, Robert D. Bewick, Jr. has been a member of the Parks, Playgrounds and Trees Committee, the Safety Advisory Committee, the Utility Committee for which he has served as Chairman since 1977, and the Building Code Appeals Committee; and

WHEREAS, Robert D. Bewick, Jr. has devoted his time and attention to the important functions and has played an important role in resolving the problems which have been encountered during his years of service to the City of Dover; and

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That the Mayor and Council of the City of Dover express their extreme appreciation to Robert D. Bewick, Jr. for his untiring devotion to his duties as City Councilman.

2. That the Mayor and Council of the City of Dover extend their best wishes to Robert D. Bewick, Jr. in his future endeavors.

3. That the Mayor and Council of the City fo Dover direct the City Clerk to make this Resolution a part of the permanent records of the City of Dover in expression of their appreciation to Robert D. Bewick, Jr.

Mayor Carroll presented Councilman Bewick with a framed original of the resolution and a plague depicting the years of service as Councilman of the City of Dover.

MAYOR’S REMARKS

Mayor Crawford J. Carroll congratulated all of the newly elected Councilmen, stating that he was looking forward to serving with them as a member of the Council body. He was hopeful that through their guidance and leadership, the City of Dover will be a better place to live in future years.

Mayor Carroll emphasized the importance of this Council to act wisely in matters that affect expenditures and revenues through their legislation.

PRESENTATION OF LAPEL PINS - COUNCILMEN BONAR AND SHEVOCK

Mayor Carroll presented lapel pins to Councilman Bonar and Shevock, containing the seal of the City of Dover.

PROCLAMATION - SMALL BUSINESS WEEK

By motion of Mr. Hardcastle, seconded by Mr. Carey, Council unanimously approved the following proclamation, issued by Mayor Crawford J. Carroll:

President Reagan has proclaimed May 10 - 16 as Small Business Week. In doing so, President Reagan recognizes the determination, the ingenuity, the energy and the economic importance of the millions of small business owners across this land.

Small business is America’s job-maker, employing over half of the nation’s labor force. Small business creates new jobs and new ideas that make America work. Every community, from the largest to the smallest, is built on small business.

Here, today, in our community let us take the time to consider the contributions made by the small business owner. Let us consider the next time we go to the dry cleaners, the movie theatre, the pet shop or the drug store how important small business is to our way of life. The impulse to serve is peculiarly American, and nowhere is that impulse better embodied than in the small business community, and so,

In recognition of the small business owner and his role in our community, now do I, Crawford J. Carroll, Mayor of the City of Dover, hereby designate the week of May 9 - 15, 1982, as Small Business Week.

RESOLUTION - AUTHORIZATION FOR CITY MANAGER - OFFICIAL SIGNATURE - EPA FUNDED PROJECTS

By motion of Mr. Witt, seconded by Mr. Bonar, Council unanimously adopted the following resolution:

BE IT RESOLVED that Robert J. Bartolotta, City Manager of the City of Dover, Delaware, is hereby authorized to affix his signature as the authorized representative of the City of Dover, Delaware, for the execution of all documents necessary for the submission of Federal Grant Applications to the United States Environmental Protection Agency to fulfill a requirement of the Department of Natural Resources and Environmental Control of the State of Delaware and that record of signature of the City Manager be on exhibit in their files.

PROCLAMATION - POLICE MEMORIAL DAY

Mayor Carroll issued the following proclamation:

WHEREAS, the Fraternal Order of Police will commemorate Police Memorial Day on Thursday, May 13, 1982 in Dover; and

WHEREAS, a ceremony will be conducted on the steps of Legislative Hall in Dover at 12:00 noon, on this date; and

WHEREAS, Police Memorial day is set aside annually to pay tribute to the families of those who have died or lost their lives in the line of duty.

NOW, THEREFORE, I, CRAWFORD J. CARROLL, MAYOR OF THE CITY OF DOVER, DO HEREBY PROCLAIM THURSDAY, MAY 13, 1982, AS

ELECTION OF OFFICERS - 1982/83

Vice-Mayor

Mr. Boaman moved to designate Councilman James C. Hardcastle as Vice-Mayor, seconded by Mr. Carey and unanimously carried.

City Solicitor

Mr. Boaman moved that Nicholas H. Rodriguez be designated as City Solicitor, seconded by Mr. Hardcastle and unanimously carried.

Deputy City Solicitor

Mr. Boaman moved that Douglas B. Catts be appointed as Deputy City Solicitor, seconded by Mr. Bonar and unanimously carried.

Chaplain

Mr. Hardcastle moved that the Reverend J.H. Williams be named as Council Chaplain, seconded by Mr. Witt and unanimously carried.

Fire Marshal

Mr. Bonar moved that Jack T. Roe be appointed Fire Marshal for the year 1982/83, seconded by Mr. Carey and unanimously carried.

City Clerk

Mr. Hardcastle moved that William H. Willis be appointed as City Clerk for year 1982/83, seconded by Mr. Carey and unanimously carried.

City Treasurer

Mr. Witt moved that William H. Willis be appointed as Treasurer for the year 1982/83, seconded by Mr. Carey and unanimously carried.

City Alderman

Mr. Hardcastle moved that William H. Willis be appointed as Alderman for the year 1982/83, seconded by Mr. Carey and unanimously carried.

Deputy Alderman

Mr. Boaman moved that Debrah J. Bittner be appointed as Deputy Alderman for the year 1982/83, seconded by Mr. Carey and unanimously carried.

ORDINANCE AMENDMENT - SECTION 2-167 - QUALIFIED MEMBERS - UTILITY COMMITTEE

By motion of Mr. Boaman, seconded by Mr. Richter, Council by a unanimous roll call vote, adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety the second sentence of subpart (a) of Sec. 2-167 and inserting therein the following sentence:

Three (3) of the members of the Committee shall be elected city officials.

ORDINANCE AMENDMENT - SECTION 2-207 - CIVILIAN PENSION PLAN - MEMBERS - BOARD OF TRUSTEES

By motion of Mr. Boaman, seconded by Mr. Hardcastle, Council by unanimous roll call vote adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety Sec. 2-207 and by inserting a new Section to read as follows:

“SEC. 2-207. COMPOSITION.

The Pension Board of Trustees shall consist of the following persons:

(1) The City Manager.

(2) Two (2) elected City officials who shall be appointed by the Mayor, subject to confirmation of a voting majority of the City Council at its annual meeting.

(3) Two (2) persons who shall represent the eligible City employees who shall be chosen by a plurality of the eligible employees voting pursuant to this article. The City Clerk shall notify each employee eligible to vote five (5) days before the meeting to choose representatives and shall give him the exact time and place of the meeting.

ORDINANCE AMENDMENT - SEC. 18-47 - POLICE PENSION PLAN - MEMBER - RETIREMENT COMMITTEE

By motion of Mr. Boaman, seconded by Mr. Witt, Council, by a unanimous roll call vote, adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety Sec. 18-47 and by inserting a new Section to read as follows:

SEC. 18-47

The Retirement Committee shall consist of two (2) elected city officials, the City Manager, the Chief of Police and three (3) members of the Plan.

(1) The City Manager and Chief of Police will serve on the Retirement Committee by virtue of their respective offices and positions with the City of Dover.

(2) The three (3) members of the Plan shall be elected by members of the Plan subject to confirmation of a voting majority of the City Council.

     (a) Such election shall be for three staggered terms, beginning with the 1st day of February and ending with the last day of January three years later. A regular election for filling these positions will be called by the Chief of Police during the month of January each year.

     (b) If an unscheduled vacancy should occur among the elected members, a special election shall be called for the purpose of filling the remainder of such term. Such election shall be called by the Chief of Police within sixty (60) days of the occurrence of such vacancy.

(3) The two (2) elected City officials shall be appointed by the Mayor, subject to confirmation of a voting majority of the City Council at its annual meeting.

(4) Any elected official serving on the committee shall be removable by a three-fourths vote of the City Council excluding any elected official under consideration, after written notice shall have been given the member being considered for removal at a reasonable time prior to the proceeding, stating the time, place and date of the removal proceeding.

ORDINANCE AMENDMENT - SECTION 5-20 - BUILDING CODE APPEALS COMMITTEE

By motion of Mr. Boaman, seconded by Mr. Carey, Council by a unanimous roll call vote, adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety Sec. 5-20 and by inserting a new Section to read as follows:

“SEC 5-20. BUILDING CODE BOARD OF APPEALS.

(a) There shall be a board to be called the Building Code Board of Appeals consisting of three (3) members, one (1) of whom shall be the City Manager and the other two (2) being elected city officials. The two (2) elected city officials shall be appointed by the Mayor, subject to confirmation of a voting majority of the City Council at its annual meeting.

(b) A member of the Building Code Board of Appeal who is an elected city official shall be removable by a three-fourths vote of the City Council excluding any elected official under consideration, after written notice shall have been given the member being considered for removal at a reasonable time prior to the proceedings stating the time, place and date of the removal proceeding.

(c) A requirement, decision or determination made by any administrative official or a request by any official, Board or agency of the City relating to this Article may be appealed within fifteen (15) days from the date that the Appellant receives the determination, request or decision by mail to the last known address of appellant as provided by appellant to the City or within fifteen (15) days after a City official has personally delivered the same to appellant.

(d) All appeals shall be in writing on a form prescribed by the Building Code Board of Appeals.

ORDINANCE AMENDMENT - SECTION 5-60 - MECHANICAL CODE APPEALS COMMITTEE

By motion of Mr. Boaman, seconded by Mr. Bonar, Council by a unanimous roll call vote, adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety, Sec. 5-60 and be inserting a new Section to read as follows:

SEC. 5-60. MECHANICAL CODE BOARD OF APPEALS.

(a) There shall be a board to be called the Mechanical Code Board of Appeals consisting of three (3) members, one (1) of whom shall be the City Manager and the other two (2) being elected city officials. The elected city officials shall be appointed by the Mayor, subject to confirmation of a voting majority of the City Council at its annual meeting.

(b) A member of the Mechanical Code Board of Appeals who is an elected City official shall be removable by a three-fourths vote of the City Council excluding any elected official under consideration, after written notice shall have been given the member being considered, for removal at a reasonable time prior to the proceeding, stating the time, place and date of the removal proceeding.

(c) A requirement, decision or determination made by any administrative official or a request by any official, Board or agency of the City relating to this Article may be appealed within fifteen (15) days from the date that the Appellant receives the determination, request, or decision by mail to the last known address of appellant as provided by appellant to the City or within fifteen (15) days after a City official has personally delivered the same to appellant.

By motion of Mr. Boaman, seconded by Mr. Carey, Council by a unanimous roll call vote, adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety Sec. 5-75 and by inserting a new Section to read as follows:

“SEC. 5-75 - PLUMBING CODE BOARD OF APPEALS

(a) There shall be a board to be called the Plumbing Code Board of Appeals consisting of three (3) members, one (1) of whom shall be the City Manager and the other two (2) being elected city officials. The city officials shall be appointed by the Mayor, subject to confirmation of a voting majority of the City Council at its annual meeting.

(b) A member of the Plumbing Code Board of Appeals shall be removable by a three-fourths vote of the City Council excluding any elected official under consideration, after written notice shall have been given the member being considered for removal at a reasonable time prior to the proceeding, stating the time, place and date of the removal proceeding.

(c) A requirement, decision or determination made by any administrative official or a request by any official, Board or agency of the City relating to this Article may be appealed within fifteen (15) days from the date that the Appellant receives the determination, request, or decision by mail to the last known address of appellant as provided by appellant to the City or within fifteen (15) days after a City official has personally delivered the same to appellant.

ORDINANCE AMENDMENT - SEC. 7-60 - FIRE PREVENTION CODE APPEALS COMMITTEE

By motion of Mr. Boaman, seconded by Mr. Hardcastle, Council by a unanimous roll call vote, adopted the following ordinance:

BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

The Code of Ordinances, City of Dover, is hereby amended by striking in its entirety Sec. 7-60 and by inserting a new Section to read as follows:

SEC. 7-60. THE FIRE PREVENTION CODE BOARD OF APPEALS.

(a) There shall be a board to be called the Fire Prevention Code Board of Appeals consisting of three (3) members, one (1) of whom shall be the City Manager and the other two (2) being elected city officials. The city officials shall be appointed by the Mayor, subject to confirmation of a voting majority of the City Council at its annual meeting.

(b) A member of the Fire Prevention Code Board of Appeals shall be removable by a three-fourths vote of the City Council excluding any elected official under consideration, after written notice shall have been given the member being considered for removal at a reasonable time prior to the proceeding, stating the time, place and date of the removal proceeding.

(c) A requirement, decision or determination made by any administrative official or a request by any official, Board or agency of the City relating to this Article may be appealed within fifteen (15) days from the date that the Appellant receives the determination, request, or decision by mail to the last known address of appellant as provided by appellant to the City or within fifteen (15) days after a City official has personally delivered the same to appellant.

(d) All appeals shall be in writing on a form prescribed by the Fire Prevention Code Board of Appeals.

APPOINTMENTS

Chief of Police

Mayor Carroll appointed Joe A. Klenoski to serve as Chief of Police.

Parks, Playgrounds and Trees Committee

Mayor Carroll appointed James C. Hardcastle as chairman of the Parks, Playgrounds and Trees Committee. Councilman David L. Bonar, Councilman Fred B. Carey, St. and Carrie Russell were appointed as members.

Mayor Carroll requested that the committee review the possibility of filing an opening that still exists on that committee.

By motion of Mr. Witt, seconded by Mr. Richter, Council by a unanimous roll call vote approved the aforementioned appointments.

Safety Advisory Committee

Mayor Carroll appointed Councilman James C. Hardcastle as chairman of the Safety Advisory Committee, with Councilman David L. Bonar and Councilman Fred B. Carey, Sr. to serve as members.

By motion of Mr. Boaman, seconded by Mr. Richter, Council by unanimous roll call vote approved the aforementioned appointments.

Utility Committee

Mayor Carroll appointed John E. Richter as Chairman of the Utility Committee with Councilman Robert H. Tudor, Mayor Carroll and Irving Levitt to serve as members.

By motion of Mr. Witt, seconded by Mr. Carey, Council by a unanimous roll call vote approved the aforementioned appointments.

Wage, Hours & Legislative Committee

Mayor Carroll appointed Councilman Gregory P. Boaman as chairman of the Wage, Hours & Legislative Committee with Councilmen David L. Bonar and David A. Shevock to serve as members.

By motion of Mr. Richter, seconded by Mr. Carey, Council by unanimous roll call vote, approved the aforementioned appointments.

City of Dover Police Pension Committee

Mayor Carroll appointed the City Manager and the Chief of Police to serve on the Police Pension Committee as provided in the ordinance with Councilmen Charles L. Witt and David A. Shevock to serve as the two City officials, along with members elected by the department, Timothy Mullaney, Larry Gray and Gene Phillips.

By motion of Mr. Richter, seconded by Mr. Bonar, Council by unanimous roll call vote approved the appointments.

City of Dover Employees Pension Committee

Mayor Carroll appointed the City Manager, as provided by the ordinance, with Councilmen Charles Witt and David Shevock to serve on the Civilian Pension Committee. Joseph Scott and Douglas VanSant will serve as members elected by the Civilian Pension members.

By motion of Mr. Witt, seconded by Mr. Hardcastle, Council by unanimous roll call vote approved the appointments as submitted.

Building Code Appeals Committee - Plumbing Code Appeals Committee - Mechanical Code Appeals Committee - Fire Prevention Code Appeals Committee

Mayor Carroll appointed the City Manager, as provided by the ordinance, to serve on the above mentioned committees with Councilman Charles L. Witt to serve as chairman and Councilman Robert Tudor to serve as a member.

By motion of Mr. Boaman, seconded by Mr. Richter, Council by unanimous roll call vote approved the aforementioned committee members.

Chamber of Commerce - Liaison Member

Mayor Carroll appointed Fred B. Carey, Sr. to serve as an official representative of the City of Dover on the Chamber of Commerce board.

Mr. Boaman moved for approval of the appointment, seconded by Mr. Hardcastle and unanimously approved by a roll call vote.

PUBLIC HEARING - ABANDONMENT OF 12' ALLEY SOUTH OF LINCOLN STREET, 100' EAST OF CHERRY STREET

A public hearing was duly advertised for this time and place to consider abandoning a 12' unimproved alley, south of Lincoln Street, approximately 100' east of Cherry Street. Mayor Carroll declared the hearing open.

There was no one present to speak for or against the abandonment and no correspondence.

Mayor Carroll declared the hearing closed.

By motion of Mr. Boaman, seconded by Mr. Bonar, Council by unanimous roll call vote adopted the following resolution:

A RESOLUTION VACATING AND ABANDONING A CERTAIN ALLEY SITUATED SOUTH OF LINCOLN STREET, EAST OF CHERRY STREET.

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER:

Section 1. The Council of the City of Dover hereby vacates and abandons the following alley, laid out upon a plot of lands late of Joseph T. Campbell, dated November 24, 1887, recorded in Kent County Orphans Court Plot Book 5, page 102-½, and as also recorded as Dr. R.S. Stephens Lots, dated September 25, 1924, in Kent County Plat Book B, page 17:

ALL that certain strip of land situated in the City of Dover and lying south of Lincoln Street and east of Cherry Street, constituting a 12' wide unopened alley as laid out on a plot of lands late of Joseph T. Campbell, dated November 24, 1887, recorded in Kent County Orphans Court Plot Book 5, page 102-½, and as also recorded as Dr. R.S. Stephens Lots, dated September 25, 1924, in Kent County Plat Book B, page 17, and being more particularly described as follows, to wit:

Beginning at a point in the south line of Lincoln Street, 60' wide, located S 88° 31' E, about 122.21' from the east line of Cherry Street, 25' wide; thence, continuing with the south line of Lincoln Street, S 88° 33' E, 12' to a point; thence, by a line being the easterly line of this alley, S 1° 27' W, about 120', thence, S 88° 33' E, about 125.78' to a point; thence, S 1° 27' W, 12' to a point, thence, by a line being the southerly line of this alley, N 88° 33' W, about 137.78' to a point; thence, N 1° 27' E, about 132' to the point and place of beginning.

Containing 0.071 acres of land, more or less.

Section 2. Since no person has bene deprived of property by vacating and abandoning of the aforesaid alley no compensation is awarded.

Section 3. This resolution shall be effective upon the filing of a revised plot plan of adjoining lands presently owned by Edith Wright, more specifically described in preceding paragraphs of this resolution.

APPROVAL OF NUMBER OF PERSONNEL AND SALARIES - POLICE DEPARTMENT

Mayor Carroll respectfully requested that the matter of approving the number of personnel and their salaries be tabled until such time as the Chief of Police and himself have the opportunity to review the budget and existing manpower. His recommendation will be submitted at a later date.

Mr. Boaman moved that the matter be tabled, seconded by Mr. Carey and unanimously carried.

PROPOSED LOOCKERMAN STREET PARK PROJECT PLAN - SITE OF OLD PIERCE BUILDING

Mr. Hardcastle informed Council that he and Mr. Carey had attended meetings with the committee of the Loockerman Street park project that included Dr. Norman Dill.

Mr. Hardcastle moved that the park project be referred to the Planning Commission, conveying to the body that the Parks, Playgrounds and Trees Committee stands behind the project 100%. The motion was seconded by Mr. Carey and unanimously carried.

HUD REHABILITATION BID - CASE #03 - 16 SOUTH QUEEN STREET

Five bids were submitted to rehabilitate 16 South Queen Street, with Hartnett Realty Company submitting the successful bid in the amount of $12,021. A total of five bids were submitted, four as follows:

            I.R. Carney                             -          $12,784

            Del Homes, Inc.                      -          $13,550

            B & B General Contractors    -          $13,173

            Faith Contractors                    -          $11,660

Faith Contractors were rejected because they did not meet the specifications.

Mr. Bartolotta stated that three contracts have been awarded in the amount of $24,000 total.

Mr. Witt moved to award the contract for 16 South Queen Street to Hartnett Realty Company in the amount of $12,021. The motion was seconded by Mr. Hardcastle and carried by a unanimous roll call vote.

REZONING REQUEST BY PLANNING COMMISSION - BLUE HEN MALL

A request was received from the City of Dover Planning Commission to rezone the Blue Hen Mall as a regional shopping center. Prior to amending the zoning map and zoning ordinance of the City of Dover, a public hearing is required.

Mr. Witt moved that a public hearing be held on June 14, 1982 at 7:45 p.m., seconded by Mr. Carey and by a unanimous roll call vote, Council adopted the following resolution:

A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP FOR THE CITY OF DOVER AND DIRECTING THAT NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain lands located on Route #113 (known as the Blue Hen Mall) are presently zoned for C-4 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the zoning map and zoning ordinance of the City of Dover.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That a public hearing be held in City Hall on June 14, 1982 at 7:45 p.m. on a proposed amendment to the zoning map that would rezone from C-4 to SC-3 that property located on Route #113 (known as the Blue Hen Mall), owned by Jardel, Inc.

2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

CORRESPONDENCE

Request to Construct Boat Dock - Silver Lake - George and Marjory Records

A letter was received from George and Marjory Records of 111 Walker Road, requesting permission to construct a 6' x 20' boat dock, adjacent to their property on Silver Lake.

Mr. Witt moved that the matter be referred to the Parks, Playgrounds and Trees Committee, seconded by Mr. Shevock and unanimously carried.

Mayor Carroll suggested that the plans for construction of the dock be reviewed by the City Manager before consideration by the committee.
