REGULAR MEETING

October 8, 1973

The regular meeting of City Council was held on Monday, October 8, 1973 at 7:30 P.M. with Mayor Carroll presiding. Members present were Messrs Biggs, Harris, Hayes, Holpp, Legates, Muir and Walls. Councilman Holmes was absent.

The invocation was said by Rev. J. H. Williams, Council Chaplain.

MINUTES

The minutes of the Council meeting of September 24, 1973 were accepted and bore the written approval of Mayor Carroll.

REPORTS

Chief of Police report for month of September was accepted.

Building Inspector & Fire Marshal report for month of September was accepted.

City Planner report for the month of September was accepted.

Alderman report for September was accepted, fines in amount of $862 were remitted.

Cash Receipts, General Fund, for month of September were accepted.

Cash Receipts, Electric Revenue Fund, for month of September were accepted.

Cash Receipts, Electric Improvement Fund, for month of September were accepted.

City Manager report for month of September was accepted.

STEEL POLES - TRANSMISSION LINE

Bids were received on October 2, 1973 for steel transmission poles for the expansion of the McKee Run Generating Station. Bids were requested from five suppliers but on one responded, at a bid price of $126,275. Laramore, Douglass & Popham has recommended that the bid be awarded to Meyer Industries, Inc. at the bid price of $216,275 for the Tubular Steel poles as specified in the above bids. On motion of Mr. Muir, seconded by Mr. Biggs, Council awarded the contract for the above bid as outlined and recommended by the engineer.

CITY HALL MILLWORK

City Manager James requested permission of Council to award a contract to Wilkinson Associates, Inc. for the millwork for the interior of City Hall now under construction. The amount of the contract is $10,000 and will cover the millwork in the Council Chambers. On motion of Mr. Harris, seconded by Mr. Biggs, Council by a vote of 7 ‘yes’ and 1 ‘absent’, Mr. Holmes, awarded the abovementioned contract to Wilkinson Associates, Inc.

SAFETY ADVISORY COMMITTEE

A written report of the Safety Advisory Committee meeting held on October 1, 1973 was presented by Chairman Walls. On motion of Mr. Legates, seconded by Mr. Muir, Council accepted the report as presented.

ROBBINS HOSE COMPANY WARNING SIGNS

Robbins Hose Company had requested permission to install warning devices on South Governors Avenue to replace the present warning devices. Permission was granted by Council but a request has been made to increase the size from 3' x 4' to 5' x 7'. The Highway Department has approved the erection of these traffic control devices. On motion of Mr. Biggs, seconded by Mr. Legates, permission was granted to Robbins Hose Company for the erection of the traffic control devices.

PARKS, PLAYGROUNDS & TREES COMMITTEE

A written report of the Parks, Playgrounds & Trees Committee meeting held on October 1, 1973 was presented by Chairman Walls. On motion of Mr. Hayes, seconded by Mr. Legates, Council approved the report as presented.

TARBURTON PARK BALL FIELD

A request has been made to ball field to be located at Tarburton Park be built as a softball field instead of a hardball field. The Parks Committee has studied this request and had recommended that his be done prior to completion of this project. A discussion of Council followed whereby a request was made that the Committee further study the needs of the recreation programs in the City of Dover in regard to the uses of the fields in the City for baseball and softball. This study will be made and recommendations returned to Council.

FAULKNER REZONING

A request was received to rezone property located on New Burton Road. Prior to amending the Zoning Ordinance and Map a public hearing is required. On motion of Mr. Walls, seconded by Mr. Hayes, Council adopted the following resolution and referred the request to the Planning Commission.

A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP OF THE CITY OF DOVER AND DIRECTING THAT NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain property located on the east side of New Burton Road is presently zoned for R-20 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the zoning map and zoning ordinance of the City of Dover.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That a public hearing be held in City Hall Annex on November 12, 1973 at 8:00 PM on a proposed amendment to the zoning map that would rezone from R-20 to C-1A that property located on the east side of New Burton Road, north of Garton Road, owned by James & Edith Faulkner, equitable owner being Timothy Bounamici, and containing approximately 5 acres.

2. That notice of this public hearing be given in accordance with the provisions of the Delaware Code.

ADOPTED OCTOBER 8, 1973

WILDCAT ENTERPRISES LANDFILL

A letter was received from Wildcat Enterprises Landfill offering for sale or lease the property they own and had until recently operated as a landfill. This landfill has since been closed by the State. On motion of Mr. Hayes, seconded by Mr. Muir, Council referred this request to the Utility Committee for their study and recommendation.

KENT GENERAL HOSPITAL

A letter was received from Kent General Hospital asking that they be permitted to share in the Revenue Sharing Money received by the City of Dover. On motion of Mr. Legates, seconded by Mr. Muir, Council referred this request to the Committee of Committees for their study and recommendation.

NATIONAL OIC DAY PROCLAMATION

A proclamation was issued this date by Mayor Crawford J. Carroll designating October 11, 1973 as “National OIC Day”. This day has been proclaimed throughout the country to hone the Reverend Leon H. Sullivan, the father of the OIC movement.

DRUG ABUSE PREVENTION WEEK

A proclamation was issued this date by Mayor Crawford J. Carroll designating the week of October 21-27, 1973 as Drug Abuse Prevention Week. This is a national designation urging all the citizens of this country to become involved in drug abuse prevention for this week and every week throughout the year.

HALLOWEEN PROCLAMATION

A proclamation was issued this date by Mayor Crawford J. Carroll limiting the observance of Halloween to October 30, 1973 and setting a curfew of 10:00 PM subject to the penalties provided by the ordinances of the City of Dover.

FOXHALL PLANTATION REZONING

A public hearing was duly advertised for this time and place to consider the rezoning of approximately 50 acres of land located adjacent to the Foxhall Plantation Development. Mayor Carroll declared the hearing opened. Mr. James McClements owner of the property was present and spoke for the rezoning. Mr. Ira Schwaetzberg, a resident of Foxhall was present and spoke against the rezoning. Mr. N. C. Vasuki, spokesman for a group of residents in the Foxhall Development addressed Council with their concerns for the rezoning and development of this area in question. A petition was presented to Council opposing the rezoning. Their feeling is that a through-street would be a traffic generating hazard to the present development. The Planning Commission has recommended approval of this request. A large contingent of residents were present from the Foxhall area. After much discussion on this request, Mayor Carroll declared the hearing closed. On motion of Mr. Muir, seconded by Mr. Harris, Council by a roll call vote of 5 ‘yes’, 2 ‘no’, Messrs Holpp and Legates, and 1 ‘absent’, Messr Holmes, Council adopted the following ordinance.

AN ORDINANCE AMENDING THE ZONING ORDINANCE AND ZONING MAP OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF THE PROPERTY LOCATED ADJACENT TO THE FOXHALL PLANTATION DEVELOPMENT FROM R-20 TO R-8, R-10 & RG-3 USE.

WHEREAS, the City of Dover has enacted a zoning ordinance regulating the use of property within the city of Dover, and

WHEREAS, it is deemed in the best interest of the zoning and planning to change the permitted use of the property described below from R-20 to R-8, R-10 & RG-3.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

1. That from and after the passage and approval of this ordinance the Zoning Map and Zoning Ordinance of the City of Dover has been amended by changing the zoning designation from R-20 to R-8, R-10 & RG-3 on that property located adjacent to Fox Plantation Development, owned by James McClements, and containing approximately 50 acres.

ADOPTED OCTOBER 8, 1973

After the adoption of the above ordinance two petitions were presented to Council by Mr. Vasuki on behalf of the residents of Foxhall protesting the rezoning and opposing the connecting road between Foxhall and the rezoned areas.
