REGULAR MEETING

June 25, 1973

The regular meeting of City Council was held on Monday, June 25, 1973 at 7:30 P.M. with Mayor Carroll presiding. Members present were Messrs. Biggs, Harris, Hayes, Holmes, Holpp, Legates, Muir and Walls.

The invocation was said by Reverend Rudolph W. Coleman, pastor of the Mt. Zion A. M. E. Church.

MINUTES

The minutes of the regular Council meeting of June 11, 1973 were accepted and bore the written approval of Mayor Carroll.

The minutes of the special Council meeting of June 12, 1973, were accepted and bore the written approval of Mayor Carroll.

TOWN REZONING

The rezoning of the property located on South Bradford Street owned by Jehial and Doris Kohn, tabled on June 11, 1973, was scheduled again for this meeting. On motion of Mr. Hayes, seconded by Mr. Holmes, Council removed from the table the rezoning of Jehial and Doris Kohn. Mayor Carroll declared the hearing opened. The Planning Commission has recommended denial of this request due to limited off-street parking and spot zoning. Mayor Carroll declared the hearing closed. On motion of Mr. Holmes, seconded by Mr. Hayes, Council by unanimous roll call vote denied the rezoning request of Jehial and Doris Kohn.

CURB AND GUTTER RESOLUTION

A recommendation has been received to install concrete curb and gutters on Edgemont Avenue, North Edgehill Avenue and Spring Garden Avenue. On motion of Mr. Hayes, seconded by Mr. Holpp, Council by unanimous roll call vote adopted the following resolution.

A RESOLUTION SETTING FORTH A PUBLIC HEARING TO CONSIDER THE INSTALLATION OF CURB AND GUTTERS ON BOTH SIDES OF EDGEMONT AVENUE, NORTH EDGEHILL AVENUE AND SPRING GARDEN AVENUE.

WHEREAS, the City Council of the City of Dover is considering the installation of concrete curb and gutters on both sides of Edgemont Avenue, North Edgehill Avenue and Spring Garden Avenue and charging the cost thereof to property owners, and

WHEREAS, the Charter of the City of Dover requires that a public hearing be held prior to such action, at which time the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. The Council of the City of Dover will hold a public hearing in the City Hall Annex on July 9, 1973, at 8:00 P.M., on the question of installation of concrete curb and gutters on both sides of Edgemont Avenue, North Edgehill Avenue and Spring Garden Avenue and assessing the cost thereof to the property owners.

2. The following named person-persons are the owners or the purported owners of the properties in front of which the concrete curb and gutters will be installed.

3. At the said meeting the Council will hear the aforesaid owners of property and other residents of the City in accordance with the Charter of the City of Dover.

ADOPTED JUNE 25, 1973

PROJECT #56 - SCHWARTZ-SHERATON SANITARY SEWER

Bids were received on June 25, 1973, for project #56, Schwartz-Sheraton Sanitary Sewer. Three (3) bids were received with the low bidder being Teal Construction Company at the bid price of $74,164.60. On motion of Mr. Hayes, seconded by Mr. Walls, Council awarded the contract for Project #56, Schwartz-Sheraton Sanitary Sewer, to the low bidder, Teal Construction Company for the bid price of $74,164.60.

PROJECT #59 - K-MART STORM DRAINAGE

Bids were received on June 25, 1973, for Project #59, K-Mart Storm Drainage. Three (3) bids were received with the low bidder being Teal Construction Company at the bid price of $64,521.00. The prior agreement with the City of Dover and the builders of K-Mart was that the cost of the construction of the storm drain would be borne by the builder. The storm drain will be built to the specifications of the City of Dover. The money will be escrowed by the builder prior to construction of the storm drain. On motion of Mr. Hayes, seconded by Mr. Walls, the contract was awarded to the low dibber, Teal Construction Company, at the bid price of $64,521.00. Construction to begin upon receipt of the full amount from the builder to be put in escrow.

DEMOLITION OF OLD WAREHOUSE

Four (4) bids were submitted for the demolition of the old warehouse on William Street with the low bidder being Charles Patterson with the bid price of $2,500.00. On motion of Mr. Legates, seconded by Mr. Biggs, the contract for the demolition of the old warehouse was awarded to Charles Patterson at the bid price of $2,500.00

HARTLY ROAD ANNEXATION REQUESTS

As requested by Council all property owners on the south side of Hartly Road that has previously expressed an interest of being annexed into the City were contacted by the City Manager. Only four (4) annexation requests were received at this time from J. Oakley Biddle, Maynard Reed, Clifford Ennis and Howard Pollitt for their properties located on Hartly Road. On motion of Mr. Hayes, seconded by Mr. Walls, action was tabled until the next Council meeting on July 9, 1973.

REVENUE SHARING REQUESTS

At this time, letters were presented to Council on requests for monies received from the Federal Government for Revenue Sharing. The letters submitted were from the following organizations:

1.   Dover Housing Authority - Iva L. Tazelaar, Executive Director

2.   Delaware State College - Luna I. Mishoe, President

3.   Catholic Social Services, Inc. - Margaret P. Weller, Chief

4.   Delaware Adolescent Program, Inc. - Lulu Mar Nix, Administrative Director

On motion of Mr. Holmes, seconded by Mr. Harris, these requests were referred to the Legislative and Finance Committee for their study and recommendation.

TENT REVIVAL

A request has been received from Reverend Ernest Conner to conduct a tent revival on the corner of Fulton and Kirkwood Streets during the month of July, 1973. On motion of Mr. Hayes, seconded by Mr. Walls, Council approved this request with the approval of the Building Inspector.

McNINCH LETTER

A letter was received from James R. McNinch, M. D., protesting the increase in license fees for the practice of medicine and surgery within the City of Dover. Council acknowledged receipt of this letter and on motion of Mr. Hayes, seconded by Mr. Legates, Council requested a letter be sent to all physicians and surgeons in the City of Dover explaining the increase in license fees fully and emphasizing that the fees were not raised to subsidize the ambulance service implied in the letter from Doctor McNinch.

SIDEWALK SALE

A letter was received from the Central Dover Business Association, Inc., requesting permission to hold a sidewalk sale on the sidewalks from State Street, across Governors Avenue and down Loockerman Street on July 13 and 14, 1973. On motion of Mr. Legates, seconded by Mr. Walls, Council approved this request pending final approval from the City Manager and the Chief of Police.

CHAPEL BUILDERS REZONING

A public hearing was duly advertised for this time and place to consider the rezoning of the property located on Bacon Avenue owned by Chapel Builders. Mayor Carroll declared the hearing opened. Mr. Jack Roe, Building Inspector, addressed Council stating that according to City records this area has always been zoned RG-2. Mr. James W. Carr, representative of the Towne Point Citizens Committee, addressed Council with a petition, signed by 268 residents, opposing the rezoning of this area from RG-2 to RG-3. A letter was read from Mr. Steven Michael Thompson opposing the rezoning. Mr. Greg Kirkwood, President of the Towne Point Elementary School P. T. A., opposed the rezoning of this area. The Planning Commission had recommended approval of this request. Mayor Carroll declared the hearing closed. On motion of Mr. Biggs, seconded by Mr. Walls, Council denied the rezoning request of Chapel Builders for their property located on Bacon Avenue.

BACON AVENUE REZONING

A request has been received to rezone property located on Bacon Avenue in Towne Point. A public hearing is required prior to amending the Zoning Ordinance and Zoning Map. On motion of Mr. Holmes, seconded by Mr. Walls, Council adopted the following resolution.

A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP OF THE CITY OF DOVER AND DIRECTING THAT NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain property located on Bacon Avenue is presently zoned for RG-2 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the Zoning Ordinance and Zoning Map.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That a public hearing be held in City Hall Annex on July 23, 1973, at 8:00 P.M. on a proposed amendment to the Zoning Ordinance and Zoning Map of the City of Dover that would rezone from RG-2 to R-8 that property located on Bacon Avenue, owned by Chapel Builders and containing approximately 3.6 acres.

2. That notice of this public hearing be given in accordance with the provisions of the Delaware Code.
