REGULAR MEETING
March 12, 1973
The regular meeting of City Council was held on Monday, March 12, 1973 at 7:30 P.M. with Mayor Carroll presiding. Members present were Messrs Biggs, Harris, Hayes, Holmes, Holpp, Legates, Muir and Walls.
MINUTES
The minutes of the regular City Council meeting of February 26, 1973 were accepted and bore the written approval of Mayor Carroll.
REPORTS
Chief of Police report for the month of February was accepted.
Building Inspector & Fire Marshal report for the month of February was accepted.
City Planner report for the month of February was accepted.
Alderman report for the month of February was accepted, fines in the amount of $1,010 were remitted.
Cash Receipts, General Fund, for month of February were accepted.
Budget Report, General Fund, for month of January was accepted.
Cash Receipts, Electric Revenue Fund, for month of February were accepted.
Cash Receipts, Electric Improvement Fund, for month of February were accepted.
City Manager report for month of February were accepted.
PARKS, PLAYGROUNDS & TREES COMMITTEE
A written report of the Parks, Playgrounds & Trees Committee meeting held on March 5, 1973 was presented by Chairman Walls. On motion of Mr. Muir, seconded by Mr. Biggs, Council accepted the report as presented.
TOUCH FOOTBALL LEAGUE
The Dover Touch Football League, under the previous sponsorship of the YMCA, is in jeopardy of being disbanded due to lack of supervision. A recommendation has been made by the Parks, Playgrounds & Trees Committee to try and work the supervision of this league into the City of Dover Recreation Program. The City of Dover now furnishes the electricity for the lights for this program and the teams are sponsored by outside interests. On motion of Mr. Legates, seconded by Mr. Hayes, Council directed the Recreation Director to attempt to fit this program into the City of Dover Recreation Program at no further cost to the City.
SIDEWALK ASSESSMENT - EASTOVER HILLS
A public hearing was duly advertised for this time and place to consider the assessment and levy of the cost of installation of sidewalks in the Eastover Hills area. Mayor Carroll declared the hearing opened. No one was present to speak for or against the assessment and levy. The Utility Committee has recommended a charge of 65¢ per square foot of sidewalk installed be assessed. Mayor Carroll declared the hearing closed. On motion of Mr. Hayes, seconded by Mr. Muir, Council by unanimous roll call vote approved the levy and assessment of charges for installation of sidewalks and terms of payment as outlined in the ordinance adopted by City Council on February 26, 1973.
TAX APPEALS - TAX APPEALS COMMITTEE
The Mayor has appointed Councilman Hayes, Councilman Legates and Councilman Holpp to serve as the Tax Appeals Committee for the year of 1973. The Tax appeal hearings will be held as follows: April 2, 1973 between the hours of 1:00 PM and 4:00 PM; and on April 9, 1973 between the hours of 1:00 PM and 4:00 PM and at the regularly scheduled Council meeting commencing at 7:30 PM.
SUBURBAN LIQUORS ANNEXATION REQUEST
A request was received from Suburban Liquors located on Forest Street requesting annexation of their property within the City of Dover. On motion of Mr. Walls, seconded by Mr. Hayes, Council referred this request to the Utility Committee for their study and recommendation.
CIVIC CENTER STUDY COMMITTEE
Mayor Carroll at this time appointed a Committee to study the feasibility of building a civic center in the City of Dover. Also this committee will be charged with the study of the feasibility of using Revenue Sharing Money for this purpose and allocating any other costs in this project. Councilman Harris stated that he felt that a committee should also be formed to study other uses of the Revenue Sharing Money, and ways and means of distributing this money throughout the City of Dover to most benefit all of the local citizens. Mayor Carroll stated that in forming this committee, it was his intention to have them make such a study and recommendation in their findings. STATE HUMAN RELATIONS COMMISSION
A letter was received from Richard Comegys, State Human Relations Commission, attached to an agreement that he has requested be signed by both the City of Dover and the State Human Relations Commission. The agreement arose out of a complaint against the City of Dover and the Dover Housing Authority over the availability and/or unavailability of sites for low-cost housing in the City of Dover. On motion of Mr. Legates, seconded by Mr. Walls, Council requested that copies of this agreement be made available to the Council for their study and consideration, further action to be taken at a later date.
JOINT USE AGREEMENT
The Council met with the Kent County Levy Court on Thursday, March 8, 1973, concerning the Joint Use Agreement wit the Kent County Levy Court and the Dover Air Force Base. Discussion took place concerning the signing of such an agreement and the use of such a facility by the County and a private contractor in providing service to the Dover area. On motion of Mr. Harris, seconded by Mr. Legates, Council by a roll call vote of 7 ‘yes’ and 1 ‘no’, Mr. Walls, stated that the City Council would favor a Joint Use Agreement between the Kent County Levy Court and the Federal Government provided a feasibility study would indicate that a break-even proposition would be practical and possible on running such a facility. The Levy Court will be so notified. Mayor Carroll expressed concern on Council’s action because a number of other questions have not been answered.
BUSINESS LICENSE ORDINANCE
Council at this time considered the adoption of ordinances that would change the business license fees of the City of Dover. On motion of Mr. Hayes, seconded by Mr. Biggs, Council by a roll call vote of 6 ‘yes’ and 2 ‘no’, Messrs. Harris and Holmes, adopted the following ordinance.
AN ORDINANCE AMENDING THE DOVER MUNICIPAL CODE CONCERNING BUSINESS LICENSES AND LICENSE FEES
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
That the Dover Municipal Code sections pertaining to business licenses shall be amended in the following respects:
1. Section 18-33 of the Dover Municipal Code shall be amended by including in the definitions of businesses requiring business licenses the attached new definitions and amended definitions.
2. Section 18-34 of the Dover Municipal Code is amended by including therein the names of new businesses attached hereto and the new rates of existing businesses as shown on the schedule attached hereto.
3. Section 18-34 of the Dover Municipal Code is amended by changing the rates for manufacturers and contractors from two-hundredths of one per cent (2/100 of 1%) of aggregate gross receipts to three-hundredths of one per cent (3/100 of 1%) of aggregate gross receipts and providing a minimum license fee of Twenty Dollars ($20.00) instead of Two Dollars and Fifty Cents ($2.50). Also, said section is amended by changing the rates for merchants and bottlers from two-hundredths of one per cent (2/100 of 1%) aggregate gross purchases for resale to three-hundredths of one per cent (3/100 of 1%) aggregate gross purchases for resale and providing a minimum license fee if Twenty Dollars ($20.00) rather than Two Dollars and Fifty Cents ($2.50) as formerly stated.
4. Section 18-33 of the Dover Municipal Code is amended by deleting the following language from the same:
“Any person, firm or corporation which shall be required to obtain a merchant’s license shall not be required to obtain any other license hereunder with the exception of the eating house keeper, who shall be required to obtain both the merchant’s license and the eating house keeper’s license.
5. Section 18-32 of the Dover Municipal Code is amended by adding new subsections to the same to be known as subsection (d) and (e).
“(d) Date when license fee must be paid and penalty for non-payment. In the event that the license fee is not paid on or before August 1 of each year, then the license fee shall incur a penalty in the amount of Ten per cent (10%) per month of the amount of license fee until the same is paid.”
“(e) Each day that the license fee is delinquent and not paid shall constitute a separate violation and a summons may issue to initiate a criminal prosecution for each day that the license fee goes unpaid.”

TYPE OF LICENSE DEFINITION
ART SCHOOL “Art School” includes every person engaged in the business of teaching fine arts, or the art whose aim is beauty rather than utility, though not necessarily to the exclusion of utility where the two can be obtained.
AUTOMOBILE RACE OPERATOR “Automobile Race Operator” includes every person in the business of conducting motor vehicle races for profit, including competition involving all recognized classes of stack, modified or sports cars, midget racers, drag races, and every type of motor vehicle in any form of race competition or time trial; for purposes of this license, motorcycle races shall be included.
BANK, LOAN, FINANCE CO. Each bank, finance company or building and loan association or trust company.
BEAUTY SCHOOL “Beauty School or School of Cosmetology” includes every person engaged in operating a place or part thereof, wherein or whereupon cosmetology or any of its practices are taught, whether such place or establishment is known or designated as a cosmetician, cosmetological or beauty culture school or establishment, or by any other name or designation indicating that cosmetology is taught therein to students.
CAR WASH “Car Wash” includes every person operating a continuing business or cleaning, washing or waxing motor vehicles for profit and not for charitable or educational purposes.
CESSPOOL CLEANER “Cesspool Cleaner” includes every person engaged in the business of cleaning cesspools for profit or reward.
CIRCUS EXHIBITOR “Circus Exhibitor” includes every person engaged in the business of exhibiting in a tent, arena or other open space feats of horsemanship, acrobatic stunts, freaks, trained or wild animals, and other forms of entertainments commonly known as circus or carnival for private profit sponsored by or in which any fire company of the State, or any fraternal, veteran’s or religious organization, shall share in the profits. The license fee for such circus or carnival shall be $200.
COMMERCIAL SIGN BUSINESS All persons engaged in the business of outside sign advertising business consisting of the erection, construction, maintenance or leasing of outside signs, bulletin boards and poster boards shall apy, per year, the license fee therefor, as required by section 35-53.
DANCING SCHOOL “Dancing School” includes every person engaged in the business of using any room, place, or space for the purpose of holding classes in dancing and where instruction in dancing is given for hire.
DENTAL LAB. **
DIRECT MAIL SERVICE **
GAS, LIGHT, POWER CO. All gas, electric light and power companies shall pay, per year, the license fee as required by section 35-53; provided, however, that this license does not cover sales of appliances or equipment for which a separate license shall be required.
HEALTH SPA OR HEALTH CLUB “Health Spa or Health Club” includes every person engaged in the business of operating private health, weight control or physical culture facilities designed to establish and maintain the optimum weight or physical conditioning of other persons.
INSURANCE ADJUSTOR **
INCOME TAX CONSULTANT “Income Tax Consultant” includes every person, not licensed as an attorney or accountant under this section, engaged in the business of providing federal or state income tax assistance to other persons for a fee.
JUNK DEALER “Junk Dealer” includes every person engaged in the business of buying and selling old iron, brass, lead, copper, or other metals, or combinations thereof, paper, old automobile tires, second-hand personal property of any kind or description whatever commonly known as junk, and who is not a salvage yard operator as defined in this section.
MANUFACTURER’S AGENT OR
REPRESENTATIVE “Manufacturer’s Agent or Representative” includes every independent contractor in the business of representing one or more manufacturers for purposes of promoting the sale of goods, product, or line of goods or products of such manufacturer or manufacturers within the State.
MODELING OR CHARM SCHOOL “Modeling or Charm School” includes every person engaged in the business of teaching or who holds himself out as capable of teaching modeling, charm, poise or personal appearance to other persons of either sex. It includes courses in public speaking conducted for profit.
MUSIC SCHOOL “Music School” includes every person engaged in the business of teaching music to 20 or more students for a consideration. It includes the teaching of musical composition as well as the instruction in the use of musical instruments.
NURSING, REST OR CONVALES-
CENT HOME (PRIVATE) “Nursing, Rest or Convalescent Home (Private)” includes every person engaged in the business of operating any institution, building or agency in which accommodation is maintained, furnished or offered for any fee, gift, compensation or reward for the care of aged, infirm, chronically ill or convalescent persons.
OUTDOOR MUSICAL FESTIVAL
PROMOTER “Outdoor Musical Festival Promoter” includes every person engaged in the business or organizing, operating, producing or staging musical entertainment in open spaces and not in a permanent structure for a gathering of 500 or more persons to view and/or hear such musical entertainment.
PHARMACIST “Pharmacist” includes every person qualified under the laws of the State to practice pharmacy and engaged in active practice of such profession.
PHYSICAL THERAPIST “Physical Therapist” includes every person engaged in the business of practicing physical therapy as defined in Chapter 26 of Title 24.
PRIVATE DETECTIVE AGENCY “Private Detective Agency” includes every person engaged in the business of practicing as a private detective as defined in Chapter 13 or Title 24; to include any person exclusively employed as a guard, watchman or private patrolman.
PSYCHOLOGIST “Psychologist” includes every person qualified under the laws of the State to practice psychology and engaged in active practice of such profession.
PUBLIC STENOGRAPHER “Public Stenographer” includes every person engaged in the business, whether full time or part time, of providing stenographic services to the general public.
PURCHASE ORDER SYSTEM
OPERATOR “Purchase Order System Operator” includes every person engaged in or holding himself out to do the business of selling orders for or furnishing or guaranteeing the credit on the account of any person for the purchase of goods, wares or merchandise at any store or other establishment for the profit of such operator and shall include factors engaged in such activities, but shall not include persons engaged in a business other wise herein defined as a finance or small loan agency, nor any bank, savings bank or other like financial institutions.
RADIO AND T.V. REPAIRMAN “Radio and T.V. Repairman” includes every person engaged in the business of installing, adjusting, repairing or reconditioning radio and television receivers.
PEOPLE SELLING COMMODITIES
WHICH DO NOT HAVE A
BUSINESS WITHIN THE CITY Each person, firm or corporation whose place of business is not within the corporate limits of the City, but who is engaged in the business of supplying to the inhabitants of the City commodities including but not limited to fuel, oil, gasoline, kerosene, milk or services including but not limited to laundry, dry cleaning sale of real estate or other commodities.
SCIENTIFIC LABORATORY “Scientific Laboratory” includes every person who operated as a private business for a profit a scientific or medical laboratory offering testing, research, analytical and other such technical services to the public.
SOUND TRUCK (Only in commercial and industrial areas) per hour - $25.00.
TAXIDERMIST “Taxidermist” includes every person who prepares, stuffs or mounts the skins of birds, quadrupeds, fist or other animals for hire.
TELEPHONE ANSWERING
SERVICE “Telephone Answering Service” includes every person engaged in the business or providing private operators or automatic equipment for answering private or business telephones in order to take messages from and/or provide information to callers on the lines thereby served.
TELEPHONE COMPANY
TRAILER PARK “Trailer Park” includes every person engaged in the business of operating any place or space where trailers may park and hook up to sanitary and/or electric facilities.
AIRLINE TICKET SALES OFFICE “Airline Ticket Sales Office” includes every person who operates an office engaged in the business of selling tickets for the transportation of passengers on his own airliner.
TREE SURGEON “Tree Surgeon” includes every person skilled in the science of tree care who presents himself to the public for compensation as a practicing tree expert, whether he terms himself a tree expert, arborist, tree specialist or tree surgeon, etc.
X-RAY LAB. *
* PROFESSIONAL SERVICES Persons engaged in professional services such as accountants, whether certified or public, architects, optometrist, lawyers, dentists, physicians and surgeons, osteopathic physicians and surgeons, chiropodists and chiropodial surgeons, chiropractic physicians, consulting chemists, civil engineers, consulting engineers, electrical engineers, structural engineers, professional engineers, heating engineers, air conditioning engineers, mechanical engineers, veterinarians and X-Ray laboratories shall pay, per year, a license fee as required in section 35-53 for engaging in such professional services within the City; provided, however, that no license shall be required of any individual encompassed within this section who is in the employ of any corporation licensed under any other provisions of this chapter and who does not practice his profession except in his capacity as an employee of such corporation; and provided, further, that no attorney in the employ of any such corporation shall be required to obtain a license under this section so as to fulfill assignments made to him by any state court.
** NONPROFESSIONAL SERVICE BUSINESSES GENERALLY Nonprofessional service businesses such as bath and massage salons, barber shops, beauty parlors, cleaners, dyers and pressers of clothes, pathological laboratories, dental laboratories, chemical laboratories, insurance adjusters, advertising agencies, general repairmen, travel ticket agencies, automobile service clubs and associations, watch and clock repairmen, collection agencies, other than note departments of banks and trust companies and finance companies, credit bureaus, credit rating and reporting agencies, cutlery sharpeners, physiotherapists, direct mail advertising services, employment agencies, pest control and exterminators, furniture upholsters and cleaners, laundries, lightning rod designers and systems, lithographers, opticians, photostat services, photographers, photoengravers, locksmiths, magazine subscriptions, radio and television repairmen, reducing salons, printers, linotype services, saw sharpeners, sewing machine services and repairs, shoe repair service, surveyors, tailors, taxidermists, telephone answering services, typesetters, typographers, weavers, undertaking establishments, menders and zipper repairers shall pay, per year, a license fee as required by section 35-53 for each store or place of business, or vehicle, from which the license conducts the business, operated within the city.
BUSINESS LICENSE FEES
On motion of Mr. Muir, seconded by Mr. Holpp, Council by a roll call vote of 6 ‘yes’ and 2 ‘no’, Messrs Harris and Holmes, adopted the following ordinance pertaining to business licenses fees.
A ORDINANCE REQUIRING LICENSES FOR CERTAIN TRADES, BUSINESSES, AND OCCUPATIONS WITHIN THE CITY OF DOVER, PRESCRIBING LICENSE FEES THEREFORE, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. As of June 1, 1973, with the issuance of the business licenses for the year 1973-1974, no person shall conduct or engage in any trade, business, or occupation within the City of Dover for which a license is required without first having obtained a license therefor and paid the license fee prescribed for such trade, business, or occupation.
The term “person” shall be construed for the purposes of this Ordinance to include any individual, partnership, firm, association or corporation.
2. Licenses shall be required for the following trades, businesses and occupations in the City of Dover and the license fees shall be as set forth beside the names of said trades, businesses and occupations:

Every manufacturer and contractor shall file with the Clerk of Council on or before the 30th day of June of each year a written statement verified by the oath or affirmation of the individual licensee, or one member of the partnership, firm or association, or the president, treasurer or secretary of a corporation, setting forth the aggregate gross receipts of such business during the year ending on the 1st day of June preceding. The license fee for each such manufacturer or contractor shall be three hundredths of one per cent (.03%) of the gross receipts so reported, but not less than $20.00.
Every merchant and bottler shall file with the Clerk of Council on or before the 30th day of June each year a written statement verified by the oath or affirmation of the individual licensee, or one member of the partnership, firm or association, or the president, treasurer or secretary of a corporation, setting forth the aggregate cost value of all merchandise purchased for sale in the course of such business during the year ending on the 1st day of June preceding. The license fee for such merchant or bottler shall be three hundredths of one per cent (.03%) of the gross purchases for sale so reported, but not less than $20.00.
Evert non-resident contractor who has not filed a written statement of aggregate gross receipts as herein before provided shall pay a license fee based upon the contract carried out in the City of Dover. Such non-resident contractor shall pay a license fee in the amount of three hundredths of one per cent (.03%) of the amount of such contract or contracts.
3. (a) Every applicant for a license under the provisions of this Ordinance shall make an application for such license upon forms provided by the Clerk of Council which shall include the following information:
1. The name and business address of the licensee;
2. The trade, business or occupation for which the license is granted;
3. The date of issuance of the license;
4. The amount of the license fee paid to the City.
4. Each license granted under this Ordinance shall be for the sole use and benefit of the licensee to whom it is issued and shall not be transferable. In case of the death of any individual licensee his personal representative shall succeed to all rights thereunder until the date of expiration of the license issued.
5. Every person holding a license authorizing the conduct of any business, trade, or occupation shall expose such license in a conspicuous manner in the principal office of the place of business of such person in the City of Dover.
6. Any person convicted of a violation of the provisions of this Ordinance shall be fined not less than Ten Dollars ($10.00) nor more than One Hundred Dollars ($100.00) or upon failure to pay such fine as shall be imposed shall be imprisoned for not more than thirty (30) days.
The individuals composing any partnership, firm or association and the President and Directors of any corporation, and each of them, shall be personally liable for the license fee herein prescribed for such partnership, firm, association or corporation and subject to prosecution for the conduct of a trade, business or occupation by such partnership, firm, association or corporation in the City of Dover without license herein required. In the event that any person shall maintain his main office at some place other than the City of Dover and a branch office or place of business in the City of Dover, the agent or representative who conducts said branch office or place of business in the City of Dover shall also be personally liable for the license fees herein prescribed and subject to prosecution for the conduct of a trade, business or occupation without the license herein required.
7. The premises of every license shall be open to the inspection of the Fire Marshal and the Executive Officer of the Board of Health during all business hours. If any violation of any of the Ordinances of the City of Dover by a licensee or applicant for a license come to the attention of the Clerk of Council, the Fire Marshal or the Executive Officer of the Board of Health, he shall immediately notify the licensee or applicant of such violation and the measures necessary for its correction, and he may in his discretion refuse the issuance of a license applied for or suspend a license previously issued until said corrective measures have been accomplished.
8. All Ordinances or parts of Ordinances inconsistent with this Ordinance are hereby repealed to the extent of such inconsistency. This Ordinance shall nor repeal its predecessor which was passed June 14, 1954, until July 1, 1973.
9. In the event that the license fee set forth herein is not paid on or before August of each year, then the license shall incur a penalty in the amount of 10% per month of the amount of the license fee until the same is paid.
10. Each day that the license fee is delinquent and not paid shall constitute a separate violation and a summons may issue to initiate a criminal prosecution for each day that the license fee goes unpaid.

SAFETY ADVISORY COMMITTEE
A written report of the Safety Advisory Committee meeting held on March 5, 1973 was presented by Chairman Walls. On motion of Mr. Muir, seconded by Mr. Biggs, Council accepted the report as presented.
PARKING ORDINANCE
On motion of Mr. Holmes, seconded by Mr. Hayes, Council by unanimous roll call vote adopted the following ordinance.
AN ORDINANCE AMENDING THE DOVER MUNICIPAL CODE, SECTION 31-109.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That section 31-09 of the Dover Municipal Code is amended to include no parking on the west side of South State Street from its intersection with Hope Street north approximately one hundred sixty eight feet (168').
2. This ordinance will be enforced upon the proper painting of the curb to prohibit the parking as outlined in this ordinance.

DELMARVA ENTERPRISES, INC. - SEWER & WATER
Mr. Henry Horsey, representing Delmarva Enterprises, Inc., and Peter K. and Patricia Schaeffer, requesting of Council some determination as to when sewer and water service would be available to his clients, per the court order. Mayor Carroll informed Mr. Horsey at this time that the study requested by Council at its last meeting, at which Mr. Horsey was also in attendance, has just this date been received and will be forwarded to the Utility Committee at there scheduled meeting to take place tomorrow evening, March 13th, at which time they will study the recommendations of Albright & Friel and return to Council with a recommendation at its next meeting, March 26, 1973.
