REGULAR MEETING

January 24, 1972

The regular meeting of City Council was held on Monday, January 24, 1972 at 7:30 P.M. with Mayor Carroll presiding. Members present were Messrs Biggs, Coyle, Hayes, Holmes, Holpp, Legates, Muir and Walls.

The invocation was said by the Rabbi Alban of the Beth Sholom Congregation.

MINUTES

The minutes of the regular meeting of City Council held on January 10, 1972 were accepted and bore the written approval of Mayor Carroll.

J.P. COURT #7

The report of the J. P. Court #7 for the month of December, 1971 was accepted by Council, accompanied by a check in the amount of $9,030.93. Deferred payments due the City of Dover as of December 31, 1971 amounted to $22,625.28.

ALDERMAN REPORT

The Alderman report for the month of December, 1971 was accepted as presented. Fines in the amount of $395.00 were remitted to the City.

MUNICIPAL ELECTION RESULTS

The officials appointed to conduct the Municipal Election on January 17, 1972 certified the results to City Council as follows:

On motion of Mr. Biggs, seconded by Mr. Holpp, Council accepted the election results as certified by the election officials.

UTILITY COMMITTEE

The written report of the Utility Committee meeting held on January 19, 1972 was presented by Chairman Holpp. On motion of Mr. Walls, seconded by Mr. Coyle, Council accepted the report as presented.

WEBBS LANE ANNEXATION

On motion of Mr. Holmes, seconded by Mr. Muir, Council by a vote of 7 ‘yes’ and 1 ‘no’ Mr. Hayes, adopted the following resolution upon the recommendation of the Utility Committee.

A RESOLUTION PROPOSING THE INCLUSION OF AN AREA WITHIN THE LIMITS OF THE CITY OF DOVER AND CALLING FOR A SPECIAL ELECTION TO BE HELD IN SAID AREA.

WHEREAS, a recent Amendment to the Charter of the City of Dover authorized the Council to extend the boundaries of the said City after a special election of the qualified voters and real estate owners of the territory proposed to be annexed, and

WHEREAS, the Mayor and Council of the City of Dover deem it in the best interest of the City of Dover to include an area south of the present City limits and hereinafter more particularly described within the limits of the City of Dover.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That the following described area situated in East Dover Hundred, Kent County, State of Delaware and more particularly described and bounded herein be annexed to the City of Dover:

ALL those certain lots and strips of land lying and being adjacent to the City of Dover, East Dover Hundred, Kent County and State of Delaware and more particularly described as follows to wit:

ALL that certain lot known as 254 Webbs Lane and now or formerly of Lyle Baltrusch together with all the lands within the right-of-way of Webbs Lane extending from the easterly right-of-way line of New Burton Road in an easterly direction to the westerly property line of the Rodney Apartments, said line now being the limits of the City of Dover.

2. That an election be held on the 26th day of February A.D., 1972 commencing at the hour of 1:00 P.M. at the City Hall Annex, The Plaza, Dover, Delaware for the purpose of submitting the question of annexation of the above area to those persons entitled to vote thereon.

3. That the election be held and conducted pursuant to the provisions of the Charter of the City of Dover as amended.

4. That this resolution be published in at least two issues of a newspaper published in the City of Dover at least two weeks prior to the date of said election.

HARTLY ROAD ANNEXATION

On motion of Mr. Coyle, seconded by Mr. Biggs, Council by a vote of 7 ‘yes’ and 1 ‘no’, Mr. Hayes, adopted the following resolution upon the recommendation of the Utility Committee.

BOUNDED on the east by the easterly right-of-way line of Saulsbury Road, on the north by the northerly right-of-way line of Hartly Road (Route #8), on the west by the westerly right-of-way line Mifflin Road and on the south by the property line of the Mifflin Tract and others, said line now being a boundary of the City of Dover,

EXCEPT those lands of the Reed Farm lying south of the Hartly Road and now or formerly of Buckson and Richardson and now being a part of the City of Dover,

AND EXCEPT the lands of Henry Heller lying south of the Hartly Road and now being a part of the City of Dover.

2. That an election be held on the 26th day of February A.D., 1972 commencing at the hour of 1:00 P.M. at the City Hall Annex, The Plaza, Dover, Delaware for the purpose of submitting the question of annexation of the above area to those persons entitled to vote thereon.

3. That the election be held and conducted pursuant to the provisions of the Charter of the City of Dover as amended.

On motion of Mr. Legates, seconded by Mr. Coyle, Council by a vote of 7 ‘yes’ and 1 ‘no’, Mr. Muir, adopted the following resolution upon the recommendation of the Utility Committee.

      PART NO. 2

ALL those certain lots, pieces, parcels or tracts of land lying and being situate adjacent to the City of Dover, East Dover Hundred, Kent County and State of Delaware and being more particularly described as follows to wit:

BOUNDED on the north by the center line of Puncheon Run, on the west by the westerly right-of-way line of Governors Avenue Extended and on the east by the easterly right-of-way line of the road connecting State Street with Governors Avenue Extended.

      PART NO. 3

ALL those certain lots, pieces, parcels or tracts of land lying and being situate adjacent to the City of Dover, East Dover Hundred, Kent County and State of Delaware and being more particularly described as follows to wit:

BOUNDED on the north by the northerly right-of-way line of Wyoming Avenue, on the west by the westerly right-of-way line of Governors Avenue Extended, on the east by the easterly right-of-way line of State Street and the easterly right-of-way line of the road connecting State Street with Governors Avenue Extended.

2. That an election be held on the 26th day of February A.D., 1972 commencing at the hour of 1:00 P.M. at the City Hall Annex, The Plaza, Dover, Delaware for the purpose of submitting the question of annexation of the above area to those persons entitled to vote thereon.

LOOCKERMAN STREET LITES

It has been recommended by the Utility Committee that mercury lights be installed on Loockerman Street between Forest Street and State Street to increase the lighting level in downtown Dover. The City Manager stated that the desired lighting level may possibly be obtained by installing mercury lights on every other existing pole along Loockerman Street. The cost of this will be approximately $11,500. On motion of Mr. Legates, seconded by Mr. Walls, Council directed the City Manager to proceed with the recommendation of the Utility Committee.

STOCKTON DEVELOPMENT REZONING

A request has been received from Stockton Development Company to rezone land they own located on the south side of White Oak Road. A public hearing is required prior to amending the Zoning Ordinance and Zoning Map. On motion of Mr. Legates, seconded by Mr. Walls, Council adopted the following resolution and referred the request to the Planning Commission.

A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING ORDINANCE AND DIRECTING THAT NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain property located on White Oak Road is presently zoned for C-1 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the Zoning Map and Ordinance.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That a public hearing be held in City Hall on February 28, 1972 at 8:00 P.M. on a proposed amendment to the zoning ordinance and zoning map of the City of Dover that would rezone from C-1 to C-1A that property located on the south side of White Oak Road, owned by Stockton Development Company, and containing approximately 0.53 acres.

2. That notice of this public hearing be given in accordance with the provisions of the Delaware Code.

LOUIS PARKER REZONING

A request has been received from Louis Parker to rezone land he owns located on South Little Creek Road. A public hearing is required prior to amending the Zoning Ordinance and Zoning Map. On motion of Mr. Coyle, seconded by Mr. Walls, Council adopted the following resolution and referred the request to the Planning Commission.

A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING ORDINANCE AND DIRECTING THAT NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain property located on South Little Creek Road is presently zoned for R-20 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the Zoning Map and Ordinance.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That a public hearing be held in City Hall on February 28, 1972 at 8:05 P.M. on a proposed amendment to the zoning ordinance and zoning map of the City of Dover that would rezone from R-20 to RG-2 that property located on the north side of South Little Creek Road, owned by Louis J. Parker, and containing approximately 22.8 acres.

2. That notice of this public hearing be given in accordance with the provisions of the Delaware Code.

RING-ROAD

The general alignment of a ring-road around Dover was presented to Council, as requested, by City Planner Brown. The Council had requested such a proposal as possible alternates to the cross-town routes that have been explored by the State Highway Department. On motion of Mr. Coyle, seconded by Mr. Holmes, Council by a vote of 6 ‘yes’ and 2 ‘Not Voting’, Messrs Legates and Hayes, approved in general the proposed ring-road as outlined this evening, and at the same time went on record to the Highway Department as opposing all four (4) proposed routes of the cross-town routes explored by the Highway Department.

DURHAM BEAUTY SHOP

It was brought to the attention of Council by Building Inspector Roe that Mrs. Alverta Durham had been operating a beauty shop on Denney’s Road in violation of the City Ordinances. She also had not obtained a State license, but is in the process of doing same. Mr. John Maybee, representing Mrs. Durham, was present and explained that she is in the process of obtaining this State license, and then will obtain the necessary City licenses. In the mean time, this beauty shop will not be in operation.

CITY HALL ANNEX

All business operations of the City of Dover will be transferred to the City Hall Annex effective with the business day of January 31, 1972. On motion of Mr. Hayes, seconded by Mr. Walls, Council directed that an “Open House” be held in the City Hall Annex on February 14, 1972 between the hours of 5:00 P.M. and 7:30 P.M., prior to the Annual Meeting of City Council.

DOVER HIGH SCHOOL FOOTBALL TEAM

On motion of Mr. Holmes, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution honoring the Dover High School Football Team for a very successful undefeated season.

WHEREAS, the Dover High School football team has completed a most outstanding season by winning all of its ten games and being the only undefeated high school football team in the State of Delaware; and

WHEREAS, the Dover Senators were the winners of the Henlopen Football Conference; and

WHEREAS, the Dover Senators played well and represented the City well in the First Annual High School Championship Football Playoffs; and

WHEREAS, the Dover Senators have not only displayed a high degree of competitiveness and sportsmanship during the football year but have also shown results of the excellent coaching headed by Coach Larry Ginsburg.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

1. That the Mayor and Council wish to extend their congratulations and appreciation to Larry Ginsburg and the coaching staff of the Dover High School Football Team and to all of the players and members of this team.

2. That this Resolution shall be made a part of the permanent records of the City of Dover in commemoration to the 1971 Dover High School Football Team and its coaching staff.
