REGULAR MEETING
The regular meeting of City Council was held on Monday, May 26, 1969 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs Biggs, Hastings, Hayes, Holpp, Hughes, Jackson, Legates and Walls.
The invocation was said by the Rev. Claude Fulks of the South Dover Baptist Church.
MINUTES
The minutes of the regular meeting of City Council of May 12, 1969 were accepted and bore the written approval of Mayor Carroll.
LEGISLATIVE & FINANCE, WAGES & HOURS COMMITTEE
A written report of the meeting of the Legislative & Finance, Wages & Hours Committee meeting held on May 20, 1969 was presented to Council by Chairman Hayes. On motion of Mr. Hastings, Council accepted the report as presented.
AMBULANCE DRIVERS AND ATTENDANTS
A job classification has been proposed for the Ambulance Diver and Attendant in the G-9 range, with an annual salary ranging from $5148 to $6552. The copy of the job description, listing the qualifications and requirements will be included in the Job Evaluation Program of the City of Dover. On motion of Mr. Jackson, seconded by Mr. Biggs, Council by unanimous vote accepted the recommendation of the Wages & Hours Committee and adopted the classification of Ambulance Driver and Attendant in Grade G-9.
BLUE CROSS COVERAGE
A proposal had been presented to the Wages & Hours Committee to consider the City of Dover providing Blue Cross coverage for all employees of the City of Dover who so desire such coverage. The cost of individual coverage for each employee is approximately $8.22 per month. The cost of any dependent coverage will be borne by the individual. The Wages & Hours Committee recommends that the City provide Blue Cross coverage for all employees commencing with the 1969-1970 Budget year, with the City paying only the cost of the individual coverage for each employee.
RECREATIONAL-COMMERCIAL ZONE (RC)
A creation of a new zoning designation, to be known as Recreational-Commercial Zone (RC), has been presented to Council for their consideration. A public hearing is required prior to any change in the Zoning Ordinance. On motion of Mr. Walls, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution.
A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING ORDINANCE AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.
WHEREAS, the City of Dover desires to create a new Zoning Classification to govern Recreational and/or Commercial zoning, and
WHEREAS, it is necessary to hold a public hearing prior to amending the zoning ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That a public hearing be held at City Hall, at 8:00 P.M. on June 23, 1969 on a proposed amendment to the zoning ordinance of the City of Dover which would create a new section 3.7B, Recreational Commercial Zone (RC).
2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

2500 KW MACHINE - ST. JONES PLANT
A letter has been received from O’Brien Machinery Company concerning the sale of the 2500 KW turbo-generator located at the St. Jones Power Plant. They have contacted a buyer for this equipment. The price of $15,200 for the generator and 5 ton 25 ft. crane, minus 15% commission for O’Brien Machinery Company. The unit will be sold “as is” “where is”. On motion of Mr. Jackson, seconded by Mr. Hayes, Council accepted the proposal of O’Brien Machinery Company to purchase the above equipment.
DR. SCHAEFFER WATER REQUEST
Mr. John Maybee, representing Dr. Peter K. Schaeffer, addressed Council, concerning the recent request of Dr. Peter K. Schaeffer for water and sewer to his property located at 1075 South Governors Avenue. This request was reviewed at the Council meeting of May 12, 1969, and at that time Council denied the request of Dr. Schaeffer, stating that the policy of the City of Dover was not to extend sewer and water utilities beyond the City Limits. Mr. Maybee at this time gave an accounting of the circumstances that led up to the most recent request of Dr. Schaeffer, and then stated that the City of Dover was discriminating against Dr. Schaeffer in not granting this request. After a brief discussion by Council, it was decided that the action taken at its most recent meeting still stands, thereby no further action need be taken at this time.
SIDEWALK HEARING
A public hearing was duly advertised for this time and place to consider the installation of sidewalks where they do not now exist in an area north of Division Street; west of Silver Lake and St. Jones Rover; east of Governors Avenue, but including both sides of Governors Avenue; and the area west of Governors Avenue; north of Williams Street; est of the Penn Central Railroad, north to Walker Road; and including Walker Road west to Saulsbury Road. Mayor Carroll declared the hearing opened. Mr. Douglas VanSant, who resides at 626 North Governors Avenue, was present and addressed Council concerning the installation of sidewalks at this location. Mr. VanSant has a triangular piece of property that would necessitate installation of sidewalks on two pieces of this triangle of approximately 500' of sidewalk. He was at this time asking Council to consider his plea, as the financial burden on installation in this case would be a great deal. City Manager then stated that in this general area there are a couple of properties that would likewise be affected. No one else was present to speak for or against the sidewalk installation program. Mayor Carroll declared the hearing closed. On motion of Mr. Holpp, seconded by Mr. Hughes, Council deferred action on the installation of sidewalks at this time, and requested that the Utility Committee study the problem on sidewalks on these triangular pieces of property in the area set forth in this public hearing.
SPRUANCE AND WILLIS ROADS IMPROVEMENTS
A public hearing had been advertised for this time and date for the consideration of the improvement of Spruance and Willis Roads. Mayor Carroll declared the hearing opened. Mr. Robert George was present and spoke on behalf of the City making such improvements, he being the largest property owner in the area, thereby sharing the greatest amount of cost to be assessed the property owners. Mr. Emil Voshell also addressed the Council and asked the cost of the project, which the City Manager stated would be approximately $60,000. No one else was present to speak for or against the improvements. Mayor Carroll declared the hearing closed. On motion of Mr. Holpp, seconded by Mr. Biggs, Council by unanimous vote the following ordinance.
AN ORDINANCE AUTHORIZING THE IMPROVEMENT OF SPRUANCE ROAD AND WILLIS ROAD.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET.
1. The City Manager is directed to proceed with the paving of Spruance Road and Willis Road and the installation of curbs, storm drainage, street lights, street signs and water lines on said streets.
2. The City Manager shall cause to be entered in the Municipal Lien Docket a notation of all properties abutting the proposed project and the names of the owners thereof. This shall be considered notice of the proposed project to all property owners and subsequent purchasers that the abutting properties shall be assessed for the costs of paving and installation of the curbs, storm drainage, street lights, street signs and water lines.
2. Within 60 days after completion of construction of the above-mentioned improvements the Council shall determine actual costs of the installation and the share assessable against the abutting properties.

KENT COUNTY SEWER PROPOSAL
A letter had been received by Council as a result of a recent meeting with the Kent County Levy Court, this letter in answer to several request made by Council in order to more clearly obtain the position of the County-City relations in the proposed joint venture of sewage treatment. These answers were satisfactory to Council, granting the City the proposed extension limits of the City they had recently adopted, the formation of a Liason Board, and a cost figure on the treating of the sewage. On motion of Mr. Hughes, seconded by Mr. Jackson, Council by unanimous vote agreed to join the Kent County Levy Court in a county-wide sewer system, based on the present County figures and the acceptance of the terms of the latest proposal by the Levy Court.
On motion of Mr. Hayes, seconded by Mr. Walls, Council at this time directed that the present engineering studies for the construction of a new sewage treatment facility, being made by the firm of Albright & Friel, Inc. be discontinued.
MEMORIAL DAY SERVICE
A letter was received from the Walter Fox Post #2, American Legion, inviting the City of Dover to participate in the Memorial Day Services to take place on May 30, 1969 at 11:00 A.M. on the Green. A floral wreath will be purchased by Mayor Carroll on behalf of the City of Dover at these memorial services.
AMBULANCE BIDS
Bids for the purchase of an ambulance were received by the City today. The following three bids were submitted:
Miller-Meteor Sales Inc. $14,568.25
S & S Sales, Inc. 18,470.25
Superior Sales 13,890.00
On motion of Mr. Hayes, seconded by Mr. Hastings, Council by unanimous voted accepted the low bid of Superior Sales, and directed the City Manager to issue purchase order for same.
LOUMAR ZONING REQUEST
A request has been received from Loumar, Inc. to rezone the property they own on the west side of U.S. Route 13 a the northern extreme of the City of Dover. A public hearing is required prior to amending the Zoning Map and Zoning Ordinance. On motion of Mr. Walls, seconded by Mr. Hastings, Council by unanimous vote adopted the following resolution and referred the request to the Planning Commission.

WHEREAS, certain property located on the west side of U.S. Route 13 at the northern extreme of the City of Dover is presently zoned for R-20 use, and
WHEREAS, it is necessary to hold a public hearing prior to amending the zoning ordinance and zoning map.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. That a public hearing be held at City Hall at 8:05 P.M. on June 23, 1969 on a proposed amendment to the zoning ordinance of the City of Dover which would rezone from R-20 to C-4 and IPM that property located on the west side of U.S. Route 13 at the northern extreme of the City of Dover, owned by the Loumar, Inc., and containing approximately 52 acres.
2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

DOVER SPECIAL SCHOOL DISTRICT AGREEMENT
City Manager Neylan presented a proposal whereby the City of Dover and the Dover Special School District would enter into an agreement whereby the City of Dover would be permitted to use the outside athletic facilities at the William Henry Middle School. The City would maintain the facilities at no cost to the School District, the City would be permitted to develop additional recreation facilities, The District shall have the right to purchase any facilities of semi-permanent nature should this agreement be terminated, which it may be by either party upon consent of the other party. On motion of Mr. Hastings, seconded by Mr. Walls, Council directed the City of Dover enter into the above mentioned agreement with the Dover Special School District for the use of the William Henry Middle School outside facilities.
TRAFFIC SIGNAL - KIRKWOOD & DIVISIONS STREETS
A letter was received from the State Highway Department stating that they had received a request from Mr. George Ryder of 14 N. Kirkwood Street for the installation of a traffic signal at the intersection of Kirkwood and Division Streets. Upon surveying this intersection, it was found that the traffic volume through the intersection did not meet the requirements for warranting a traffic signal. However, they feel that the “no parking” limits at this intersection should be studied by the City. On motion of Mr. Hayes, seconded by Mr. Walls, Council referred this request to the Safety Advisory Committee.
