REGULAR MEETING

The regular meeting of City Council was held on Monday, August 26, 1968 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs Harris, Hastings, Hayes, Holpp, Hughes and Jackson. Councilman absent were Messrs Biggs and Smith.

The invocation was said by Dr. Parker of Wesley College.

MINUTES

The minutes of the regular meeting of August 12, 1968 were accepted by Council and bore the written approval of Mayor Carroll.

CHAMBER OF COMMERCE

Mr. George Frebert, on behalf of the Greater Dover Chamber of Commerce, presented to the City of Dover a check for $680.65, which they request to be earmarked for use in the Parks & Playgrounds Recreational Programs of the City of Dover. This money was derived from the proceeds of the Fireworks display that was held by the Chamber of Commerce on July 4th.

REZONING REQUEST

A request has been received by Council to rezone the property fronting on U.S. Route 13 from Leipsic Road to the present City Limits, on the east side of U.S. Route 13. A public hearing is required prior to amending the Zoning Ordinance and Zoning Map. On motion of Mr. Hayes, seconded by Mr. Jackson, Council adopted the following resolution.

A RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain land located on the east side of U.S. Route 1, from the Leipsic Road north to the City Limits, is presently zoned for R-20 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the zoning ordinance and zoning map.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That a public hearing be held at City Hall, at 8:00 P.M. on September 23, 1968 on a proposed amendment to the zoning ordinance and zoning map of the City of Dover which would rezone from R-20 to C-4 that land located on the east side of U.S. Route 13 beginning at the Leipsic Road and running north for approximately 4650', with the exception of approximately 200' to be reserved for the entrance to Dover Downs, and a depth of approximately 600'. This land contains approximately 62 acres.

2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

SIDEWALK ART SHOW

A request has been received from the Central Dover Business Assn. to conduct a sidewalk art show on September 28, 1968 on the sidewalks on both sides of Loockerman Street. On motion of Mr. Hayes, seconded by Mr. Hastings, Council granted permission for the CDBA to conduct a sidewalk art show on September 28, 1968, with a rain date set for October 5, 1968.

NIMLO

Messrs Jeff Werner, Edward Coxen and Carl Fisher of NIMLO were present to address the Council and explain the workings of NIMLO in the area of Ordinance Codification, such as is being done for the City of Dover. Each man spoke on the different phases of the codification and then answered questions of the Councilmen. The final copy, exclusive of any last minute changes, has been presented to the City of Dover for their adoption of the Code if they see fit. Included in this Code will be the Charter of the City of Dover, the Technical Codes and all the ordinances applicable to the City of Dover. Adoption of the Code can be done by an Adopting Ordinance, which will adopt the entire Code at one time. This at this time will repeal all ordinances not included in the new code. On motion of Mr. Hastings, seconded by Mr. Hayes, Council by a vote of 6 ‘yes’ and 2 ‘absent’, Messrs Biggs and Smith, adopted the following resolution.

RESOLUTION OF THE COUNCIL OF THE CITY OF DOVER ENACTED AT REGULAR COUNCIL MEETING OF AUGUST 26, 1968

BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:

1. That Council has deemed it beneficial and desirable to review and codify the Ordinances of the City of Dover.

2. That such a revision and codification has been prepared and that the same is in final form in a book known as “The Code of The City of Dover, 1968.”

3. That this codification of City Ordinances known as “The Code of The City of Dover, 1968" is now on display for examination by the public in City Hall.

4. That at the next regular Council Meeting on September 9, 1968, at 8:00 P.M. Council will hold a public hearing in City Hall to consider adoption of the revision and codification of Ordinances known as “The Code of The City of Dover, 1968.”

5. That notice of this Resolution and of the public hearing shall be given by publication of this Resolution in the Delaware State News once a week during the weeks commencing August 26, 1968, and September 2, 1968.
