REGULAR MEETING
The regular meeting of City Council was held on Monday, June 10, 1968 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs Biggs, Harris, Hastings, Hayes, Holpp, Hughes, Jackson and Smith.
The invocation was said by the Rev. H. F. Chandler, District Superintendent, United Methodist Church.
MINUTES
The minutes of the regular meeting of May 27, 1968 were approved and bore the written approval of Mayor Carroll.
REPORTS
Chief of Police report for the month of May was accepted.
Building Inspector & Fire Marshall report for the month of May was accepted.
Acting Alderman report for the month of May was accepted. Fines in the amount of $244.10 were remitted to the City of Dover.
Report of the J. P. Court #7 for the month of May was accepted. A check in the amount of $1,230.00 was remitted to the City of Dover.
Cash Receipts, General Fund, for the month of May was accepted.
Budget Report, General Fund, for the month of April was accepted.
Cash Receipts, Electric Revenue Fund, for the month of May was accepted.
Cash Receipts, Electric Improvement Fund, for the month of May was accepted.
City Manager Report, for the month of May was accepted.
RECREATIONAL DIRECTOR & ASSISTANTS
City Manager Neylan has requested of Council, salary ranges and job classifications be approved by Council for a Recreational Director and Playground Leaders. The money for the payment of these salaries is included in the 1968-69 Budget. On motion of Mr. Holpp, seconded by Mr. Smith, Council approved the G-16 Classification for a Recreational Director with a salary scale of $6864-$8788. On motion of Mr. Hastings, seconded by Mr. Jackson, Council approved a W-1 Classification for a Junior Playground Leader, and a W-7 Classification for a Playground Leader.
PLAYGROUND LEASE
Three-year leases have been agreed to and signed by James Hardcastle and Dr. Edward Dennis and by the Edgell Construction Company for the lots on the corner of Kirkwood and West Division Street. On motion of Mr. Jackson, seconded by Mr. Smith, Council authorized the Mayor and city Clerk to sign these leases and complete the agreements with the above named parties.
GENERAL FUND BUDGET
On motion of Mr. Hayes, seconded by Mr. Holpp, Council by unanimous vote adopted the following ordinance adopting the General Fund Budget for the fiscal year 1968-1969.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. The amounts hereinafter named, aggregating Two Million, One Hundred Three Thousand, Seven Hundred Seventy One Dollars and Eighty Seven Cents ($2,103,771.87) or so much as may be necessary are hereby appropriated from current revenues and other funds for the use of the several departments of the Municipal Government, and for the purposes hereinafter mentioned, for the fiscal year beginning July 1, 1968 and ending June 30, 1969, as follows:

2. The City Manager is hereby authorized without further approval of City Council to make interdepartmental transfers of up to 10% of the amount herein appropriated to any department.

ELECTRIC DEPARTMENT BUDGET
A public hearing has been duly advertised for this time and date on the preliminary budget of current expenses of the electric system for the Fiscal Year beginning July 1, 1968. Mayor Carroll declared the hearing opened. No one was present to speak for or against the proposed budget. Mayor Carroll declared the hearing closed.
On motion of Mr. Hastings, seconded by Mr. Hayes, Council by unanimous vote adopted the following ordinance:
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER, IN COUNCIL MET:
1. The amounts hereinafter named, aggregating four million, five hundred fifteen thousand, eight hundred thirteen dollars and eighty-eight cents ($4,515,812.88), or so much thereof as may be necessary, are hereby appropriated from current revenues of the Electric Department, estimated to be four million six hundred ten thousand dollars ($4,610,000.00), for the use of the several divisions of the Electric Department, and for the purposes hereinafter mentioned, for the fiscal year beginning July 1, 1968 and ending June 30, 1969, as follows:

2. HIGHWAY DEPARTMENT LETTER
A letter was received from the State Highway Department, in response to a request from Mr. Neylan concerning the reconstruction of South Governors Avenue. They stated in this letter that they have moved up from 1972 to 1970 the engineering of this job, and as soon after that as money is available, construction will begin. They will make an effort to adjust their schedule.
GSA PROPERTY
A public hearing was duly advertised for this time and date for the demolition proceedings on the property owned by the Federal Government in the vicinity of North and News Streets. Mayor Carroll declared the hearing opened. No one was present to speak for or against the demolition. Mr. Rodriguez, City Solicitor, expressed an opinion that in the event the Federal Government did not comply with the request of Council, demolition could be done in accordance with the City Ordinance, and a lien could be placed against the land to recover the cost involved. Mayor Carroll declared the hearing closed. On motion of Mr. Hayes, seconded by Mr. Biggs, Council by unanimous vote directed the Building Inspector to give notice to the Federal Government that the buildings aforementioned will be demolished in ten (10) days, or bids will be taken by the City of Dover to have these buildings removed and the cost to be assessed against the property in accordance with Dangerous Building Ordinance.
WATER LINE - U.S. ROUTE 13
A public hearing was duly advertised for the time and date for the purpose of establishing a rate to be assessed against the property owner for the construction of a water line on the East side of U.S. Route 13 from Towne Point north. Mayor Carroll declared the hearing opened. No one was present to speak for or against the assessment. The recommendation of the Utility Committee was a charge of $3.00 per front foot plus the tapping fee when the property owner tapped into the water line. This charge being made to only the property owners on the east side of U.S. Route 13, that being the only side of the highway served by this water line. Mayor Carroll declared the hearing closed. On motion of Mr. Holpp, seconded by Mr. Harris, Council by unanimous vote approved the recommendation in conjunction with the recreational program being formulated through his office.
UNITED KLANS OF AMERICA
A letter was received from Mr. William R. Walston, State Co-ordinator, United Klans of America, requesting permission to hold an assembly on the property owned by Layton and Company, located at the 600 block of West Division Street. The date requested is June 15, 1968 from 8:00 P.M. to 10:00 P.M. with an estimated attendance of five hundred persons. Councilman Hughes asked at this time, whether this was the responsibility of the Council or an administrative responsibility to grant or deny such a request as this. Although no formal request has been made, a verbal request was denied last week because of a zoning violation. Mr. Rodriguez, City Solicitor, stated that in the past, request of this nature have been handled by Council, for a use beyond the uses permitted in the zoning ordinance. A decision made by Council on such a request, could be appealed to the Zoning Board of Adjustment. On motion of Mr. Harris, seconded by Mr. Hayes, Council by unanimous vote denied the request of the United Klans of America, Inc.
Councilman Jackson then stated, that by voting for the denial, he was not voting against the Klan or any other organization holding meetings or assemblies in the City of Dover, providing they meet the requirements as set up by the ordinance and regulations of the City of Dover.
FLUORIDATION OF WATER SUPPLY
A letter was received from Miss Virginia Lyndall, Councilwomen of Wyoming, Delaware, pertaining to the recent law passed by the State of Delaware that will require the fluoridation of all water supplies as directed by the State Board of Health. Miss Lyndall was requesting that Dover and some of the other towns in the State to band together to try to get this law amended, changed, or even completely done away with through the General Assembly. On motion of Mr. Harris, seconded by Mr. Holpp, Council by a vote of 7 ‘yes’ and 1 ‘no’, Mr. Smith, directed that the receipt of this letter be acknowledged and the matter be tabled.
On motion of Mr. Hayes, seconded by Mr. Jackson, Council directed that the State of Delaware be notified as to the City’s desire to have to State hold a referendum in the City of Dover to determine if the residents of Dover would be favorable to the fluoridation of the water supply of the City of Dover.
ATOMIC ENERGY COMMISSION
A decision of the appeal by the City of Dover on its intervention in the issuance of a permit by the AEC for a non-commercial generating units at the Peachbottom site on the Susquehanna River. The petition to intervene has been denied along with the appeal made by the attorney retained by the City of Dover, Spencer W. Reeder, Esq. Mr. Neylan stated that he felt the City of Dover has gone as far as would be necessary, since another course of action is now being undertaken by the City which could bring the same results or maybe even better results. In order to file any further appeal, this must be done by June 15, 1968. Mr. Neylan recommends that the City not file any more appeals. On motion of Mr. Harris, seconded by Mr. Holpp, Council accepted the recommendation of the City Manager.
LEAGUE OF WOMEN VOTERS
A letter was received from the League of Women Voters expressing their appreciation for the City of Dover’s appropriation which will open the school recreational facilities to the public.
