REGULAR MEETING

October 10, 1966

The Regular Meeting of City Council was held Monday, October 10, 1966 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hastings, Hayes, Holpp, Hughes, Jackson and Smith.

The invocation was said by the Reverend C. W. Adams.

MINUTES

Minutes of the meeting of September 26, 1966 were approved and bore the written approval of Mayor Carroll.

REPORTS

Report of the Chief of Police was accepted.

Report of the Alderman Neylan was accepted. Fines in the amount of $469.20 were remitted to the City in the month of September.

Report of the Fire Marshal and Building Inspector was accepted.

Report of Cash Receipts, General Fund, was accepted.

Budget Report, General Fund, was accepted.

Cash Report, Electric Revenue Fund was accepted.

Cash Report, Electric Improvement Fund was accepted.

Report of the City Manager was accepted.

UTILITY COMMITTEE

Councilman Holpp reported that a meeting of the Utility Committee was held on Monday, October 3, 1966. Mr. Elmer Gates, representing Middle West Service Company was present to answer questions of the Committee relating to the proposed rate revision that has been proposed to the City. The proposed rate reduction would be a savings to the consumer of approximately $120,000 per year. The proposed rate would provide one rate for all residential users, City and Rural. The Committee recommends that the proposed rates go into effect January 1, 1967. On motion of Mr. Hayes, seconded by Mr. Holpp, a request was made for an ordinance to be prepared to authorize the rate reduction to go into effect January 1, 1967.

Mr. Gates also informed the Committee that Middle West Service Company would perform the same services now supplied the City by Gilbert Associates, should the City desire a change. Mr. Neylan stated at this time that he had been contacted by Gilbert Associates, a desire to be released from the services now performed to the City of Dover, feeling that there might be a conflict of interest on their part. On motion of Mr. Hayes, seconded by Mr. Biggs, Mr. Neylan was authorized to contact both Gilbert Associates and Middle West Service Company for the purpose of making a change.

PARKS, PLAYGROUNDS & TREE COMMITTEE

Councilman Smith presented a report of a meeting of the Parks, Playgrounds, & Tree Committee held on Monday, October 3, 1966. Mr. Smith stated that the Dover Jaycees were present at the Committee Meeting to present plans for the development of the Water Street Playground. Mr. Tom Miles, was present at this meeting, and stated that the Dover Jaycees would contact the City Planner and the City Manager and work with them on plans to develop this playground.

SAFETY ADVISORY COMMITTEE

Councilman Smith presented a report of the Safety Advisory Committee held on October 3, 1966. Mr. Smith had been presented with requests to eliminate parking spaces in several areas in the City. The first was on the East side of State Street just South of the alley next to the Wesley Church. On motion of Mr. Smith, seconded by Mr. Biggs, a request was made to prepare an ordinance to eliminate the parking meter and parking space adjacent to this alley. Messrs. Hastings, Hughes, and Jackson voted ‘No’. Chief Turner was asked at this time to contact Wesley Church for the purpose of making arrangements with them for limited access of this alley onto State Street.

The second request was for the elimination of a parking space on the corner of Kerbin and Water Streets. On motion of Mr. Smith, seconded by Mr. Holpp, a request to deny the preparation of an ordinance to eliminate this parking space was passed by Council. Messrs. Harris and Hayes voted ‘No’.

STOP SIGNS

On motion of Mr. Smith, seconded by Mr. Hastings, Council by unanimous vote passed following ordinance:

AN ORDINANCE PROVIDING FOR THE ERECTION OF STOP SIGNS ON PORTIONS OF BRADLEY ROAD, DUPONT STREET AND LAUREL DRIVE WITHIN THE LIMITS OF THE CITY OF DOVER.

WHEREAS, Title 21, Delaware Code, Section 505, vests in the local authorities the right to install signs notifying the drivers of motor vehicles to come to a full stop; and

WHEREAS, the Mayor and Council of the City of Dover have deemed it necessary and advisable to install such signs at the intersection of certain hereinafter named streets; and

WHEREAS, the Mayor and Council have vested in the Police Department of the City of Dover authority to install such signs.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Dover in Council met:

1. That no vehicle shall enter onto any of the following described streets without first coming to a full stop, nor shall any individual operate a motor vehicle so as to enter onto any of the following named streets without first coming to a full stop:

            On Bradley Road before entering Harrison Drive;

            On DuPont Street before entering Queen Street going both East and West;

            On Laurel Drive before entering U.S. #13.

2. That the Police Department of the City of Dover, pursuant to Title 21, Delaware Code, Section 505, is hereby authorized and empowered to install the necessary Stop Signs at the locations and intersections mentioned in Paragraph “1" above.

3. Any violation of the provisions of this Ordinance shall result in prosecution under the Laws of the State of Delaware, and any fines and/or imprisonment shall be as provided in the applicable provisions of the Delaware Code.

INTERNATIONAL ASSOCIATION OF CHIEFS OF POLICE CONVENTION

Chief of Police James Turner gave a brief report on the Convention that he and Mayor Carroll attended in Philadelphia, Penn. He expressed his pleasure of having the opportunity to attend this convention, and felt the trip was very beneficial.

WILLEY REZONING

A public hearing has been duly advertised for this date for the purpose of rezoning the Willey Tract. Mayor Carroll declared the hearing opened. Recommendations of the Planning Commission were presented to Council and discussed at some length. On motion of Mr. Hayes, seconded by Mr. Biggs, action by Council was delayed until its next meeting, Monday, October 24, 1966. Mayor Carroll closed the hearing.

SEVENTH DAY ADVENTIST CHURCH

A letter was received from the Chesapeake Conference of Seventh-Day Adventists, whose local congregation is located at 119 Lotus Street, requesting permission to erect a 40' x 80' air tent on the corner of Waples and South Governors Streets. The lot is to be leased from Dr. Bertram Widder and is 231' x 135'. Enclosed with the letter were details as to the construction of the tent, and how it is to be placed on the property. This tent is to be used for religious meetings for a three week period commencing on November 19, 1966. The meetings are to be held daily from 7:30 P.M. to 9:30 P.M. On motion of Mr. Harris, seconded by Mr. Smith, permission was granted to the Seventh-Day Adventist Church for the use of this property to erect this tent for the period of November 7, 1966 through December 21, 1966 only. Council unanimously granted this request.

250TH ANNIVERSARY CELEBRATION

Councilman Holpp reported on a meeting of the Dover’s 250th Anniversary Celebration. This was an organizational meeting with Councilman Holpp acting as Temporary Chairman. At this meeting Mr. James Jackson was appointed permanent Chairman. Mr. Holpp gave a brief outline of the activities in connection with the 250th Anniversary Celebration, to be held during the Summer of 1967.
