REGULAR MEETING
August 22, 1966
The regular meeting of City Council was held Monday, August 22, 1966 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hastings, Hayes, Holpp, Hughes and Smith.
MAGISTRATE REPORT
Report of Justice of the Peace Court No. 7 was accepted by Council. A check in the amount of $2,466.00 was remitted to the city for the month of July.
PARKING AUTHORITY
Mayor Carroll recommended the reappointment of W. Lamar Pierce to the Parking Authority. On motion of Mr. Hayes, seconded by Mr. Biggs the recommendation of the Mayor was approved.
HOUSING AUTHORITY
Mayor Carroll recommended the reappointment of Morris Simon to the Housing Authority. On motion of Mr. Smith, seconded by Mr. Hayes, the recommendation of the Mayor was approved.
LEGISLATIVE AND FINANCE
Councilman Hayes submitted a written report of a meeting of the Legislative and Finance Committee held on August 17, 1966 which was accepted.
STOP SIGNS AND YIELD SIGNS ORDINANCE
On motion of Mr. Hayes, seconded by Mr. Holpp, Council by a vote of 7 yes with one absentee, Councilman Jackson, passed the following ordinance:
AN ORDINANCE PROVIDING FOR THE ERECTION OF STOP SIGNS AND YIELD SIGNS ON VARIOUS INTERSECTIONS WITHIN THE LIMITS OF THE CITY OF DOVER.
WHEREAS, Title 21, Delaware Code, Section 502, vests in the Local Authorities the right to install signs notifying drivers of motor vehicles to come to a full stop and to yield the right-of-way; and
WHEREAS, the Police Department of The City of Dover has deemed it necessary and advisable to install such stop signs at the intersections of certain hereinafter named streets.
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET, THAT:
1. From and after the passage of this Ordinance, no vehicle shall enter onto any of the following described streets without first coming to a full stop, nor shall any individual operate a motor vehicle so as to enter onto any of the following streets without first coming to a full stop:
DOVER PUBLIC HOUSING PROJECT
Stop on Reese Street before entering North Street
Stop on East Alley before entering North Street
Stop on West Alley before entering North Street
LINCOLN PARK
Stop on Paul Street before entering Reese Street
Stop on Irma Street before entering Pail Street
Stop on Irma Street before entering Slaughter Street
2. No vehicle shall enter onto any of the following described streets without first yielding the right-of-way, nor shall any individual operate a motor vehicle so as to enter onto any of the following named streets without first yielding the right-of-way:
DOVER PUBLIC HOUSING PROJECT
Yield before entering West Alley when proceeding in a westerly direction
Yield before entering main entrance to Project when proceeding in both a westerly and easterly direction
Yield before entering East Alley proceeding in an easterly direction
3. That the Police Department of the City of Dover, pursuant to Title 21, Delaware Code, Section 505, is hereby authorized and empowered to install the necessary signs and/or symbols at the locations and intersections mentioned above.
4. Any violation of the provisions of this Ordinance shall result in prosecution under the Laws of the State of Delaware, and any fines and/or imprisonment shall be as provided in the applicable provisions of the Delaware Code.

MIRROR POND
City Engineer Alfred Joseph made a detailed report on the progress of work on Mirror Pond. Mr. Joseph called on Mr. John Bryson of the State Water Pollution Commission, who related the condition of the silt and deposit in Mirror Pond and the aspects of removing the same, and dredging the pond as a solution to cleaning it up. Mr. Bryson expressed an opinion that dredging the pond was not the solution to the problem. On motion of Mr. Harris, seconded by Mr. Smith, a recommendation was passed to cease filling operations until a report at next council meeting on feasibility of dredging or putting in an island to control the flow fo the stream with the possibility of eliminating silt and other problems now present in Mirror Pond. Recommendation was approved by Council. Report to be made at the next council meeting by City Engineer Joseph.
PLANNING REPORT
City Manager Ward presented a report prepared by Mr. John Bivens, State Planning Commissioner, on setting up a Planning Office within the City of Dover. This report was in conjunction with City Council’s request of Mr. Bivens to coordinate the establishment of the Planning Office. This report contained a detailed outline prospects and needs of a Planning Office and/or Planner. It also estimated the cost of this program over the next twenty four months. These cost to be borne in one of three ways: (1) by the City alone; (2) by the City and Federal Government; and (3) by the City, Federal Government, and State. Mr. Ward then introduced Mr. Joseph Patermo, Chief Community Planner, of Mr. Biven’s office, who stated that an application would have to be made to the Federal Government to determine if there were any monies available for use by the City of Dover. Copies of this report are to be made available by the State Planning Office for the Councilmen and the Planning Commission, to whom this report will be presented at their next meeting by Mr. Ward. Action was deferred on this report until Council had been given a copy of this report and could familiarize themselves with it.
PLANNER
City Manager Ward reported that out of a possible eighteen applicants, the field had been narrowed to three. He felt that all three were qualified, but one was out of the salary range originally set up for this position. Mr. Ward also stated at this time that he could find noting in writing that he had the authority to hire a Planner. On motion of Mr. Hayes, seconded by Mr. Biggs, Mr. Ward was authorized to hire a Planner with A Masters Degree in Planning, within the salary range of $7,500 to $10,000, as set by the Legislative and Finance Committee. By unanimous vote this recommendation was approved.
HINKLE BUILDING
On motion of Mr. Hayes, seconded by Mr. Smith, City Manager Ward was authorized to get prices on the demolition of this City-owned property which is located on the Southeast corner of North and State Streets. By unanimous vote this recommendation was approved.
CROSSGATES PLAYGROUND
Mr. Charles Harris, a resident of Crossgates, appeared on behalf of the residents of this development, to inquire as to the progress made on the playground to be built in this development. Council had instructed the City Clerk to contact the builder at its meeting of July 11, 1966. A letter was sent to the builder and a reply was received from the builder’s attorney stating that they would be in touch with the City Authorities at a later date. Noting has been received to this date. A motion by Mr. Harris, seconded by Mr. Smith, directed City Manager Ward to contact the builder of Crossgates, to determine if the playground in this area will be ready for use by the residents of this area and acceptable by the City Council on September 12, 1966, the date of the next Council meeting. If this cannot be arranged, further action will be taken by the Council to direct the Building Inspector’s office to not issue any more Certificates of Occupancy until playground is completed. By unanimous vote this recommendation was approved.
