REGULAR MEETING

May 9, 1966

The Regular Meeting of City Council was held Monday, May 9, 1966 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hastings, Hayes, Holpp, Hughes, Jackson and Smith.

The invocation was said by the Rev. C. E. Hammond.

MINUTES

Minutes of the meeting of April 25, 1966 were accepted and bore the written approval of Mayor Carroll.

REPORTS

Report of the Chief of Police for April was accepted.

Report of the Acting Alderman for April was accepted. Fines in the amount of $332.60 were remitted to the City during April.

Report of the Fire Marshal and Building Inspector was accepted.

Report of Cash Receipts, General Fund, was accepted.

Budget Report, General Fund, was accepted.

Cash Report, Electric Revenue Fund was accepted.

Cash Report, Electric Improvement Fund, was accepted.

Report of the City Manager for April was accepted.

RATE STUDY

City Manager Ward reported he had made contacts with various firms asking for proposals on making an electric rate study as directed by Council. He was hopeful of having proposals to submit by the time of the next meeting of Council.

PLANNER

City Manager Ward reported on progress in obtaining a City Planner. He stated he had received four inquiries as a result of advertising, and that of the four two appeared to be interested in Dover. No choice has yet been made, but Mr. Ward stated one applicant was more experienced and would probably require a higher salary than the other. Mr. John Bivens, State Planner, has offered to assist Dover in setting up the Planner and will appear before Council on May 23 if they so desire. On motion of Mr. Holpp, seconded by Mr. Hastings, Council invited Mr. Bivens to appear on May 23.

TOWNE POINT PARKS

An entrance is required into the park area of the Towne Point Development and the City Manager had been directed to determine whether an entrance could be secured from the developer. City Manager Ward reported that the Civic Association in that area had been offered the use of a lot as an entrance at a fee of $1 per year until the lot is sold and on condition that they obtain liability insurance. The lot in question is No. 2 and the developer states it will be the last lot to be sold. Although the offer was made to the association, the same conditions would probably be available to the City. On motion of Mr. Hayes, seconded by Mr. Holpp, Council authorized the City Manager to enter into such an agreement with the developers. In the meantime he will continue to seek a permanent solution to the problem of entrance.

WAGES & HOURS

Councilman Hayes submitted to Council written recommendations made by the Wages & Hours, Legislative & Finance Committee following hearings held on the 1966-67 budget requirements of the various City departments. The recommendations will be included in the budget offered for adoption in June. The report was accepted.

SAFETY COMMITTEE

Councilman Smith submitted to Council a written report of a meeting of the Safety Advisory Committee held May 2, 1966. The report was accepted.

On motion of Mr. Hayes, seconded by Mr. Smith, Chief Turner was authorized to talk to the Highway Department about lower speed limits on Highway 13 and establishing of truck lanes.

On motion of Mr. Hughes, seconded by Mr. Harris, the proposed jay-walking ordinance was referred back to the Safety Advisory Committee for further study.

On motion of Mr. Harris, seconded by Mr. Smith, Council authorized the preparation of an ordinance providing for parking meters at the old Post Office and the island adjacent thereto.

On motion of Mr. Smith, seconded by Mr. Hayes, Council rescinded the ordinance establishing a loading zone at the former News-Journal office.

On motion of Mr. Holpp, seconded by Mr. Smith, Council authorized Chief Turner to obtain Highway Department approval, and directed the preparation of an ordinance providing for channelization of traffic on Division Street at New Street.

On motion of Mr. Hayes, seconded by Mr. Hastings, Council directed that an ordinance be prepared providing for the installation of stop signs on Holly Drive at Yearsley Drive.

PARKS COMMITTEE

Councilman Smith submitted a written report of a meeting of the Parks, Playgrounds & Tree Committee held on May 2, 1966. The report was accepted.

On motion of Mr. Smith, seconded by Mr. Hayes, Council directed that bids be obtained on the dredging of Mirror Lake.

UTILITY COMMITTEE

Councilman Holpp submitted a written report of a meeting of the Utility Committee held on May 3, 1966 to discuss the Federal Power Commission decision. The report was accepted.

BUDGET HEARING

On motion of Mr. Hayes, seconded by Mr. Smith, Council directed that a public hearing be held on the proposed electric department budget for 1966-67 as required by the Resolution authorizing the issue of Electric Revenue Bonds, dated July 26, 1965.

CATTS ZONING

Mrs. Della V. Catts, 39 Fisher Avenue, Milford, asked Council to rezone a property owned by her at the corner of New and Cecil Streets from RG-1 to C-1. A public hearing is required before changing the zoning ordinance or zoning map. On motion of Mr. Hayes, seconded by Mr. Smith, Council by unanimous vote adopted the following ordinance and referred the request to the Planning Commission:

RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, certain lands of Mrs. Della V. Catts located at the northwest corner of New and Cecil streets are presently zoned for RG-1 use, and

WHEREAS, a request was submitted to change the zone designation from RG-2 to C-1 use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the zoning ordinance and zoning map.

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER:

1. That a public hearing be held at City Hall at 8:00 P.M. on June 13, 1966 on a proposed amendment to the zoning ordinance and Zoning Map of the City of Dover which would rezone from RG-1 use to C-1 use that land of Mrs. Della V. Catts located on the northwest corner of New and Cecil Streets measuring approximately 26' on New Street and approximately 145' on Cecil Street.

2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

Adopted May 9, 1966.

CORRESPONDENCE

A letter from Dorothy Kilvington, President of the Sprig & Twig Garden Club, expressed appreciation of the City flower beds and asked whether potted shrubs could be set out on Loockerman Street. On motion of Mr. Hayes, seconded by Mr. Harris, the letter was referred to the Parks and Tree Committee.

The Delaware League of Local Governments announced a monthly meeting to be held Thursday, May 19, 1966 at 6 P.M. at The Hub.

A memorandum from City Manager Ward invited the Mayor and Council to an IBM demonstration at the Armory at 9 A.M. on May 12.

Council adjourned at 8:55 P.M.
