SPECIAL MEETING

April 22, 1965

A Special Meeting of City Council was held Thursday, April 22, 1965 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Holpp, Hughes, Massey, Smith and Walls.

PSC HEARING

Mayor Carroll and City Manager Ward reported on a meeting held in the State Water Pollution offices to discuss the application for sewer and water franchise in Kent County made to the Public Service Commission by Tidewater Utilities. A hearing before the Commission is to be held on April 26. Apparently Dover is the only public body to actively oppose the application. Council again expressed its opposition to the application of Tidewater Utilities, citing among other things that the operation of such a utility would lead to indiscriminate building adjacent to Dover City limits and throughout Kent County which lacked Planning and Zoning controls. In the event the application is approved, Council urged that the Commission condition the franchise to exclude from the service area, any areas not yet provided service by the private utility which in the future might be annexed to the City, and that adequate bond be obtained to guarantee service to areas in which the utilities are extended.

ANNEXATION

Council discussed the situation on the temporary road between the Hartly and Hazlettville Roads. The Mifflin heirs and the Dover Housing Authority have agreed to terms for extension of the use for two more years, but no agreement has yet been reached with William Holden. He has put forth various conditions none of which seem to be firm. In his area the road makes use of a dedicated street right of way and cuts across a portion of three lots. The City Manager suggested alternate firm proposals that could be made. On motion of Mr. Holpp, seconded by Mr. Massey, Council approved the following proposals: 1. That the City purchase the three lots at a price of $2500 each, or 2. That the City pay $1500 for two years right-of-way over the lots; or 3. That the City extend sewer and water lines from their present termination on Lincoln Street to the center of Bertrand Drive and their stubbed out for extension by Holden, with this to be done only after Holden begins development of his land, that the surface of Bertrand Drive be maintained as it now is until such time as Holden completes the installation of curb and gutter and utilities in the right of way, after which the City will pave the street with hot mix. Mr. Hughes voted ‘No’.

HOLDEN ROAD

Council discussed the acquisition of property for the extension of Queen Street from North to Water Street. On motion of Mr. Holpp, seconded by Mr. Walls, Council authorized a firm offer to property owners based on the estimated value to be made by an independent appraiser, for which Council authorized payment.
