REGULAR MEETING
October 26, 1964
The Regular Meeting of City Council was held Monday, October 26, 1964 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Holpp, Massey, Smith and Walls.
The invocation was said by the Rev. John Roock of St. Johns Lutheran Church.
MINUTES
Minutes of the meeting of October 12, 1964 were accepted and bore the written approval of Mayor Carroll.
ANNEXATION
City Council considered a resolution providing for an election on the question of annexing the lands of the former Coty plant and the H. Baxter McKee farm. On motion of Mr. Walls, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:
RESOLUTION PROPOSING THE INCLUSION OF AN AREA WITHIN THE LIMITS OF THE CITY OF DOVER AND CALLING FOR A SPECIAL ELECTION TO BE HELD IN SAID AREA.
WHEREAS, The Charter of the City of Dover authorizes the Council to extend the boundaries of the said City after a special election of the qualified voters and real estate owners of the territory proposed to be annexed, and
WHEREAS, The Mayor and Council of the City of Dover deem it in the best interest of the City of Dover to include an area as hereinafter more particularly described within the limits of the City of Dover,
NOW THEREFORE BE IT RESOLVED:
1. That the following territory situate in East Dover Hundred, Kent County, State of Delaware, as more particularly bounded and described by detailed description, be annexed to the City of Dover, to-wit:
ALL those certain pieces, parcels or tracts of land lying and being adjacent to The City of Dover, East Dover Hundred, Kent County and State of Delaware, and being more particularly described as follows, to-wit:
BEGINNING at a point in the center of McKee Run and in the easterly right of way line of the Delaware Railroad and at a corner of lands of The City of Dover; thence in a northerly direction with the easterly right of way line of the Delaware Railroad to the southerly right of way line of College Road; thence with the southerly right of way line of College Road in a southwesterly direction and crossing McKee Road to a line dividing the lands of H. Baxter McKee from lands of the Kilson Estate; thence with this said line in a southeasterly direction to McKee Run; thence with the said McKee Run and separating the lands of H. Baxter McKee from the lands of William P. and Harry A. Richardson in a northeasterly direction to the easterly right of way line of McKee Road; thence with the said easterly right of way line of McKee Road in a southeasterly direction to a property line dividing the lands now or late of Coty, Inc. from the lands of Northwest Dover Heights, now a part of The City of Dover, thence with the said Coty, Inc. line in a northeasterly direction to a point in the easterly right of way line of the Delaware Railroad and in line of lands of The City of Dover; thence with the easterly right of way line of the Delaware Railroad and with lands of The City of Dover home to the place of beginning, be the contents thereof what they may.
2. That an election be held on the 21st day of November 1964 between the hours of 1:00 P.M. and 7:00 P.M. at City Hall on the Plaza in Dover, Kent County, Delaware for the purpose of submitting the question of annexation of the above area to the persons entitled to vote thereon.
3. That the election be held and conducted pursuant to the provisions of the Charter of the City of Dover as amended, and the Laws of the State of Delaware.
4. That this Resolution be published in at least two issues of a newspaper published in the City of Dover at least two weeks prior to the date of said election.

WAGES & HOURS COMMITTEE
Councilman Hayes submitted a written report of a meeting of the Wages, Hours, Legislative and Finance Committee held October 19, 1964. This report concerned a claim of Harley Taylor’s for reimbursement for a water line, consideration of a capital improvement program including a new police station, and the leasing of IBM punch card equipment. The report was accepted.
IBM EQUIPMENT
On motion of Mr. Hayes, seconded by Mr. Walls, the recommendation of the Wages & Hours Committee that the City of Dover lease IBM punch card equipment at a cost of $700 per month for City office use was approved.
FPC HEARING
Councilman Holpp reported that the Utility Committee recommended the employment of the firm of Martin T. Bennett Associates Inc., Washington, D.C. to prepare and give expert testimony int eh City of Dover case before the Federal Power Commission. The firm was recommended also by Spencer W. Reeder, attorney representing the City in the hearing. The cost of serves of the different individuals of the firm would range from $5 to $20 per hour with total cost estimated at $2800. Council agreed that the City should take all steps required to successfully presents its case. On motion of Mr. Holpp, seconded by Mr. Harris, Council authorized the employment of the firm of Martin T. Bennett Associates Inc. to prepare and present testimony on behalf of the City of Dover.
GOODEN LAND
William Hudson of City Solicitor Buckson’s office reported that a clear title could be obtained for the Leslie Gooden land on Tar Ditch. Council decided to proceed with its previous action authorizing purchase of the land and not to engage in the exchange of a Bradford Street lot.
ROSS STREET
Mr. Hudson reported that the Court had rendered a decision in the Ross Street case which in essence provided that Robino should provide 38' of paved street in the 50' right of way and that the City should pay the cost of 500' of curbing which must be removed and replaced. On motion of Mr. Harris, seconded by Mr. Holpp, Council directed that steps be taken immediately to get the project underway with the hope of paying the street before winter.
LILLIAN JONES ALLEY
Lillian Jones had requested that an alley adjoining 71 West Street be abandoned. Mr. Hudson reported that the City could give title to the alley but will investigate ownership of the alley further before a public hearing on abandonment is held.
BISHOFF DRIVEWAY
Paul Scotton requested permission to depress 18' of curbing on Division Street east of Park Drive to provide an entrance to a parking area for Dr. Bishoff. On motion of Mr. Holpp, seconded by Mr. Hayes, the request was approved.
DP&L SUBSTATION
DP&L invited members of Council and other officials of the City to witness a demonstration of a gas turbine providing emergency power at its Hazletville Road substation. Members of the Council will attend the demonstration at 10:30 A.M., Thursday, October 29.
