REGULAR MEETING
October 12, 1964
The Regular Meeting of City Council was held Monday, October 12, 1964 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Holpp, Massey, Smith and Walls.
The invocation was said by the Rev. Hubert F. Jicha Jr.
MINUTES
Minutes of the meeting of September 28, 1964 were accepted and bore the written approval of Mayor Carroll.
REPORTS
Report of the Chief of Police was accepted as read.
Report of Alderman Cavanaugh was accepted as read. Checks in the amounts of $276.00, $254.00, and $1016.80 were remitted to the City. Report of Magistrate Knotts was accepted as read. A check in the amount of $1364.50 was remitted to the City.
Report of the Fire Marshal and Building Inspector was accepted.
Report of the Board of Health was accepted.
Report of General Fund Cash receipts was accepted.
Report of General Fund Budget was accepted.
Report of Electric Revenue Fund Cash was accepted.
Report of Electric Improvement Fund Cash was accepted.
Report of the City Manager was accepted.
HALLOWEEN
Chief of Police Turner requested Council to limit the observance of Halloween to one day as was done successfully in 1963. On motion of Mr. Hayes, seconded by Mr. Massey, Council authorized the Mayor to issue a proclamation limiting the observance of Halloween to October 31, 1964 and setting a curfew of 10:00 P.M., subject to the penalties provided by the ordinances of the City of Dover.
LILLIAN JONES ALLEY
Lillian Jones, 71 West Street, asked Council to abandon a 10 foot alley which parallels the north side of her property at that address. The alley is also the south boundary of three properties facing on Fulton Street but apparently has never been opened or used by anyone but Lillian Jones. The question of ownership of an abandoned alley arose. On motion of Mr. Holpp, seconded by Mr. Hayes, the matter was referred to the City Solicitor for his recommendation.
GOODEN LOT
Council has authorized the purchase of a plot of land on Tar Ditch from G. Leslie Gooden. Mr. Gooden now offers to exchange the plot for a piece of land owned by the City of South Bradford Street in the rear of Club 13. Mr. Hudson of the Solicitor’s office informed Council that Mr. Gooden may not be able to give clear title to the land on Tar Ditch which was part of an estate. On motion of Mr. Holpp, seconded by Mr. Hayes, the matter was tabled until the question of title is resolved.
MITSCHER ROAD CURB
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of mitscher road between White Oak Road and North Little Creek Road. Mayor Carroll declared the hearing open. A representative of John Pleasanton, property owner on the street, stated that he was opposed to the installation of the curb and gutter. No one else appeared to object. Mayor Carroll declared the hearing closed.
On motion of Mr. Harris, seconded by Mr. Walls, Council by unanimous vote adopted the following Resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURB AND GUTTER ON BOTH SIDES OF MITSCHER ROAD BETWEEN WHITE OAK ROAD AND NORTH LITTLE CREEK ROAD.
WHEREAS, the Mayor and Council of the City of Dover have considered the installation of concrete curb and gutter on the street mentioned above, and
WHEREAS, a public hearing has been held by Mayor and Council to determine whether the said curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interest of the residents of the above area,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Mitscher Road between White Oak Road and North Little Creek Road.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid street.

GREENHILL ROAD AND BAYARD AVENUE CURB
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Greenhill Road and on both sides of Bayard Avenue in the City of Dover and assessing the cost thereof to property owners. Mayor Carroll declared the hearing open. Marvin Thompson, Paul Scotton, Josh Twilley, David King, Alice McCloskey, Grafton Heather and one other property owner opposed installation of the curbs. Objections were that sanitary sewer was recently installed and that this cost should be known and absorbed before any other costs are assessed to property owners; that improvements of the streets would increase the flow of traffic which only this evening had resulted to injury to a child; that Greenhill Road should be blocked or dead-ended to eliminate traffic flow from U.S. Route #13; that street lights were needed more than improved streets. Elmar Zemitis approved the proposal and was concerned only with the design of the street. More than 40 property owners were directly concerned so that only a small fraction expressed objection. Mayor Carroll and others explained to those present at the hearing that the City was preparing a program of general improvements and that the curb hearings were being held to determine the sentiment of property owners before these projects are included in the program. Street paving and street lights will also be part of the program. Estimates of costs of projects decided upon will be made and voters of the City will be asked to approve a bond issue to finance the improvements. Following questions and discussion, Mayor Carroll declared the hearing closed.
On motion of Mr. Harris, seconded by Mr. Holpp, Council by unanimous vote adopted the following resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURB AND GUTTER ON BOTH SIDES OF GREENHILL ROAD AND BAYARD AVENUE IN THE CITY OF DOVER.
WHEREAS, the Mayor and Council of the City of Dover have considered the installation of concrete curb and gutter on the street mentioned above and assessing the cost thereof to property owners, and
WHEREAS, a public hearing has been held by Mayor and Council to determine whether the said curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interest of the residents of the above area,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Bayard Avenue and along both sides of Greenhill Road.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid streets.

CURB MILLER, MARTIN AND COWGILL STREETS
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Miller Road, Martin Street, and Cowgill Street east of U.S. Route #13. Mayor Carroll declared the hearing open. At least 14 property owners are directly concerned. Two owners appeared to oppose the project until sewer and water are installed. They were informed that these would be installed before the streets are improved and that payment for the improvements could be spread over a period of time. Mr. Kelley and Mr. Carroll, other property owners in the area, expressed approval of the project. No other being present to express opinions, Mayor Carroll declared the hearing closed.
On motion of Mr. Holpp, seconded by Mr. Harris, Council by unanimous vote adopted the following Resolution:

2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid street.

EDGEHILL, EDGEMONT AND SPRING GARDEN CURB
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Edgehill Avenue between White Oak Road and Maple Parkway and on both sides of Edgemont and Spring Garden Avenue. Mayor Carroll declared the hearing open. No one else appeared to speak for or against the proposed project. Mayor Carroll declared the hearing closed.
On motion of Mr. Hayes, seconded by Mr. Biggs, Council by unanimous vote adopted the following Resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURB AND GUTTER ON BOTH SIDES OF EDGEMONT AND SPRING GARDEN AVENUES.

WHEREAS, a public hearing has been held by Mayor and Council to determine whether the said curb and gutter should be installed, and

NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Edgehill Avenue between White Oak Road and Maple Parkway, and along both sides of Edgemont and Spring Garden Avenues.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid streets.

UTILITY COMMITTEE
Councilman Holpp submitted a written report of a meeting of the Utility Committee held October 5, 1964. Items included was a report on McKee Run, consideration of sewer and water and other improvements in the William Holden tract, a request by the Texaco Company for sewer service to two stations, Ross Street and front foot charges for sewer and water in Eastover Hills, Edgehill, and Edgehill Acres. On motion of Mr. Massey, seconded by Mr. Harris, the report was accepted. A further study will be made of front foot charges for sewer and water.
On motion of Mr. Harris, seconded by Mr. Hayes, the recommendation of the Utility Committee to deny sewer service to The Texas Company stations was approved.
PARKS COMMITTEE
On motion of Mr. Hayes, seconded by Mr. Harris, the written report of a meeting of the Parks, Playgrounds and Tree Committee held October 5 was accepted.
SAFETY ADVISORY COMMITTEE
Councilman Walls also submitted a written report of a meeting of the Safety Advisory Committee held October 5. On motion of Mr. Holpp, seconded by Mr. Harris, the report was accepted.
COTY ANNEXATION
A map and written description of the former Coty lands and the McKee farm proposed for annexation was submitted to Council. On motion of Mr. Massey, seconded by Mr. Smith, the City Solicitor was directed to prepare a resolution providing for a referendum election to annex the area to the City.
DOVER LEASING ZONING
Dover Leasing Company requested Council to rezone from R-8 to C-3 use a plot of land approximately 220' x 266' located on the northeast corner of Pear and Clara Streets. Their plan is to erect an office on the property and use the land for leasing and parking of automotive equipment. A public hearing is required prior to any zoning change.
On motion of Mr. Harris, seconded by Mr. Walls, Council by unanimous vote adopted the following Resolution:
RESOLUTION SETTING FORTH TIME AND PLACE FOR PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.
WHEREAS, a certain area located on the northeast corner of Pear and Clara Streets in the City of Dover is presently zoned for residential use, R-8, and
WHEREAS, a request has been submitted to City Council to change the zone designation from R-8 to C-3 use, and
WHEREAS, a public hearing is required prior to amending the Zoning Ordinance or Zoning Map of The City of Dover
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That a public hearing be held at City Hall at 8:00 P.M. on November 9, 1964 on a proposed amendment to the zoning ordinance and zoning map of the City of Dover which would change from R-8 to C-3 use that area on the northeast corner of Pear and Clara Streets with approximately 220 feet of frontage on Pear Street and 266 feet of frontage on Clara Street.
2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

On motion of Mr. Walls, seconded by Mr. Hayes, Council directed that the request also be referred to the Planning Commission for their recommendation.
