REGULAR MEETING
August 24, 1964
The Regular Meeting of City Council was held Monday, August 24, 1964 at 7:30 p.m. with Mayor Carroll presiding. Councilmen present were: Messrs. Biggs, Harris, Hayes, Holpp, Hughes, Massey, Smith and Walls.
The invocation was said by the Rev. Hubert F. Jicha Jr.
MINUTES
Minutes of the meeting of August 10, 1964 were accepted and bore the written approval of Mayor Carroll.
COMMITTEE REPORTS
The report of the meeting of the Building, Housing and Plumbing Code Committee was not presented as Chairman Hughes was absent. The report will be submitted at the September 14, 1964 meeting.
Councilman Hayes submitted a written report of a meeting of the Wages, Hours, Legislation and Finance Committee. Council accepted the report.
The report of the meeting of the Mayor’s Special Committee on Revision of the Land Subdivision Regulations will be submitted at the September 14, 1964 meeting.
CURB AND GUTTER LINCOLN STREET BETWEEN FOREST AND CHERRY STREETS
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Lincoln Street between Forest and Cherry Streets. Mayor Carroll declared the hearing open. Mr. Walter Bolan, of Bolan Motor Co., was the only person to appear at the hearing, and he voiced no objection to installing the curb and gutter and assessing the cost thereof adjoining property owners. Mayor Carroll declared the hearing closed.
On motion of Mr. Holpp seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURBS AND GUTTERS ON BOTH SIDES OF LINCOLN STREET BETWEEN FOREST AND CHERRY STREETS.
WHEREAS, the Mayor and Council of the City of Dover have considered the installation of concrete curb and gutter on the street mentioned above, and
WHEREAS, a public hearing has been held by the Mayor and Council to determine whether the said curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determine that such installation is for the best interest o the residents of the above area,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Lincoln Street between Forest and Cherry Streets.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage each property owner has on the aforesaid street.

CURB AND GUTTER RAILROAD AVENUE BETWEEN FOREST AND DIVISION STREETS
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Railroad Avenue between Forest and Division Streets. Mayor Carroll declared the hearing open. No one appeared to speak for or against installing the curb and gutter and assessing the cost thereof to adjoining property owner. Mayor Carroll declared the hearing closed.
On motion of Mr. Walls, seconded by Mr. Massey, Council by unanimous vote adopted the following resolution:

CURB AND GUTTER KINGS HIGHWAY BETWEEN LOOCKERMAN AND DIVISION STREETS
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Kings Highway between Loockerman and Division Streets. Mayor Carroll declared the hearing open. No one appeared to speak for or against installing the curb and gutter and assessing the cost thereof to adjoining property owners. Mayor Carroll declared the hearing closed.
On motion of Mr. Holpp, seconded by Mr. Walls, Council by unanimous vote adopted the following resolution:

CURB AND GUTTER RIDGELY STREET
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Ridgely Street. Mayor Carroll declared the hearing open. Mr. L. Lee Layton, of Layton and Co., was the only person to appear at the hearing, Mr. Layton asked that Council postpone the installation of concrete curb and gutters along Ridgely Street until they can find out where the entrances and exits will be. Mr. Layton owns all but one lot on Ridgely Street. Mayor Carroll declared the hearing closed.
On motion of Mr. Massey, seconded by Mr. Walls, Council by unanimous vote accepted Mr. Laytons request.
CURB AND GUTTER REED STREET BETWEEN NEW STREET AND RAILROAD AVENUE
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Reed Street between New Street and Railroad Avenue. Mayor Carroll declared the hearing open. No one appeared to speak for or against installing the curb and gutter and assessing the cost thereof to adjoining property owners. Mayor Carroll declared the hearing closed.
On motion of Mr. Holpp, seconded by Mr. Walls, Council by unanimous vote adopted the following resolution:

WHEREAS, a public hearing has been held by the Mayor and Council to determine whether the said curb and gutter shall be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interests of the residents of the above area,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install concrete curb and gutter along both sides of Reed Street between New Street and Railroad Avenue.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners (*based upon the front footage each property owner) has on the aforesaid street.

REZONING OF NORTHWEST DOVER HEIGHTS
The Dover Planning Commission, at its meeting of August 14, 1964, recommended to Council that the lands in Northwest Dover Heights be rezoned. A public hearing will be required prior to making any changes.
On motion of Mr. Hayes, seconded by Mr. Biggs, Council by unanimous vote adopted the following resolution:
RESOLUTION SETTING FORTH TIME AND PLACE FOR PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.
WHEREAS, a certain area located in the northwest section of The City of Dover, is presently zoned for R-20 and
WHEREAS, City Council proposed to rezone the area as follows:
1. Lands of Dover Special School District - R-20
2. Lands of Suburban Propane - M
3. Lands of McKee Run Electric Plant - M
4. Estate of Harry Wilson - C-1
5. Northwest Dover Heights Area (Taylor) - R-7
6. Lands of Lockwood Gooden - M
WHEREAS, it is necessary to hold a public hearing prior to amending the Zoning Ordinance and Zoning Map.
NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER:
1. That a public hearing be held at City Hall, at 8:00 P.M., on September 14, 1964, on a proposed amendment to the Zoning Ordinance and Zoning Map of the City of Dover which would rezone from R-20 the six sites as follows:
1. Lands of Dover Special School District - R-20
2. Lands of Suburban Propane - M
3. Lands of McKee Run Electric Plant - M
4. Estate of Harry Wilson - C-1
5. Northwest Dover Heights Area (Taylor) - R-7
6. Lands of Lockwood Gooden - M
2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

REZONING EAST LOOCKERMAN STREET, (Behind the Hub Restaurant)
Mr. Maurice Hartnett, representing the Kramedas Realty Company, has requested that a portion of its lands at the southwest corner of East Loockerman Street and U.S. 13 (Dover Bypass), be rezoned from R-10 to C-4 to permit the erection of a motel thereon.
On motion of Mr. Hayes, seconded by Mr. Walls, Council by unanimous vote adopted the following resolution:
RESOLUTION SETTING FORTH TIME AND PLACE FOR PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER:
1. That a public hearing be held at City Hall, at 8:15 P.M., on September 28, 1964, on a proposed amendment to the Zoning Ordinance and Zoning Map of the City of Dover which would rezone from R-10 to C-4, Balance of land of Kramedas Realty Company. Containing approximately 4.4 acres.
2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

SEWER SYSTEM FROM K.C.M. REALTY CO.
Mr. James G. Smith, President of K.C.M. Realty Co., requested the extension of the sanitary sewer to their property located on U.S. Route #13 northeast of Dover. The costs for their portion of the line will be paid by the K.C.M. Realty Co., and the costs for the balance of the line will be paid by the City. Mr. Smith said that they would finance the extension until such time as the City is able to pay its share. The front foot charge will be the same as that charged for the sewer line in Edgehill. On motion of Mr. Hayes, seconded by Mr. Biggs, Council, by unanimous vote, agreed that the same policy adopted for Edgehill be followed.
Capital Green Street Lighting
A petition containing 92 names was read in reference to street lighting in Capital Green. On motion of Mr. Harris, seconded by Mr. Massey, the City Manager was directed to write the petitioners to let them know where they stand in the City’s Improvement Program.
ST. JONES RIVER
Council is still receiving complaints about the odor from the St. Jones River. Jack Woods gave a report of what was being done and what they plan to do if conditions do not get any better. On motion of Mr. Hayes, seconded by Mr. Walls, Council agreed that letters be sent to our Representatives, Senators and U.S. Army Corps of Engineers to see what can be done about dredging the river.
ART EXHIBIT
Miss Elizabeth Rissmiller requested permission to hold a sidewalk art display on the Keith lawn approximately 26 yards east of State Street on Loockerman Street, during the week end of August 28 and 29. On motion of Mr. Hayes, seconded by Mr. Walls, Council agreed to grant permission to hold the art exhibit.
PINE GROVE INDUSTRIES - MISTER DONUT
A letter from Pine Grove Industries was read in which reference is made to a request for rezoning of a plot on which to erect a Mister Donut Shop. A hearing has been set for this appeal on September 14, 1964, but a restricted time limit in the contract for erecting the building is a deterring factor. The plans will be reviewed by the Planning Commission. Mr. Harris made a motion that any construction or changes for the building will be at their own risk, and that the hearing will be held on September 14, as scheduled, at which time their letter will be answered and a permit issued. Mr. Harris’s motion was not seconded.
GILBERT SHANK PLOT
On motion of Mr. Smith, seconded by Mr. Hayes, Council agreed to purchase from Mr. Gilbert Shank a piece of land containing approximately one-half acre, located on the creek just south of Silver Lake dam. The purchase price is $1,000. Mr. Shank requests an agreement from the City as to the fill and landscaping that will be needed.
Safety Achievement award
Mayor Carroll attended a luncheon at the DuPont Hotel today, and received a safety award for the City of Dover. It is the Pedestrian Safety Achievement Award for 16 consecutive years.
