REGULAR MEETING

August 10, 1964

The Regular Meeting of City Council was held Monday, August 10, 1964 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Holpp, Hughes, Massey, Smith and Walls.

The invocation was said by the Rev. Hubert F. Jicha Jr.

MINUTES

Minutes of the meeting of July 27, 1964 were accepted and bore the written approval of Mayor Carroll.

REPORTS

Report of the Chief of Police was accepted.

Report of Alderman Cavanaugh was accepted. Checks in the amounts of $215.00, $21.50 and $552.00 were remitted to the City. Report of Magistrate Knotts was accepted. A check in the amount of $977.20 was remitted to the City.

Report of the Fire Marshal & Building Inspector was accepted.

Report of the Board of Health was accepted.

Report of Cash Receipts, General Fund, was accepted.

Budget Report, General Fund, was accepted.

Cash Report, Electric Revenue Fund, was accepted.

Cash Report, Electric Improvement Fund, was accepted.

Report of the City Manager was accepted.

CAR BIDS

Fire Marshal Roe requested permission to obtain bids to replace his car. Council asked the City Manager whether other cars needed replacing. He named the City engineer’s and Electric Department superintendents cars. Council suggested that bids be obtained on a combined basis because of the possibility of a better price.

CITY HALL HEAT & AC

City Manager Ward reported he had analyzed the two bids received for heating and air conditioning in City Hall. Comparable heating was offered by both bidders and with 15-ton air conditioning Forney Engineering bid $17,390 and Dover Appliance bid $18,850. Forney submitted an alternate bid on heating and 20-ton air conditioning or a price of $18,270. Mr. Ward recommended acceptance of the latter bid. On motion of Mr. Hayes, seconded by Mr. Walls, Council awarded the installation of heat and air conditioning in City Hall to Forney Engineering Co., Easton, on their bid of $18,270.00.

CURB & GUTTER HEARINGS

On motion of Mr. Harris, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:

A RESOLUTION SETTING A PUBLIC HEARING TO CONSIDER THE INSTALLATION OF CURB AND GUTTER ON BOTH SIDES OF LINCOLN STREET BETWEEN FOREST AND CHERRY STREETS.

WHEREAS, the City Council of the City of Dover is considering the installation of concrete curb and gutter on both sides of Lincoln Street between Forest and Cherry Street and charging the cost thereof to property owners, and

WHEREAS, the Charter of The City of Dover requires that a public hearing be held prior to such action, at which the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published,

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. The Council of the City of Dover will hold a public hearing in the Council Chambers at City Hall at 8:00 P.M., August 24, 1964 on the question of installing concrete curb and gutters on both sides of Lincoln Street between Forest and Cherry Streets and assessing the cost thereof to property owners.

Section 2. The following-named persons are the owners or the purported owners of the properties in front of which the concrete curb and gutter will be installed:

On motion of Mr. Holpp, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:

A RESOLUTION SETTING A PUBLIC HEARING TO CONSIDER THE INSTALLATION OF CURB AND GUTTER ON BOTH SIDES OF RAILROAD AVENUE BETWEEN FOREST AND DIVISION STREETS.

WHEREAS, the City Council of the City of Dover is considering the installation of concrete curb and gutter on both sides of Railroad Avenue between Forest and Division Streets and charging the cost thereof to property owners, and

WHEREAS, the Charter of The City of Dover requires that a public hearing be held prior to such motion, at which the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published,

NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. The Council of The City of Dover will hold a public hearing in the Council Chambers at City Hall at 8:05 P.M., August 24, 1964 on the question of installing concrete curb and gutters on both sides of Railroad Avenue between Forest and Division Streets and assessing the cost thereof to property owners.

Section 2. The following-named persons are the owners or the purported owners of the properties in front of which the concrete curb and gutter will be installed:

WHEREAS, the Charter of The City of Dover requires that a public hearing be held prior to such action, at which the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published,

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. The Council of the City of Dover will hold a public hearing in the Council Chambers at City Hall at 8:10 P.M., August 24, 1964 on the question of installing concrete curb and gutters on both sides of Kings Highway between Loockerman and Division Streets and assessing the cost thereof to property owners.

A RESOLUTION SETTING A PUBLIC HEARING TO CONSIDER THE INSTALLATION OF CURB AND GUTTER ON BOTH SIDES OF RIDGELY STREET IN THE CITY OF DOVER.

WHEREAS, The City Council of the City of Dover is considering the installation of concrete curb and gutter on both sides of Ridgely Street in the City of Dover and charging the cost thereof to property owners, and

WHEREAS, the Charter of the City of Dover requires that a public hearing be held prior to such action, at which the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published,

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. The Council of The City of Dover will hold a public hearing in the Council Chambers at City Hall at 8:15 P.M., August 24, 1964 on the question of installing concrete curb and gutters on both sides of Ridgely Street in the City of Dover and assessing the cost thereof to property owners.

Section 2. The following-named persons are the owners or the purported owners of the properties in front of which the concrete curb and gutter will be installed:

Section 3. At the said meeting the Council will hear the aforesaid owners of property and other residents of the City in accordance with the Charter of The City of Dover.

WHEREAS, the City Council of the City of Dover is considering the installation of concrete curb and gutter on both sides of Reed Street between New Street and Railroad Avenue and charging the cost thereof to property owners, and

WHEREAS, the Charter of The City of Dover requires that a public hearing be held prior to such action, at which the property owners concerned and other residents of the City may be heard, and that notice of such hearing be published,

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. The Council of The City of Dover will hold a public hearing in the Council Chambers at City Hall at 8:20 P.M., August 24, 1964 on the question of installing concrete curb and gutters on both sides of Reed Street between New Street and Railroad Avenue and assessing the cost thereof to property owners.

AMA CONGRESS

Mayor Carroll reported on his attendance at the American Municipal Association Congress held at Miami Beach, Florida July 25 thru 29, 1964. He found that many communities were concerned about zoning and planning and the search for additional revenues. He distributed to Council copies of resolutions adopted at the Congress.

 

COMMITTEE REPORTS

Council accepted a written report of a meeting of the committee considering revision of the Land Subdivision Regulations submitted by Councilman Holpp.

Council accepted a written report of a meeting of the committee on Parks, Playgrounds and Trees submitted by Councilman Walls.

Council accepted a written report of a meeting of the Safety Advisory Committee submitted by Councilman Walls.

Council accepted a written report of two meetings of the Utility Committee submitted by Councilman Holpp.

Council accepted a written report of a meeting of the Wages, Hours, Legislative & Finance Committee submitted by Councilman Hayes.

LITTLE LEAGUE

Dover Little League is the State Champion and will participate in a regional tournament to be held in Charleston, West Virginia. Cost of the trip may be as much as $1500 and the directors of the Little League have asked the financial support of the City. The Chamber of Commerce is already endeavoring to raise funds. The Parks & Playgrounds Committee recommends support. On motion of Mr. Smith, seconded by Mr. Biggs, Council authorized a donation by the City of an amount not to exceed $500 if that, with other donations, is required to meet expenses.

KINGS HIGHWAY ZONING

Pine Grove Industries Inc. requested Council to rezone a plot of land located on the northwest corner of Kings Highway and U.S. Route #13 from R-20 to Highway Commerce, C-4. A Public Hearing is required prior to rezoning.

On motion of Mr. Hayes, seconded by Mr. Smith, Council by unanimous vote adopted the following resolution:

RESOLUTION SETTING FORTH TIME AND PLACE OF PUBLIC HEARING ON A PROPOSED AMENDMENT TO THE ZONING MAP AND DIRECTING THAT A NOTICE OF SAID HEARING BE PUBLISHED IN ACCORDANCE WITH THE PROVISIONS OF THE DELAWARE CODE.

WHEREAS, a certain area on the northwest corner of U.S. Route #13 and Kings Highway in the City of Dover is presently zoned for residential use, R-20, and

WHEREAS, a request has been submitted to change the zone designation from R-20 to C-4, Highway Commerce use, and

WHEREAS, it is necessary to hold a public hearing prior to amending the Zoning Ordinance and Zoning Map,

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. That a public hearing be held at City Hall, at 8:00 P.M., on September 14, 1964 on a proposed amendment to the zoning ordinance and zoning map of the City of Dover which would rezone from R-20 to C-4 use a plot of land on the northwest corner of U.S. Route #13 and Kings Highway having a frontage of approximately 225 feet on U.S. Route #13 and of approximately 160 feet on Kings Highway and being bounded on the north by lands of Biter & Cullen and on the west by lands of Harrington Scott.

Section 2. That notice of the public hearing be given in accordance with the provisions of the Delaware Code.

PLUMBING CODE

At the request of Councilman Hughes consideration of the adoption of a proposed Plumbing Code was tabled until the committee preparing it gives it further study.

BLOCK PARTY

On motion of Mr. Smith, seconded by Mr. Walls, Council a request of residents of the Towne Point development to hold a block party in the 900 block of Boggs Drive from 2 to 6 P.M. August 16.

CHICKEN FESTIVAL

A letter from the Delmarva Poultry Industry Inc. informed Council that Salisbury, Maryland has been selected as the site of the 1965 Chicken Festival, June 17, 18 and 19, 1965.
