REGULAR MEETING
July 13, 1964
The Regular Meeting of City Council was held Monday, July 13, 1964 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Hughes, Massey, Smith and Walls.
The invocation was said by the Rev. Leroy Hamilton.
MINUTES
Minutes of the meeting of June 22, 1964 were accepted as read and bore the written approval of Mayor Carroll.
REPORTS
Report of the Chief of Police was accepted as read.
Report of the City Alderman was accepted as read. Checks in the amounts of $240.00, $828.50 and $306.00 were remitted to the City. Report of Magistrate Knotts was accepted as read. A check in the amount of $1863.60 was remitted to the City.
Report of the Fire Marshal and Building Inspector was accepted.
Report of the Board of Health was accepted.
Report of General Fund Cash Receipts was accepted.
Report of General Fund Budget was accepted.
Report of Electric Revenue Fund Cash was accepted.
Report of Electric Improvement Fund Cash was accepted.
Report of the City Manager was accepted.
DOG FOOD
Councilman Hughes reported he had inspected the dog pound used by the City and found it to be well kept.
DANGEROUS BUILDINGS
Building Inspector Roe reported he had given notice and posted a number of buildings as dangerous under the ordinance of the City of Dover and from two no reply or evidence of compliance had been received. On motion of Mr. Walls, seconded by Mr. Hughes, Council directed that written notice be given to all interested parties in the Estate of Wayman Brown, 48 Slaughter Street, and in the Estate of Joseph Ravy 752-754 Slaughter Street, to appear before Council at 8 P.M. on July 27, 1964 to show cause why the buildings or structures reported to be ‘dangerous buildings’ should not be repaired, vacated or demolished in accordance with the Building Inspector’s notice. A hearing will be held in the Council Chambers at that time and date.
CURB & GUTTER PARK DRIVE
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Park Drive between Division Street and Loockerman Street. Mayor Carroll declared the hearing open. No one appeared to speak for or against installing the curb and gutter and assessing the cost thereof to adjoining property owners. It was noted that the policy of the City was not to assess costs against properties which already had curb in place. Mayor Carroll declared the hearing closed.
On motion of Mr. Hayes, seconded by Mr. Biggs, Council by unanimous vote adopted the following resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CONCRETE CURBS AND GUTTERS ON BOTH SIDES OF PARK DRIVE BETWEEN DIVISION STREET AND LOOCKERMAN STREET IN THE CITY OF DOVER AND ASSESSING THE COST THEREOF TO THE ADJOINING PROPERTY OWNERS.
WHEREAS, the Mayor and Council of the City of Dover have considered the installation of concrete curb and gutter on the street mentioned above, and
WHEREAS, a hearing has been held by the Mayor and Council determining whether the said curb and gutter should be installed, and
WHEREAS, pursuant to the hearing the Mayor and Council have determined that such installation is for the best interests of the residents in the above area,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. That the City of Dover shall install along both sides of Park Drive between Division Street and Loockerman Street concrete curb and gutter.
2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners based upon the front footage which each property owner has on the aforesaid street.

CURB & GUTTER, SLAUGHTER, MINIMA AND CLARENCE
A public hearing was duly advertised for this date on the installation of concrete curb and gutter on both sides of Slaughter, Minima and Clarence Streets. Mayor Carroll declared the hearing open. No one appeared to speak for or against installing the curb and gutter and assessing the cost thereof to adjoining property owners. It was noted that if the project were completed Clarence Street would be paved 32' from curb to curb and also Slaughter Street from Clarence to Minima, while Minima Street and Slaughter west of Minima would be 38' curb to curb. Mayor Carroll declared the hearing closed.
On motion of Mr. Smith, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:

2. That the cost of the installation of the said concrete curb and gutter shall be assessed against the adjoining property owners according to the front footage which each property owner has on the aforesaid streets.

PEOPLE TO PEOPLE
Mr. & Mrs. Fred Britten and Mr. & Mrs. Warren reported to Council on a recent affair held in the State Department in Washington in connection with the People to People program in which Dover participates through a local group with Lamia, Greece as its sister City. Dover received a citation for its part in the program. Mayor Carroll was also present in Washington for the affair.
Council recessed until 10:00 P.M.
AUDITOR
Council discussed the employment of an auditor to make the annual audit of City accounts and the scope of the audit. On motion of Mr. Hayes, seconded by Mr. Massey, Council approved employment of William Manter, CPA to dot he annual City audit.
LEBANON BRIDGE HEARING
A letter from the U.S. Corps of Engineers reported that a request had been received from the Delaware State Highway Department to close permanently the draw bridge at Lebanon thus making the St. Jones River unnavigable beyond that point. They will receive petitions for or against the request at their Philadelphia office until August 5, 1964. On motion of Mr. Hayes, seconded by Mr. Smith, Council directed that a protest be registered on closing the bridge on behalf of The City of Dover.
RICHTER & MEYERS LIGHTS
Four yard lights were installed by the City of Dover in the parking area of the Edgehill Shopping Center in September 1962 at the request of the owners Richter & Meyers, who were billed installation costs of $612.65. They have asked that the charge be reduced or written off entirety on the grounds that the lights illuminate City streets. Council noted that the lights are installed entirely on private property. On motion of Mr. Harris, seconded by Mr. Hayes, Council directed that necessary steps be taken to collect the bill due the City.
UTILITY COMMITTEE
In the absence of the Chairman, Mr. Holpp, Councilman Harris submitted the written report of the Utility Committee, which met June 25 and July 6. A recommendation of the Committee was that the City purchase a plot of land from Leslie Gooden for $1000 in the Tar Ditch area through which City utilities run. On motion of Mr. Harris, seconded by Mr. Smith, Council authorized purchase of the plot for $1000. Mr. Hughes voted ‘No’. Council approved acceptance of the reports with Mr. Hughes voting ‘No’.
FPC HEARING
Hearings are being held by the Federal Power Commission on a resale power rate dispute between Delaware Power & Light Company and two municipalities in Maryland, one of which is St. Michaels. The outcome will effect rates charged the City of Dover by DP&L. On motion of Mr. Harris, seconded by Mr. Biggs, Council authorized the City Solicitor to take the necessary steps to intervene on behalf of the City of Dover. Mr. Hughes voted ‘No’.
SUBDIVISION COMMITTEE
Councilman Hayes submitted a written report of a meeting of the special committee appointed to consider revision of the Land Subdivision Regulations. Council accepted the report.
PARKS & PLAYGROUNDS
Councilman Walls submitted a written report of a meeting of the committee on Parks & Playgrounds. Council accepted the report.
Safety Committee
Councilman Walls submitted a written report of a meeting of the Safety Advisory Committee. Council accepted the report.
ORDINANCE FEDERAL STREET
On motion of Mr. Walls, seconded by Mr. Hayes, Council by unanimous vote adopted the following ordinance:
AN ORDINANCE PROHIBITING PARKING ON BOTH SIDES OF FEDERAL STREET IMMEDIATELY ADJACENT TO COURT STREET.
WHEREAS, the Mayor and Council of The City of Dover are authorized to restrict parking on streets within the limits of the City of Dover, and
WHEREAS, the Police Department of the City of Dover has deemed it advisable to restrict parking on certain portions of Federal Street within the limits of the City of Dover
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. No person, firm, association or corporation shall park, or allow to be parked, any motor vehicle on those portions of both sides of Federal street extending north and south for a distance of forty-two (42') feet from the intersection of said Federal Street with Court Street.
2. The Police Department of the City of Diver is authorized to install such signs or markings prescribing such areas as a “No Parking Zone”.
3. Any person convicted of a violation of this ordinance shall be fined not less than $2.00 nor more than $10.00, and in lieu of payment of such fine shall be imprisoned for a period not to exceed five (5) days.

MUNICIPAL AID
A letter from the State Highway Department informed the City that its share of the State Municipal Street Aid Fund for the year 1964 would be $92,490.87.
FIRE LIAISON
A letter from the Robbins Hose Company named Thomas E. Baker and the Fire Chief as Liaison Officers between the Fire Department and the City of Dover in matters relating to water supply and fire protection. On motion of Mr. Hughes, seconded by Mr. Walls, Council accepted the request.
TRASH TRUCK
On motion of Mr. Massey, seconded by Mr. Smith, Council authorized request for bids for a new truck to pick up trash and garbage.
STOP SIGN ORDINANCE
On motion of Mr. Walls, seconded by Mr. Smith, Council by unanimous vote passed the following ordinance:
AN ORDINANCE PROVIDING FOR THE ELECTION OF A STOP SIGN ON THE NORTHWEST SIDE OF THE INTERSECTION AT ORCHARD AVENUE AND PINE STREET.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:
1. No vehicle traveling south on Orchard Avenue shall enter into, over or upon Pine Street without stopping at the intersection of Orchard Avenue with the north side of Pine Street.
2. The Police Department of the City of Dover is hereby authorized and empowered to install the necessary stop sign at the intersection of Orchard Avenue and Pine Street.
3. Any violation of the provisions of this ordinance shall result in prosecution under the laws of the State of Delaware, and fines and/or imprisonment shall be as provided in the applicable provisions of the Delaware Code.
