REGULAR MEETING
October 28, 1963
The Regular Meeting of City Council was held Monday, October 28, 1963 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs. Biggs, Harris, Hayes, Hill, Holpp, Hughes, Smith and Walls.
MINUTES
Minutes of the meetings of October 14 and October 21, 1963 were accepted and bore the written approval of Mayor Carroll.
SAFETY COMMITTEE
Councilman Hill submitted a report of the regular meeting of the Safety Advisory Committee which was accepted by Council.
DIVISION AND FOREST
A traffic island at the intersection of Division and Forest Streets impedes the eastward flow of traffic on Division Street. The Safety Advisory Committee submitted for the approval of Council a new design of the intersection prepared by the State Highway Department. The proposal would permit easier flow of traffic. On motion of Mr. Holpp, seconded by Mr. Smith, the new design was approved by Council and the Clerk was directed to so notify the State Highway Department.
PARKS AND PLAYGROUNDS
Councilman Walls submitted a report of the regular meeting of the Committee on Parks, Playgrounds and Trees which was accepted by Council.
ZURKOW CURB
Chief of Police Turner reported to Council that he had no objection to Robert Zurkow’s request for a curb depression on American Avenue south of Division St., and the relocation of a curb depression on Division Street, west of American Avenue. On motion of Mr. Hayes, seconded by Mr. Smith, Council approved the request for curb depressions, subject to State Highway Department approval of the curb depression on Division Street.
HALLOWEEN
The City Solicitor read to Council a proclamation prepared for issuance by the Mayor declaring the Halloween observation limited to October 31 and requesting Dover residents to limit Halloween activities to that date and to terminate the observance at 10 P.M. Violators would be subject to penalties provided by existing laws and ordinances of the City. On motion of Mr. Holpp, seconded by Mr. Hill, Council approved the proclamation.
JAYCEE PARADE
The Junior Chamber of Commerce have planned their annual Halloween parade for October 30 and stated they would be unable to change the date to October 31 because of band commitments. If the parade could not be held on October 30 because of the Halloween proclamation it would be canceled. Council felt that the proclamation should not interfere with the parade. On motion of Mr. Hill, seconded by Mr. Walls, Council approved granting a parade permit to the Junior Chamber of Commerce for October 30.
ORDINANCES
On motion of Mr. Walls, seconded by Mr. Holpp, Council by unanimous vote adopted the following ordinance:
AN ORDINANCE CREATING AND PRESCRIBING A TRUCK LOADING ZONE ON THE EAST SIDE OF NEW STREET:
WHEREAS, the Mayor and Council are vested with the power and authority to regulate and restrict the use of the streets and roadways within the limits of the City of Dover, and
WHEREAS, the Police Department of the City of Dover is authorized to enforce the regulations and ordinances of the City of Dover with respect to parking and traffic regulations and ordinances of the City of Dover with respect to parking and traffic
NOW, THEREFORE from and after the passage of this ordinance
(1) The following described area shall be used for the loading and unloading of trucks and only for such purposes for and during the time prescribed herein:
On the east side of New Street beginning at a point forty (40) feet north of the northerly right of way line of Water Street, and extending therefrom in a northerly direction a distance of forty four (44) feet.
(2) The Chief of Police is hereby authorized and empowered to designate the area described in paragraph one above as a loading and unloading zone by the placing of appropriate signs setting forth the time.
(3) That the area prescribed herein for a truck loading and unloading zone shall be such between the hours of 9:00 A.M. and 3:00 P.M. on all days except Sunday.
(4) Any person, firm, association or corporation in violation of the terms of this ordinance shall upon conviction thereof be fined not less than $1.00 nor more than $10.00, and upon failure to pay such fine shall be imprisoned for not less than one day or more than ten days.
Passed October 28, 1963.
On motion of Mr. Smith, seconded by Mr. Hayes, Council by unanimous vote passed the following ordinance:
AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON A PORTION OF THE NORTH SIDE OF WATER STREET.
NOW, THEREFORE, be it ordained by the Mayor and Council of The City of Dover in Council met, that from and after the passage of this ordinance
1. It shall be unlawful for any person, firm, association or corporation to park any motor vehicle north side of Water Street beginning at a point at the intersection of the northerly right of way line of Water Street and the easterly right of way line of State Street and extending for a distance of 328 feet along the northerly side of Water Street to a point in the westerly curb depression of the entrance to the Court House Parking lot.
2. The Chief of Police of the City of Dover is hereby authorized and empowered to designate the area described above as a “No Parking” zone, and to install the necessary signs and/or markings.
3. Any person who parks a vehicle in violation of the terms of this section in a space properly designated as a no parking zone shall upon conviction thereof be fined not less than $1.00 nor more than $10.00 or upon failure to pay such fine as shall be imposed and costs for prosecution shall be imprisoned for not more than 10 days.
Passed October 28, 1963.
On motion of Mr. Holpp, seconded by Mr. Biggs, Council by unanimous vote passed the following ordinance:
AN ORDINANCE PROHIBITING THE PARKING OF MOTOR VEHICLES ON A PORTION OF THE NORTH SIDE OF WATER STREET.
NOW, THEREFORE, be it ordained by the Mayor and Council of the City of Dover in Council met, that from and after the passage of this ordinance:
1. It shall be unlawful for any person, firm, association or corporation to park any motor vehicle on that portion of the north side of Water Street beginning at a point at the intersection of the northerly right of way line of Water Street and the easterly right of way line of New Street and extending from said beginning point along the northerly right of way line of Water Street east a distance of 63 feet.
2. The Chief of Police of the City of Dover is hereby authorized and empowered to designate the area described above as a “No Parking” zone and to install the necessary signs and/or markings.
3. Any person who parks a vehicle in violation of the terms of this section in a space properly designated as a no parking zone shall upon conviction thereof be fined not less than $1.00 nor more than $10.00 or upon failure to pay such fine as shall be imposed and costs for prosecution shall be imprisoned for not more than 10 days.

PREPARE ORDINANCES
The Chief of Police recommended that stop signs be installed on streets in the Fairview development and in other sections of Dover. Councilman Hughes remarked on the difficulty motorists have entering State Street block the view. On motion of Mr. Holpp, seconded by Mr. Smith the City Solicitor was directed to prepare ordinances covering the above subjects.
SOLICITOR REPORT
City Solicitor Buckson reported that action had been started in the case of the City and Frank Robino concerning Ross Street between Fairview Avenue and Pear Street and that a court hearing was scheduled to be held in Dover at 11:00 A.M. October 31, 1963.
Mr. Buckson reported he had discussed with Herman Brown, attorney for Max Ambach, the matter of Ambach extending a City water line beyond an agreed upon area to serve a swimming pool and that Mr. Brown was of the opinion that Ambach must renegotiate his agreement before extending water to the swimming pool. Mr. Ambach was not at present in the City.
Mr. Buckson reported that the hearing on the condemnation of the Scull property for the sewage plant expansion would beheld at 10 A.M. November 6.
NORTH STREET
Councilman Harris discussed the possible widening of North Street and asked that the question of widening the street from New Street to the Railroad be placed on the agenda for the next meeting of Council. City officials were asked to have the necessary information prepared.
CONSTRUCTION PROGRAM
A progress report was submitted to members of Council on all construction underway or proposed this year within the City. City Engineer Joseph answered questions.
HEALTH
Health Secretary Thomas Baker told Council he had been notified that certain smoked fish originating in the Great Lakes region were contaminated and had caused some sickness and deaths throughout the nation. All local outlets were being told to discontinue the sale of these products.
