                                                           REGULAR MEETING

February 25, 1963

The regular meeting of City Council was held Monday, February 25, 1963 at 7:30 P.M. with Mayor Carroll presiding. Councilmen present were Messrs Biggs, Harris, Hayes, Hill, Holpp, Hughes and Walls.

The invocation was said by the Rev. Jicha of Wesley Methodist Church.

MINUTES

Minutes of the meeting of February 11, 1963 were accepted and bore the written approval of Mayor Carroll.

APPOINTMENTS

Planning Commission: Mayor Carroll named as appointees to the Planning Commission for three year terms David McCue, J. Henry McDonnell, and Mrs. H. V. Holloway. On motion of Mr. Hayes, seconded by Mr. Holpp, the appointment of Mr. McDonnell was confirmed. On motion of Mr. Hughes, seconded by Mr. Biggs, the appointment of Mrs. Holloway was confirmed. On motion of Mr. Hughes, seconded by Mr. Biggs, the appointment of Mr. McCue was confirmed, with Mr. Hayes voting ‘No’.

Zoning Commission: Mayor Carroll named as appointee to the Zoning Commission for a six year term Henry K. Roscoe Jr. On motion of Mr. Holpp, seconded by Mr. Harris the appointment of Mr. Roscoe was confirmed, 4 to 3, Messrs Hayes, Hill and Walls Voting ‘No’.

Utility Committee: Mayor Carroll named as appointees to the Utility Committee Councilman Holpp, chairman, Councilmen Harris and Biggs, and Mayor Carroll. On motion of Mr. Holpp, seconded by Mr. Hughes, the appointments were confirmed, 4 to 3, Messrs Hayes, Hill and Walls voting ‘No’.

Parking Authority: Mayor Carroll was prepared to name an appointee to the Parking Authority bit discovered that the State Code required appointments to be made between May 1 and July 31.

UTILITY COMMITTEE REPORT

Councilman Holpp reported that he had conferred with members of the State Highway Department on the possibility of that Department immediately opening a temporary road between the Hartly and Hazlettville Roads. He learned that it would be impossible for that Department to take any action until their program was approved and funds appropriated by the State Legislature.

R-7 ZONING HEARING

A hearing was duly advertised on a proposed amendment to the zoning ordinance which would provide for a new one-family residence zone known as R-7 zone. Mayor Carroll declared the hearing opened. No one appeared to speak for or against the proposed amendment.

On motion of Mr. Hill, seconded by Mr. Walls, Council by unanimous vote adopted the following amendment to the Zoning Ordinance:

AN ORDINANCE AMENDING THE ZONING ORDINANCE PROVIDING FOR A ZONE TO BE DESIGNATED AS R-7.

WHEREAS, the zoning ordinance of the City of Dover provides for certain areas to be designated as Residence Zones, and

WHEREAS, the said zones as prescribed therein are R-20, R-15, R-10 and R-8, and

WHEREAS, it is the desire of the Mayor and Council of the City of Dover to provide for an additional Residence Zone to be designated as Zone R-7 with height and setback requirements differing in parts with those zones mentioned above and already in existence.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

That from and after the passage of this ordinance the following additions and modifications shall be made to the Zoning Ordinance of the City of Dover.

1. That the table of contents of the Zoning Ordinance of The City of Dover be changed as follows: Article III, Section 3.1, shall read as follows: One-Family Residence Zones (R-20, R-15, R-10, R-8 R-7).

2. That Article III, Section 3.1, shall be changed to read as follows: One-Family Residence Zone (R-20, R-15, R-10, R-8 R-7).

3. That Section 3.11 shall be amended by adding thereto the numbers R-7 after R-8 as it appears on line 2 of said section.

4. That Article IV, Section 4.11 shall be amended by adding the following requirements for Zone R-7:

5. That Section 5.16 shall be amended to add an R-7 zone and providing therein that (no exceptions) shall be allowed for any lots of less than fifty (50) feet as prescribed for lots in a Zone designated as R-7.

6. That Section 10.21 shall be amended by adding thereto under Part B, a zone designated as R-7.

7. That Article XIII, Definitions, shall be amended to provide under Residence Zone after R-8, the designation ‘R-7'.

8. From and after the passage of this ordinance, the new zone to be designated as R-7, shall be incorporated as part of the Zoning Ordinance of the City of Dover, and any restrictions provided for said section shall also be limited by the general provisions set forth in the Zoning Ordinance.

BRADFORD STREET ZONING

A hearing was duly advertised on a proposed amendment to the Zoning Map of the City of Dover which would rezone both sides of South Bradford Street between Reed and Loockerman Streets, to the line of the alley in the rear of each side, from General Residence Zone, RG-1, to Commercial Zone, C-2. Mayor Carroll declared the hearing opened. No one appeared to speak for or against the proposed amendment.

On motion of Mr. Hill, seconded by Mr. Walls, Council by unanimous vote adopted the following amendment to the Zoning Mao and Zoning Ordinance of the City of Dover:

AN ORDINANCE AMENDING THE ZONING MAP AND ZONING ORDINANCE OF THE CITY OF DOVER BY CHANGING THE ZONING DESIGNATION OF SOUTH BRADFORD STREET TO C-2.

WHEREAS, the City of Dover has enacted a zoning ordinance regulating the use of property within the limits of the City of Dover, and

WHEREAS, it is deemed desirable and proper to change the Zoning Map and the permitted uses on South Bradford Street between Reed and Loockerman Streets from General Residence Zone, RG-1, to Commercial Zone, C-2.

NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

1. From and after the passage and approval of this ordinance, the Zoning Map and Zoning Ordinance of the City of Dover shall be amended by changing the zoning designation of both sides of South Bradford Street, between Reed and Loockerman Streets, to the line of the alley in the rear of each side, from General Residence Zone, RG-1, to Commercial Zone, C-2.

Passed February 25, 1963.

ZONING AMENDMENT

On motion of Mr. Hayes, seconded by Mr. Walls, Council directed that the Zoning Commission be requested to recommend areas to be included in the now R-7 Zoning designation and on changing the designation of McGinnis’ Market to a commercial zone.

MAPLE LANE

Council discussed parking restrictions on Maple Parkway from King’s Highway to the dual. On motion of Mr. Hill, seconded by Mr. Hayes, Council directed the City Solicitor to prepare an ordinance prohibiting parking on that street with the exception of a load and unload zone in the south side near the watchbox.

PARKING METERS

Certain businesses requested that parking restrictions be placed on the street before their businesses on Division Street, between Bradford and Queen Streets, and on Queen Street south of Loockerman. The Chief of Police recommended that parking meters be installed in front of the places of business so that parking might be more easily controlled. On motion of Mr. Hill, seconded by Mr. Biggs, Council directed that a public hearing be held at its next meeting on the question of installing parking meters on Division Street between Bradford and Queen Street, and on Queen Street from Loockerman to North Street.

TEMPORARY ROAD HEARING

A hearing was duly advertised on a proposal to open a street between Forrest Street and the Hazlettville Road over Bertrand Drive and lands of William Holden, the Dover Housing Authority, and Walker Mifflin. Mayor Carroll declared their approval of the proposal and pointed out the urgency of the need. James Hughes, attorney for William Holden, pointed out that the proposed street would take portions of three lots of his client, and that under the procedure of public hearing and condemnation the land would be taken permanently. In this event his client would require compensation. He stated his client was willing to negotiate a temporary lease of the land required. Josh Twilley, attorney for the Dover Housing Authority, was also concerned and could not agree to any permanent taking of the land. Ralph Tischer, representing Walker Mifflin, pointed out that the proposed road would separate the tillable portion of the Mifflin farm from the farm buildings and would make it necessary to move farm machinery back and forth across the road when tilling the land. He also was concerned with the length of time the road would be in use and stated that a permanent division of the land would lessen the value of the entire plot. Council pointed out that the road was intended as a temporary measure to be in use approximately two years to move heavy traffic resulting from construction of the new General Foods plant on the Hazlettville Road. There were apparently no serious objections to the opening of the road on a temporary basis. On motion of Mr. Holpp, seconded by Mr. Hayes, the matter was referred to the City Solicitor to negotiate agreements with the property owners involved on the basis of opening a temporary road across their lands.

POWER AGREEMENTS

City Manager Ward reported that formal contracts were being prepared for signature by the Mayor and Clerk covering the supply of electric current by DP&L to Dover for resale to General Foods. Minor details remain to be worked out. Representatives of General Foods will be in town in the next week or two to go over the contract between that firm and Dover.

IDENTITY CARDS

Mr. Biggs asked that members of Council be furnished with identity cards for use at Dover installations, or when visiting other Cities.
