June 26, 1961

The regular meeting of City Council was held Monday, June 26, 1961 at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Thompson, Turner and Zartman.

MINUTES

Minutes of the meeting of June 12, 1961 were accepted as read and bore the written approval of Mayor Haman.

DOCTOR’S PARKING

Doctors Charles Allen and Norman P. Jones requested two reserved parking spaces in front of their office at 128 S. Bradford Street. On motion of Mr. Davis, seconded by Mr. Turner, the request was granted. Mr. Holpp voted ‘No’.

DRIVEWAY

Rev. G. P. Mellick Belshaw of Christ Church requested permission to depress the curb on Water Street to permit off-street parking in the rear of the rectory. The request was referred to the Chief of Police and City Engineer to report back their recommendation.

BUDGET ORDINANCE

Council discussed the proposed budget for the general operation of the City for the fiscal year beginning July 1, 1961. On motion of Mr. Fromm, seconded by Mr. Thompson, Council passed the following budget ordinance by vote of 7 to1. Mr. Hayes voted ‘No’.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. That the amount herein named, aggregating nine hundred eighty-eight thousand, seven hundred dollars ($988,770.00), or so much thereof as may be necessary, are hereby appropriated from current revenues for the use of the several departments of the municipal government, and for the purposes hereinafter mentioned for the Fiscal Year beginning July 1, 1961, and ending June 30, 1962, as follows:

Section 2. The City Manager is hereby authorized, without further approval of City Council, to make interdepartmental transfers up to 10% of the amount herein appropriated to any department.

CURB HEARINGS

Hearings were opened on the installation of curb and gutter on portions of William Street, Queen Street and New Street in accordance with resolutions adopted June 12, 1961 and duly published. No interested persons were present to speak for or against the proposed projects.

On motion of Mr. Thompson, seconded by Mr. Hayes, Council by unanimous vote adopted the following Resolution:

A RESOLUTION PROVIDING FOR THE INSTALLATION OF CURBS AND GUTTERS ON THE SPECIFIED PORTIONS OF THE FOLLOWING NAMED STREETS WITHIN THE CITY OF DOVER AND FIXING THE COST THEREOF TO BE BORNE BY ADJOINING OWNERS.

1. Between Pear Street Alley and the Railroad on William Street

2. Between Clara Street and Mary Street on Queen Street

3. Between Dover Street and Water Street on New Street.

WHEREAS the Council of The City of Dover has held a meeting on Monday, June 26,1961, at 8:00 P.M. Eastern Daylight Saving Time at the City Hall, in accordance with a resolution adopted June 12, 1961, and duly published in accordance with the Charter; and

WHEREAS all interested property owners and other residents of the City have been heard, and a written objection signed by a majority of the property owners affected has not been presented;

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dover:

Section 1. Concrete curbs and gutters shall be installed along both sides of the specified portions of the following named streets in the City of Dover in front of the properties of the owners named in the published resolution of June 12, 1961:

Between Pear Street Alley and the Railroad on William Street

Between Clara Street and Mary Street on Queen Street

Between Dover Street and Water Street on New Street

Section 2. The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of The City of Dover.

SIDEWALK REPORT

The City Engineer presented to City Council a map indicating where sidewalks were lacking in the City. The estimated cost of installing all sidewalks is approximately $209,000. The City Manager and City Engineer will prepare and submit to Council as soon as possible a plan to install sidewalks through the cooperation of property owners. Bids will be obtained so that the best price can be obtained.

SIDEWALK RESOLUTION

On motion of Mr. Thompson, seconded by Mr. Davis, Council by unanimous vote adopted the following resolution:

A RESOLUTION PROVIDING FOR THE INSTALLATION OF SIDEWALKS WITHIN THE CITY OF DOVER UPON APPLICATION FOR BUILDING PERMIT.

WHEREAS, the City Council may pursuant to the Charter of the City of Dover as amended, pave, re-pave or cause to be paved or re-paved streets and sidewalks of the City or any part or portion thereof with such material or materials as it shall determine, and

WHEREAS, the City Council has determined that the construction of buildings on any lands within the City of Dover which abut upon any street or streets or portion of any street or street in said City creates a condition requiring the installation of sidewalks,

NOW, THEREFORE, BE IT RESOLVED by the Council of The City of Dover:

That from and after the passage of this Resolution no building permit shall issue unless such permit is conditioned upon and the plans submitted at the time of the application for the permit contains provision for the laying of sidewalks or the improvement of existing sidewalks of such size and material as is approved by the City Manager of The City of Dover.

URBAN RENEWAL REPORT

Myron U. Lamb, Redevelopment Director reported on the progress of the Dover Green-West Urban Renewal planning.

ANNEXATION

Council discussed the problems of annexing areas adjacent to the City. It was suggested that Council should more actively pursue an annexation policy and that a committee should be appointed to study and make recommendations to that end. On motion of Mr. Thompson, seconded by Mr. Fromm, Mayor Haman was authorized to appoint a committee to study and make recommendations to Council on annexation.

PARKING METER ORDINANCE

City Solicitor Buckson submitted to Council a proposed ordinance authorizing installation of parking meters on S. Governors Avenue between Bank Lane and Water Street. A petition was received from property owners in the area objecting to the proposal. Studies conducted in the area indicated that at present plenty of parking space is available at most hours of the day. Mr. Carroll, seconded by Mr. Holpp, moved that the ordinance be adopted. Following discussion, on motion of Mr. Thompson, seconded by Mr. Hayes, Council tabled the ordinance. Mr. Carroll voted ‘No’.

HARTNETT FENCE

M. A. Hartnett Inc. requested the order of the Fire Marshall to complete installation of a fence around its lumber yard be held in abeyance until July 12, 1961. On motion of Mr. Thompson, seconded by Mr. Turner, Council approved the request.

POWER PLANT AUDIT

The Utility Committee reported that William Manter’s audit of the Construction Fund for the new power plant was about completed but that Mr. Manter was away on vacation. He will be asked to make his report on his return.

CITY MANAGER REPORT

Report of the City Manager for the month of May was accepted as read.

RICHARDSON & ROBBINS

A letter from Richardson & Robbins regarding their building plans will be considered by the Zoning Commission and the Utility Committee.

URBAN RENEWAL AUDIT

City Manager Ward reported that Urban Renewal Funds had been audited by Herman L. Westerman, HHFA Auditor and exceptions noted which were not if conformance with Federal regulations. Federal regulations will be complied with in the future.

SUBDIVISION ORDINANCE

A proposed ordinance providing for subdivision regulation by the Planning Commission will be considered at the next meeting of City Council.

Mr. Fromm remarked on the suggestions made publicly that the proposed master plan for City development and the proposed zoning ordinance be made subject to approval by referendum. Mr. Fromm pointed out that neither subject is limited to a single proposal which could be offered for a simple ‘yes’ or ‘no’ vote of a referendum. Public sentiment is determined by public hearings which are now being held.
