                                                           REGULAR MEETING

February 27, 1961

The regular meeting of City Council was held Monday, February 27, 1961 at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Thompson, Turner and Zartman.

The invocation was said by the Rev. Robert Duke of People’s Church.

MINUTES

Minutes of the meeting of February 13, 1961 were accepted as read and bore the written approval of Mayor Haman.

BUSINESS IN RESIDENTIAL SECTION

Midget Market Grocery Store requested that a property on the N.E. corner of Mary and Bradford Streets, now used as a reducing salon, be rezoned for use as a grocery. The request was duly advertised for hearing this date. No petitions were received for or against the request. On motion of Mr. Hayes, seconded by Mr. Thompson the request was approved. Mr. Zartman disqualified himself from voting because he has an interest in the project.

Louis J. Parker Jr. requested that a property at 42 S. State St. now used as an office building be rezoned for use as a day nursery. The request was duly advertised for hearing this date. No petitions were received for or against the request. On motion of Mr. Davis, seconded by Mr. Hayes, the request was tabled pending inspection of the premises were suitable for use as a day nursery.

URBAN RENEWAL

Myron U. Lamb presented to City Council an offer which had been received from HHFA which amended the original contract for planning advance. The offer, copy of which is attached and made part of these minutes, deleted from Section 3 of Part I of the contract the detailed description and substituted a new detailed description, which was explained to and discussed by City Council.

On motion of Mr. Fromm, seconded by Mr. Thompson, Council by unanimous vote adopted the following Resolution:

RESOLUTION ACCEPTING AN OFFER TO MAKE AN AMENDMENT TO CONTRACT FOR PLANNING ADVANCE NO. DEL. R-2 (A) BY AND BETWEEN THE CITY OF DOVER AND THE UNITED STATES OF AMERICA.

(FIRST AMENDMENT)

WHEREAS, the United States of America (herein called the “Government”) and the City of Dover (herein called the “Local Public Agency”) on May 2, 1960 entered into Contract for Planning Advance No. Del. R-2 (a) which provided for an Advance of Federal funds under Title I of the Housing Act of 1949, as amended, to the Local Public Agency to aid it in the financing of certain surveys and plans in Urban Renewal Project, designated Project No. Del. R-2, and

WHEREAS, the Government has tendered tot he Local Public Agency an Offer to amend said Contract for Planning Advance which Offer is dated January 26, 1961, and

WHEREAS, the Local Public Agency had given due consideration to said Offer,

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Dover, as follows:

Section 1. The Offer of the Government tot he Local Public Agency, dated January 26, 1961, designated “Offer to Amend Contract for Planning Advance,” (said Contract being designated No. Del. R-2(A), effective May 2, 1960), is hereby in all respects accepted.

Section 2. The Local Public Agency agrees to abide by all of the provisions, terms and conditions of said Offer to Amend Contract for Planning Advance.

Section 3. The City Clerk of the Local Public Agency is hereby authorized and directed forthwith to send to the Housing and Home Finance Agency, three certified copies of the proceedings of the Local Public Agency in connection with the adoption of this Resolution, together with three certified copies of this Resolution, and such further documents or proofs in connection with the acceptance of said Offer as may be requested by the Government.

Section 4. This Resolution shall take effect immediately.

Adopted February 27, 1961.

UTILITY COMMITTEE

Councilman Holpp reported on the trip of the Utility Committee to Ohio to tour the plant of B&W where the boilers for the new power plant are being fabricated.

Harvey Colgin of the Kuljian Corporation presented to Council the report on the new power plant as of January 31. The report showed the plant to be approximately 12% completed, and included a revised estimate of cost which exceeded the original estimate by approximately $17,000.

PARKING ORDINANCE

On motion of Mr. Thompson, seconded by Mr. Hayes, Council by unanimous vote passed the following ordinance:

AN ORDINANCE TO PERMIT THE PARKING OF VEHICLES DURING CERTAIN HOURS AND ON CERTAIN PORTIONS OF THE STREETS IN THE CITY OF DOVER.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. From and after the passage and approval of this Ordinance, it shall be unlawful for any person to park any vehicle on the following portions of the streets of the City of Dover during the hours specified:

On Loockerman Street, Governor Avenue between North Street and Reed Street, Bradford Street between Reed Street and Loockerman Street, State Street between Reed Street and The Green, from 1:00 A. M. until 6:00 A.M. daily.

On the side of any street south of Loockerman Street where the house or building numbers are even, from 12:00 midnight Monday until 6:00 A.M. Tuesday.

On the side of any street south of Loockerman Street where the house or building numbers are odd, from 12:00 midnight Tuesday until 6:00 A.M. Wednesday.

On the side of any street south of Loockerman Street where the house or building numbers are odd, from 12:00 midnight Thursday until 6:00 A.M. Friday.

On the side of any street north of Loockerman Street where the house or building numbers are even, from 12:00 midnight Friday until 6:00 A.M. Saturday.

On the outside curb line of The Green from 12:00 midnight Monday until 6:00 A.M. Tuesday.

On the outside curb line of The Green from 12:00 midnight Thursday until 6:00 A.M. Friday.

Section 2. It shall in like manner be unlawful to park a vehicle or permit any vehicle to remain parked on the following streets during any snow fall exceeding one hour in duration:

                                    (a) Water Street

                                    (b) State Street

                                    (c) Governors Avenue

                                    (d) Division Street

                                    (e) Loockerman Street

Section 3. The Police Department of The City of Dover, and any individuals, firms, or corporations acting at the request and on behalf of the said Police Department shall be vested with the authority to remove or tow away any vehicles which during the times and under the conditions set firth in Sections 1 and 2 shall be parked.

Section 4. All vehicles removed or towed away pursuant to this ordinance shall be taken to a storage area selected by the Police Department and shall remain there until such time as a release is obtained from the Police Department.

Section 5. The owner or owners and/or the operator of any vehicle impounded pursuant to this ordinance shall, before vehicle is released pay all expenses incurred by the removal or towing of such vehicle in addition to any fine and costs as hereinafter provided.

Section 6. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar or more than Twenty-five ($25.00) Dollars, and/or upon failure to pay such fine as may be imposed shall be imprisoned not less than one (1) day or more than thirty (30) days, plus costs.

SOLICITOR REPORT

City Solicitor Buckson reported that the suit against the City and the Gas Company was settled out of court and that no decisions had yet been rendered int eh annexation and McClements cases.

KEITH PROPERTY

A letter from Judge Ernest V. Keith dated February 10, 1961 stated that he and his wife had checked the Richardson survey of his property on the Plaza and that they agreed that a recently constructed overhang on their property extends several inches over City property. He also presented a copy of an easement between the City and the Keiths dated May 27, 1938. Recorded in Deed Record Book L, Vol. 15, Page 269, which grants to Keith a perpetual right-of-way for a 12 foot strip of driveway and a five foot strip of sidewalk with necessary approach steps from the existing south curb line of The Plaza to the north line of the Keith property.

AIR BASE EASEMENT

On motion of Mr. Fromm, seconded by Mr. Thompson, Council authorized signing an easement with the Dover Air Base over a portion of the lot on which the Lebanon substation is located in return for a 10x100' easement from the Air Base to land west of the lot. The easements are for terms of 25 years and will provide clearance for an exit from Air Base Housing.

WATER TANK

On motion of Mr. Zartman, seconded by Mr. Holpp, Council authorized employment of J. K. Stoltzfus to clean and paint the Division Street water tank at a cost of $2550, and to make needed repairs at additional unit prices quoted.

AIR CONDITION AND HEAT

On motion of Mr. Thompson, seconded by Mr. Hayes, Council authorized the City Manager to obtain bids on air conditioning and heating in City Hall.

MEDALLIONS

City Manager Ward reported that prices had been obtained from a Rochester, New York firm for making medallions containing the City seal. Purchase of the items has previously been authorized by Council.

MISCELLANEOUS

The City Manager was requested to obtain cost estimates for reconstructing street light circuits on various approaches to the City.

Council discussed the need for completing the paving of Forest Street, urged action by the State Highway Department, and requested the City Solicitor to advise the Council on what action the City could take to get the job completed.

Mayor Haman reported he had received replies from Senator Williams and Congressman McDowell to his letter asking their assistance on the construction of a new Dover Post Office.

HOUSING CODE ORDINANCE

Council considered and discussed the Housing Code presented by the committee of Council designated to prepare the same.

On motion of Mr. Zartman, seconded by Mr. Davis, Council by unanimous vote adopted the following Housing Code ordinance:

WHEREAS, it is within the power of the Council of the City of Dover to adopt measures necessary to promote the health, safety and welfare of the residents of the City of Dover, and

WHEREAS, a Housing Code is deemed in the best interest of the City of Dover and in the best interest of the residents and property owners of said City,

THEREFORE, BE IT ORDAINED by the Mayor and Council of The City of Dover in Council Met:

That the following be adopted in its entirely as the Housing Code of The City of Dover.
