                                                           REGULAR MEETING

October 24, 1960

The regular meeting of City Council was held Monday, October 24, 1960 at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Thompson, Turner and Zartman.

The invocation was said by the Rev. Mr. Robinson of Wesley M. E. Church.

MINUTES

Minutes of the meeting of October 10, 1960 were accepted as read and bore the written approval of Mayor Haman.

UNION BOILER

Mr. Ward reported that the Union Boiler had been repaired and tested and should be back on the line Wednesday of this week. Additional purchased power during the repairs would have been obtained from DP & L under the terms of the existing contract, but was not required. International Latex Corporation furnished the City with up to 22,000# of steam and this, with the output of the Keeler Boiler enabled the City to operate the 2500 and 1250 turbines. Scale formations on the boiler tubes are being analyzed so that water treatment can be modified to prevent future formations of scale.

LIEBMAN AWNING

Building Inspector Jack Roe reported that Leibman & Company requested permission to erect an aluminum awning across the front of their business at 143 S. Governors Avenue. Plans for its erection met City engineering approval. On motion of Mr. Thompson, seconded by Mr. Turner, the request was approved. Mr. Fromm voted ‘No.’

AMBULANCE AGREEMENT

City Solicitor Buckson presented a prepared agreement covering operation of the City-owned ambulance by William Torbert during a 90-day trial period. On motion of Mr. Thompson, seconded by Mr. Hayes, Council authorized signing the agreement.

ODD FELLOWS HALL HEARING

Home Comfort Lodge #4464, Odd Fellows of America, were duly notified that a hearing would be held at 8 P.M. this date on the order of Building Inspector Jack T. Roe to repair or demolish their building at 423 W. Division Street. Prudence Lodge No. 6, F & AM, an interested party, was also notified. Mayor Haman declared the hearing opened. Building Inspector Roe read the particulars of the condition of the building set forth in the notice dated September 2, 1960 giving the owners 30 days to demolish the building, or provide plans and specifications for its repairs. No action has yet been taken by the owners. Mr. Harry Blackson spoke for Home Comfort Lodge #4464, and Mr. John L. Parker, spoke for Prudence Lodge No. 6. They agreed with the report of the Building Inspector and stated their intention to demolish the building. Home Comfort Lodge #4464 was in the process of transferring the deed to the property to Prudence Lodge No. 6 and Mr. Harold Schmittinger is the attorney retained for the purpose. Time will be required to complete the transaction because ownership of the property is recorded in the names of individuals who were Trustees of the Home Comfort Lodge in 1902. An extension of time was requested before demolishing the building was begun to permit legal transfer of the deed, and permission was also requested to hold lodge meetings in the building during the period of extension. After transfer of the deed Prudence Lodge No. 6 will cause the building to be demolished, and plan to erect a new building on the site. On motion of Mr. Turner, seconded by Mr. Thompson, Council granted a 60 day extension of time before the building is demolished, and will permit lodge meetings to be held on the first floor, only, of the building.

ORDINANCE ALDERMAN’S COURT

On motion of Mr. Zartman, seconded by Mr. Davis, Council by unanimous vote passed the following ordinance:

AN ORDINANCE RELATING TO CONTEMPT OF THE ALDERMAN’S COURT AND PROVIDING PENALTIES THEREFOR.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. From and after the passage and approval of this ordinance, any conduct which interrupts or interferes with any judicial proceeding before the Alderman’s Court, shall be unlawful. Any person or persons convicted of such an offense shall be subject to a fine of not more then Ten ($10.00) Dollars and/or imprisonment for not more than ten (10) days for each offense.

Passed October 24, 1960.

On motion of Mr. Fromm, seconded by Mr. Davis, Council directed that the Alderman be informed of Council’s concern that the court itself should be conducted with dignity and that the above ordinance be used with discretion.

HOLY CROSS DRIVEWAY

Mr. Zadoc Pool outlined to City Council the plan of Holy Cross R. C. Church to open a driveway from the Church and School property to Sackarackin Avenue. The driveway would provide a secondary one-way exit for school busses and other vehicles, a walkway for school children, and an emergency entrance in case of fire or other disaster. A petition from property owners and residents of Sackarackin Avenue objected to such use of the driveway as a safety hazard and a zoning violation. On motion of Mr. Zartman, seconded by Mr. Fromm, Council directed that Holy Cross Church be requested not to install the driveway because it would be a safety hazard and would conflict with residential land use of the neighborhood.

AUDIT

William Manter, CPA, appeared before City Council to answer questions is the members relating to the recently completed annual audit for the fiscal year ending June 30, 1960. Council accepted the report.

FIRE MARSHAL CONVENTION

On motion of Mr. Carroll, seconded by Mr. Zartman, Council authorized Fire Marshal Jack Roe to attend the convention of the Fire Marshals’ Association of North America, November 14, 15, and 16, 1960, at Columbus, Ohio, and the expenditure of up to $150 for the purpose.

URBAN RENEWAL REPORT

Councilman Fromm explained to Council that the Phase I Report, prepared by Raymond & May, on the Dover Green West Urban Renewal Project had been forwarded to the Urban Renewal Agency. The report had been outlined in detail to Councilmen at a Planning Commission meeting, but had not been formerly approved at a meeting of Council. He thought this action should be taken. On motion of Mr. Fromm, seconded by Mr. Turner, Council approved the Phase I Report of the Dover Green West Urban Renewal Project and approved its transmittal to the HHFA.

POWER PLANT REPORT

City Manager Ward reported to City Council on progress in the construction of the new power plant. Report of test well borings have been received and available water supply appears adequate, contracts have been awarded for air compressors, pumps, water tanks, turbine room crane and a self-supporting steel stack. Commitments made to date for services and equipment amount to approximately $4,500,000. Harvey Colgin of the Kuljian Corporation stated that construction was on schedule.

STORM SEWER HAZARD

Councilman Thompson reported to Council that a merchant on West Lockerman Street pointed out to him a catch basin opening which was so large is presented a safety hazard, especially to children. He recommended that the State Highway Department, under whose jurisdiction it was installed, should be asked to correct the condition by the installation of boars, or some other means. On motion of Mr. Thompson, seconded by Mr. Davis, the City Manager was directed to write the State Highway Department and ask them to make the storm sewer opening less hazardous.
