                                                           REGULAR MEETING

September 12, 1960

The regular meeting of City Council was held Monday, September 12, 1960 at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Fromm, Hayes, Holpp, Thompson, Turner and Zartman.

MINUTES

Minutes of the meeting of August 22, 1960 were accepted as read and bore the written approval of Mayor Haman.

REPORTS

Report of Alderman Dempsey was accepted as read. A check in the amount of $358.50 was remitted to the City.

Report of the Acting Alderman Shockley was accepted as read. A check in the amount of $379.70 was remitted to the City.

Report of Magistrate Knotts for April, May, June and July were accepted as read. Checks in the amounts of $5445, $535 and $258 had been remitted to the City.

Report of the Chief of Police was accepted as read.

Report of General Fund Cash Receipts for August was accepted as read.

Report of General Fund Budget Expenditures for July was accepted as read.

Report of Electric Revenue Fund receipts and expenditures for August was accepted as read. Report of Electric Improvement Fund receipts and expenditures for August was accepted as read.

Report of the City Manager for August was accepted as read.

DAYLIGHT SAVING TIME

Letters were received from the Dover Chamber of Commerce, Dover business men, Radio Station WDOV, the Diamond State Telephone Company and the Farmers Bank requesting the extension of daylight saving time until the last Sunday in October so that Dover’s time would conform with that of most of the eastern part of the United States. On motion of Mr. Hayes, seconded by Mr. Turner, Council approved extension of daylight saving time for the City of Dover until October 30, 1960.

QUEEN STREET ORDINANCE

On motion of Rm. Zartman, seconded by Mr. Hayes, Council by unanimous vote passed the following ordinance;

AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON A PORTION OF SOUTH QUEEN STREET NEW LOOCKERMAN STREET.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. From and after the passage and approval of this Ordinance, it shall be unlawful for any person to park any vehicle on the east side of South Queen Street within fifty (50) feet from the intersection of said South Queen Street with the north side of Loockerman Street, said area and parking regulation pertaining thereto to be designated by appropriate signs or markings.

Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine as may be imposed shall be imprisoned not more than five (5) days.

SOLICITOR REPORT

City Solicitor Buckson reported on the status of the suit to set aside the results of a referendum which annexed a section southwest of Dover to the City.

Mr. Buckson also reported that the City and Patrolman Rasmussen were being sued by James McClements for damage or injury he suffered when he was arrested. He will determine whether the City’s liability is covered by insurance.

Mr. Buckson reported he had replied to a letter from Charles Baker regarding the City’s electric line easement on Lebanon Road and that he had prepared an agreement for the Dover Pony League under which they would release title to ball park lighting should they default in repayment of a loan guaranteed by the City.

PARKING AUTHORITY

On motion of Rm. Thompson, seconded by Mr. Turner, Council authorized payment tot eh Parking Authority of $1000 for a parcel of land purchased by the Authority and included in the City Hall parking lot and payment of $2660 for 133 parking meters installed on the parking lot, and execution of an agreement between the City and the Parking Authority canceling the Authority’s lease the City Hall parking lot and releasing the Authority from any obligation for payment of monies borrowed in accordance with an agreement between the two executives between the two under date of February, 1956.

MANTER AGREEMENT

On motion of Mr. Turner, seconded by Mr. Zartman, Council authorized execution of an agreement between the City and William Manter covering a study of cost accounting and other administrative requirements at a cost not to exceed $2000.

SAFETY AWARD

Vice Mayor Holpp and Chief Turner displayed safety awards received today from the National Safety Council because of no traffic deaths during 1959 and pedestrian safety. Mayor Haman expressed the pride of the Council and the citizens of Dover in the awards.

POWER PLANT ROADWAY

Council Holpp and Harvey Colgin of Kuljian Corporation explained to Council the need for a roadway into the new power plant site and the negotiations held with R. Harry Wilson to acquire the right-of-way. Mr. Wilson will sell the City a 25' right-of-way approximately 1100' ling for the sum of $3150. Mr. Colgin explained that Mr. Wilson was reluctant to sell a wider strip. Councilmen felt that a 50' right-of-way would be more desirable and that an additional entrance by extension of Ann Street from west of the railroad should be provided. On motion of Mr. Zartman, seconded by Mr. Hayes, Council authorized purchase of the 25' right-of-way from R. Harry Wilson at a price of $3150.

ALDERMAN’S COURT

Chief Turner informed Council that the Police Station was being altered to provide for an Alderman’s Court which would make handling and processing of prisoners more convenient and safe. On motion of Mr. Fromm, seconded by Mr. Turner, Council approved establishing an Alderman’s Court in the Police Station.

SHERWOOD #3 STORM DRAINAGE

Councilman Thompson stated that the heavy rains accompanying today’s storm emphasized the meed for storm drainage in the Sherwood #3 development. He stated that the storm sewer had been approved and wondered why it had not yet been installed. He stated that there should be no particular difficulty getting a storm sewer easement across the Konschak land, but that Mr. Konschak desired a fence erected between Sherwood #3 and his land. It was explained that the storm sewer was included in this year’s budget. Mr. Joseph outlined an alternate route for the storm sewer across an easement provided by the Sherwood and then south under the Westview Terrace sidewalk to Wyoming Avenue thus avoiding the Konschak land. On motion of Mr. Zartman, seconded by Mr. Hayes, Council authorized issuing bids for the project and awarding the contract to the low bidder.

URBAN RENEWAL ADMINISTRATOR

Mr. Fromm reported that his committee had selected a director for the urban renewal project but that their selectee reported he was unable to accept the appointment. The committee must therefore make a new selection.

FARMERS BANK WATER

A letter from the Farmers Bank informed City Council that plans were being prepared for construction of an addition which would double the requirement of its present air conditioning capacity. The letter asked whether Dover had any regulation which would prohibit increasing the pumping capacity of the well from which water is now drawn for air conditioning. The well taps the strata from which the City draws its water and further drilling of wells is prohibited by City ordinance.

Council is greatly concerned about conservation of the City’s water supply and considers the one-time use of great quantities of water for air conditioning as a nonessential use which could deplete the supply of water required for essential public requirements. Council felt that all necessary steps should be taken to protect the public water supply and proceeded to consider and act upon the following ordinance.

AN AMENDMENT TO THE ORDINANCE REGULATING THE DRILLING OF WELLS WITHIN THE CITY OF DOVER AND PROVIDING PENALTIES FOR VIOLATION THEREOF.

Be It Ordained By The Council Of The City Of Dover In Council Met:

That the above entitled Ordinance passed August 11, 1952 be and is hereby amended by adding two new sections designated as Section 4 and 5 to-wit:

Section 4. No person, firm or corporation shall increase the present capacity of any pumping facilities used in conjunction with any well more than 150 feet deep below the surface of te ground within the limits of the City of Dover unless the express permission of the Council of the City of Dover by Resolution properly adopted shall have been obtained for the increasing of the capacity of such pumping facilities.

Section 5. Any person or the members of any firm or the officers of nay corporation who shall be convicted of violating the provisions of Section 4 of this Ordinance shall be penalized as provided in Section 2 hereof and Section 3 hereof insofar as such sections are applicable.
