SPECIAL MEETING

January 27, 1960

The special meeting of City Council was held at City Hall Wednesday, January 27, 1960, at 5:00 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Holpp, Mundy, Turner and Zartman.

ANNEXATION POLICY ORDINANCE

Council discussed a resolution prepared for adoption outlining the policy of the City of Dover relating to areas annexed, to be annexed, of presently within the City and previously unassessed. Robert Reed, a property owner in an area being considered for annexation questioned council on the proposal.

On motion of Mr. Carroll, seconded by Mr. Zartman, Council by unanimous vote adopted the following resolution:

POLICY OF THE CITY OF DOVER RELATING TO AREA ANNEXED, TO BE ANNEXED, AND AREAS WITHIN THE CITY LIMITS PREVIOUSLY UNASSESSED.

Be It Resolved By The Council Of The City Of Dover In Council Met:

1. All lands and improvements thereon in areas annexed, t be annexed or areas within the City limits previously unassessed are to be assessed or reassessed on the same basis as lands and improvements thereon now within the City limits.

2. All taxes assessed shall be due and collectible beginning in the tax year succeeding the year in which the annexation and assessment of record are completed.

3. Garbage and trash collection, police protection, fire protection and all other services rendered by the City of Dover to its residents shall be provided for the areas annexed as soon as such services can be made available. Such services as are now being rendered to the residents of the City of Dover and are available, shall commence upon completion of annexation.

4. Areas annexed shall become a part of the election district of the City of Dover which the areas annexed adjoins.

5. Areas annexed to be zoned by and become subject to such zoning as enacted by the Zoning authority of the City of Dover and City Council.

6. Areas annexed shall become a part of and included in the City master plan and shall be laid out in streets, alleys, etc. according to plot plan approved by Planning Commission and City Council.

7. Utility rates in annexed areas shall be the same as prevailing City rates.

8. Street lights shall be installed in annexed areas by the City of Dover as and when funds are available and of such design as approved of the City of Dover and consistent with public welfare and safety.

9. The City may require installation of streets, curbs and gutters in annexed areas after a public hearing at a time and place designated by the City at which a majority of the owners to pay the total cost of curb and do not object, said property owners to pay the total cost of curb and gutter, now approximately $2.00 per front foot on each side of street. In addition, said property owner shall pay one-half of the cost of street filling, paving and drainage now established at $5.50 per front foot on each side of street. Owners of corner lots shall be charged for paving for both streets on which said lots front less a credit be charged for paving for both streets on which said lots front less a credit of 50% of the cost of paving the side street along said lot, said frontage to be determined by Post Office address.

Competitive bids for the construction referred to in this paragraph are to be secured and awarded by the City under such terms and conditions as established by the City and the actual construction shall be supervised by the City.

10. Sewer and water lines in annexed area will be installed when 50% more of the property owners concerned request such installation. Charges would be based upon 8 inch sewer lines (Now approximately $2.80 per front foot on each side of the street) and 6 inch water line (now approximately $1.85 per front foot on each side of the street). Fire hydrants and installation thereof shall be at the expense of the City.

11. In annexed areas the City of Dover will continue its present policy concerning street paving where a street had been dedicated and paved, to wit: City will maintain, improve, re-pave and acquire additional right of way if needed without charge to the property owner, provided, however, property owners will bear the cost for curbs and gutters prior to repaving where curbs and gutters do not exist. The estimated cost at present for installation of the following City facilities for each side of the street per front foot are as follows:

                        Curb and gutter            $2.00 

                        Streets                                     5.50

                        Sanitary Sewer, 8-inch           2.80

                        Water Lines, 6-inch                1.85

In the event the City of Dover should deem it advisable to permit payment of the cost to the property owner of the above mentioned installation over a period of 20 years with interest added, the cost per front foot for each side of the street per year would be approximately as follows:

                        Curb and gutter            $.15

                        Streets                                     .41

                        Sanitary Sewers                      .21

                        Water Lines                            .14

12. The tapping of water and sewer lines in annexed areas will be made by the City upon the request of the property owner at the expense of the property owner based upon the cost of materials and labor to the City.

13. Any improvements in undeveloped areas annexed or within the City of Dover and previously unassessed shall be at the expense of the developer subject tot he terms, conditions and specifications of the City.

14. Schools, churches, State owned lands and lands of the United Stated Government within the City of Dover and areas hereafter annexed shall be excluded from the provision of this Resolution pertaining to property taxes.

15. Charges assessed to property owners pursuant to this Resolution shall be established by the Utility Committee subject to the approval of City Council and thereafter filed with the City Clerk and published at least once in a local newspaper to be effective as of the date set forth in such notice. Such charges as are established as aforesaid shall become a lien on the property concerned and shall be collectible in the same manner as provided for the collection of taxes due the City of Dover. Such charges are to be entered in the tax records of the City of Dover and such entry shall constitute notice to the property owner of the charge against the property. Each year charges are to be reviewed and revised, if necessary, prior to the preparation of the annual budget.
