REGULAR MEETING

November 9, 1959

The regular meeting of City Council was held Monday, November 9, 1959, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Hayes, holpp, Mundy, Turner and Zartman.

The invocation was said by the Rev. Robert L. McKim of the Presbyterian Church.

MINUTES

Minutes of the meeting of October 19, 1959 were accepted as read and bore the written approval of Mayor Haman.

REPORTS

Report of Alderman Dempsey was accepted as read. Checks in the amounts of $1120.50, 25.50, 29.50, 69.00 and 236.00 were remitted to the City. Report of Acting Alderman Shockley was accepted as read. A check in the amount of $89.50 was remitted to the City.

Report of the Chief of Police was accepted as read.

October Cash Receipts report was accepted as read.

September Budget Report was accepted as read.

Report of the Fire Marshal was accepted as read.

FIRE CHIEFS

A letter from the Robbins Hose Company reported the following nominations for Chief Engineers for the year 1960:

                        Chief Engineer                       George D. hill Jr.

                        First Assistant             Paul N. Kertiles

                        Second Assistant                    Jack T. Roe

There being no contest, an election will not be required.

SISTER CITY

City Manger Ward read a letter received from Japan stating that a city in that country was interested in establishing relations with the City of Dover and requesting general information about out City. Mr. Ward will reply and state that the request is being referred to a committee known as the “Overseas Neighbors Committee” and will send a copy of the resolution establishing the committee and explaining its purpose.

CITY MANGER REPORT

Report of the City Manager was accepted as read.

EAST DOVER SEWER LINES

The Dover Special School District constructed a sewer line from the City limits to the East Dover Elementary School several years ago. Dover’s policy on sewer lines constructed outside City limits does not permit recapture of costs. A letter from the Secretary of the School Board asked Council to reconsider the policy to permit recapture of costs from taps made by others. The utility Committee recommended that the policy remain as it is. On motion of Mr. Davis, seconded by M. Turner, the recommendation of the Utility Committee was approved.

FREAR WATER TAP

The Frear Machine Company owns a property outside City limits which it leases to Air Mod Corporation and which is supplied with City water. The Company wishes to install a sprinkler system for fire protection and requests permission to make a 4" water tap to supply the system.. Councilman Zartman pointed out that although Dover has recently adopted a policy prohibiting extension of water lines outside City limits until the user is annexed to the City, Dover has agreements with certain developers under which they are to recapture their costs of installing water line from charges made to others tapping the lines. Mr. Zartman asked whether the policy of Dover is entirely legal in view of the existing agreements. The request of the Frear Machine Company was tabled until the City Solicitor can review the matter.

PIPPIN TRACT, ETC.

Mr. Ward presented a print of a tentative plot plan of street and alley layout of the area between New Burton Road and Governors Avenue, Wyoming Avenue and Puncheon Run. The plan can be used as a basis for estimating cost of utilities, streets, etc. The Utility Committee recommended approval. On motion of Mr. Davis, seconded by Mr. Carroll, Council approved the layout of the tentative plot plan.

ANNEXATION POLICY

Council discussed the development of a policy covering the extension of utilities, streets, etc. in newly annexed areas. The matter was referred tot he Utility Committee for study and recommendation. Walter Ellis presented a petition to Council requesting permission of Council to tie his development south of Wyoming Avenue into city utilities. He stated that he and his associates favor annexation and would agree to any policy established by the City covering charges for City utilities and improvements and would further be willing to retain ownership of all property within the development until they could vote in an annexation referendum. City Solicitor Buckson said that a formal agreement could not be made until the policy of the City is established.

On the question of a referendum, Mr. Buckson gave his opinion that the ballots could contain several questions making it possible to decide at the same election the question of annexing a certain area or a smaller section within the same area.

POLICE CAR

Bids have been received on the purchase of a new police car with the trade-in of an older car. Low net bid was Bolan Motors at a price of $1342. On motion of Mr. Hayes, seconded by Mr. Mundy, Council authorized purchase of a police car from the low bidder, Bolan Motors.
