REGULAR MEETING
September 14, 1959
The regular meeting of City Council was held Monday, September 14, 1959, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Mundy, Turner and Zartman.
MINUTES
Minutes of the meeting of August 24 were accepted with the Resolution of Curb Hearings corrected to read curbs and gutters and the portion of Clara Street corrected to read between Governors Avenue and Queen Street. The minutes bore the written approval of Mayor Haman.
REPORTS
Report of City Alderman was accepted as read. Checks in the amounts of $100.00 and $925.80 were remitted to the City. Report of the Acting Alderman was accepted as read. Checks in the amounts of $36.00 and $737.60 were remitted to the City.
Report of the Chief of Police was accepted as read.
Report of Cash Receipts for August was accepted as read.
Report of Budget Expenditures for July was accepted as read.
CLIFTON BARBER SHOP
J. Ellis Clifton, 22 Ross St., requested permission to open a barber shop at that address, a residential section. The request was duly advertised for hearings on this date. A written petition was received from a majority of property owners in the block requesting that the petition be denied. As required by ordinance when a majority of property owners oppose such a request, the permit was denied.
DOVER APPLIANCE SHOP
Dover Appliance Shop requested the use of two parking spaces in front of its store on Loockerman Street September 17, 18 and 19 to park a trailer in which appliances would be exhibited. On motion of Mr. Fromm, seconded by Mr. Davis, the request was granted.
FIRE MARSHALL REPORT
Jack T. Roe submitted his initial written report as Fire Marshall. His report included inspection of premises for which business licenses have been withheld. The business license of John’s Package Store, S. New Street has been withheld pending an electrical inspection. The business license of Harman Oil Company has been withheld pending the elimination of numerous fire hazard which exist at the bulk plant of that company at Division and West Streets. Mr. Roe has notified Mr. Harman by registered mail of the conditions which must be corrected before a license will be issued. He has attempted to speak to Mr. Harman personally but has been unable to do so. Inspection of the premises was made in the company of the plant manager who was furnished a lost of deficiencies to be corrected.
Mr. Roe requested instruction from City Council on how to proceed in the case of the Harman Oil Company. On motion of Mr. Fromm, seconded by Mr. Hayes, The Fire Marshall was ordered to proceed directly to enforce the fire regulations in the case of the Harman Oil Company by taking such legal action as is required by City ordinance. The Fire Marshall will give the Harman Oil Company verbal notice of this order and if corrections are not made within five days will proceed with legal action.
The Fire Marshall will meet with the Committee of Council to discuss amendments to the Fire Prevention Code and recommend changes to City Council. The Fire Marshall was authorized to join the N.F.P.A. to City Council.
CURB HEARINGS
The Council opened the hearing to consider the installation of concrete curbs and gutters on both sides of the streets named and in front of properties of persons named in a resolution adopted August 24, 1959 and of assessing the cost thereof against the said owners.
Between Fulton Street and Mary Street on Queen Street.
No objections were received. Several property owners inquired about the approximate cost and the length of time given for payment. The approximate cost is $1.90 per lineal foot and the minimum time of payment provided by City Charter is one year.
Between New Street and West Street on Fulton Street.
No objections were received.
Between New Street and West Street on Cecil Street.
No objections were received. M. A. Hartnett Inc. requested permission to depress the curb from West Street to the alley on Cecil Street and to install the curb according to City specifications at its own expense. The City Engineer will consult with M. A. Hartnett Inc. to work out details of the curb depression and the specifications of curb to be installed.
Between New Street and Pear Street on Mary Street.
Mrs. Elizabeth T. Clark and Mrs. Margaret D. Tomlinson, joint owners of property on the north side of Mary Street between Queen Street and Kirkwood Street objected tot he installation of curbs and gutters as unnecessary to the improvement of their property.
Between Governors Avenue and Queen on Clara Street
Edward P. Wais believed the City required more right of way on Clara Street and objected to paying the cost of curb and gutter unless it was offset by the cost of right of way.
Stanley Petty, representing Holy Cross Church, requested some form of relief from the cost of curb and gutter, perhaps an arrangement for long-term payment.
Between the Boulevard ad Walker Road on Bradford Street.
No objections were received.
Council discussed the results of the hearings and because plans and specifications had not yet been prepared on the streets concerned decided to defer action on those streets from which objections were received.
On motion of Mr. Zartman, seconded by Mr. Turner, Council by unanimous vote adopted the following resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CURBS AND GUTTERS ON THE SPECIFIED PORTIONS OF THE FOLLOWING NAMED STREETS WITHIN THE CITY OF DOVER AND FIXING THE COST THEREOF TO BE BORNE BY ADJOINING OWNERS.
1. Between Fulton Street and Mary Street on Queen Street
2. Between New Street and West Street on Cecil Street
3. Between New Street and West Street on Fulton Street
4. Between the Boulevard and Walker Road on Bradford Street
WHEREAS the Council of The City of Dover has held a meeting on Monday, September 14, 1959, at 8:00 P.M. Eastern Daylight Saving Time at the City Hall, in accordance with a resolution adopted August 24, 1959, and duly published in accordance with the Charter; and
WHEREAS all interested property owners and other residents of the City have been heard, and a written objection signed by a majority of the property owners affected has not been presented;
Now Therefore Be it Resolved By The City Of Dover:
Section 1. Concrete curbs and gutters shall be installed along both sides of specified portions of the following named streets in the City of Dover in front of the properties of the owners named in the published resolution of August 24, 1959:
Between Fulton Street and Mary Street on Queen Street
Between New Street and West Street on Cecil Street
Between New Street and West Street on Fulton Street
Between the Boulevard and Walker Road on Bradford Street
Section 2. The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of The City of Dover.

CITY MANAGER’S REPORT
Report of the City Manager for August was accepted as read.
STREET PROJECT NO. 8
Plans and specifications have been prepared and bids received on street project No. 8 which includes installation of curbs and gutters and paving on the following named streets:
Kirkwood Street, between Division and Mary Streets
Queen Street, between Division and Mary Streets
Fulton Street, between New and West Streets
Cecil Street, between New and West Streets
Bids were obtained on unit prices based on estimated quantities from Edgell Construction Co., George & Lynch, Standard Bitulithic and Burger Construction Co. Low bidder was Edgell Construction Co. at a total price of $49,344.22. On motion of Mr. Davis, seconded by Mr. Carroll, Council awarded the contract to the low bidder, Edgell Construction Co., with the provisions that Bradford Street, between the Boulevard and Walker Road be included in the project at the same unit prices, and that the completion date be November 15, 1959, or the equivalent number of working days, under penalty of liquidated damages provided in the State Highway Specifications, which are part of the bid and contract.
DENTAL OFFICE
Dr. Jessie R. Williamson requested permission to open a dental office on the Bernard Paskins lot on Gibb’s Drive, a residential section. On motion of Mr. Hayes, seconded by Mr. Turner, Council directed that the request be advertised for hearing at its meeting to be held September 28, 1959.
DAYLIGHT SAVING TIME
On motion of Mr. Holpp, seconded by Mr. Hayes, Council directed that daylight saving time be extended for the City of Dover until the last Sunday in October. Mr. Zartman voted No.
