REGULAR MEETING
May 11, 1959
The regular meeting of City Council was held Monday, May 11, 1959, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Mundy and Turner.
The invocation was said by the Rev. Best of the Lutheran Church.
MINUTES
Minutes of the meeting of April 27 was accepted as read and bore the written approval of Mayor Haman.
REPORTS
Report of the Chief of Police for April was accepted as read.
Report of the Alderman for April was accepted as read. A check in the amount of $1397.30 was remitted to the City. Report of the Acting Alderman was accepted as read. A check in the amount of $119.75 was remitted to the City.
Report of Budget expenditures for March was accepted as read.
Report of Cash Receipts for April was accepted as read.
CHICKEN FESTIVAL
Turner Hastings of the Chicken Festival decorating committee appeared before Council to request permission to decorate the streets along the parade route by attaching brackets and banners to street light poles and stringing pennants between the poles. The decorations will be erected between June 1 and June 12. On motion of Mr. Mundy, seconded by Mr. Davis, the request was approved.
City Manager Ward reported that Robert Reed, Chairman of the Chicken Festival, requested Dover to provide free electricity for the Festival cooking contests. On motion of Mr. Holpp, seconded by Mr. Hayes, the request was approved.
The committee of Council appointed to consider a float and reviewing stand for the Festival parade requested further instructions. In view of the number of important guests expected to be present, Council thought that the idea of a float should be abandoned and that the City should provide an adequate reviewing stand. On motion of Mr. Fromm, seconded by Mr. Hayes, Council authorized the committee of Council to work with the parade officials and to provide a suitable reviewing stand properly decorated.
BAKER REPORT
Thomas Baker reported on the condemnation of substandard housing, on the removal of fire hazards and on the status of Wesley College improvements. His future reports will list the number of houses posted, the number on which action was taken, the number of exceptions made and additional postings each month.
On motion of Mr. Davis, seconded by Mr. Fromm, Council by unanimous vote adopted the following ordinance:
AN ORDINANCE PROHIBITING THE USE OF FUEL BURNING PORTABLE HEATERS AND STOVES AND PROVIDING PENALTIES FOR THE USE THEREOF.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. As used in this Ordinance the phrase “Portable Heaters or Stoves” is defined as self-contained, self-supporting nonflue-connected heating apparatus, designed to be carried from one location to another.
Section 2. It shall be unlawful for any person, firm or corporation to use or permit to be used any portable fuel burning heater or stove within the corporate limits of te City of Dover after the 1st day of October, 1959.
Section 3. Whoever shall violate the provisions of Section 2 above shall for the first offense be fined not more than $25.00 and/or be imprisoned for not more than 10 days, or both, and for each subsequent offense shall be fined not more than $100.00, and/or be imprisoned for not more than 30 days, or both.
Passed May 11, 1959.
On motion of Mr. Fromm, seconded by Mr. Davis, Council directed that the provisions of the above ordinance by advertised in local newspapers and sent to local residents through the mail, and that the Building Inspector and Fire Marshall seek to educate the public on the intent of the ordinance by personal visits and instructions.
CITY MANAGER REPORT
Report of the City Manager was accepted as read.
LINCOLN PARK
Maurice Hartnett, Attorney, appeared before Council on behalf of Dover builders objecting to Dover’s policy that would require the developer of property owner to pay 2/3 of the cost of paving Lincoln Street within the Lincoln Park Development. He claimed that Lincoln Street had long been a dedicated street and that Council had implied to the developer that no charge would be made for improving it and that a hardship would be imposed on the developer by requiring him to share the cost. Council stated that its intent had been, and is, to assess to property owners or developers the stated portion of the cost of improving and paving newly opened streets, no matter when dedicated. The matter was referred to the City Solicitor.
UTILITY COMMITTEE
Mr. Ward distributed to members of Council exhibit 13 of the Albright & Friel report on its study of Dover’s sewer system and sewage disposal plant. The Utility Committee has not yet completed its study of the report.
WILLEY TRACT WATER
Council was requested to permit the extension of water to the Willey development and to State Highway Department facilities between the dual highway and the Bay Road according to City specifications and at the expense of the developers. The request was fully discussed. On motion of Mr. Fromm, seconded by Mr. Hayes, Council denied the request until the area is annexed tot he City.
KEITH BUILDING PERMIT
Keith Realty requested from Dover a building permit to erect low cost, row type housing on the corner of Fulton & Kirkwood Streets. The conformity of the design and architecture to City requirements is questioned. The request was referred to the Planning Commission for study and recommendation.
WAGES & HOURS
Mr. Ward reported that the committee on Wages & Hours had met and will meet again before submitting a recommendation to Council.
PARKS
A letter from the Delaware Veterans of World War II urged Council to consider the formation of a Park Planning Commission. Council directed that the letter be acknowledged.
MOSQUITO CONTROL
Mr. Ward reported he had received a letter from Charles D. murphy of the State Highway Department requesting permission to spray the marsh areas of Dover for mosquito control between May 15 and October 15. He has replied granting permission.
PARKING SPACES
Ferguson & Hayes requested that two parking spaces be set aside at the funeral parlor on S. State Street for loading hearses.
Kent County Levy Court requested that two parking spaces be set aside at the Court House for loading and unloading prisoners by the Sheriff and his deputy.
The requests were referred to the Chief of Police for study.
ORDINANCE
Chief of Police Turner requested that parking be prohibited for a distance of 40 feet from the intersection at North & New Streets. On motion of Mr. Fromm, seconded by Mr. Turner, Coucnil directed the Solicitor to prepare an ordinance prohibiting parking a distance of 40 feet from all four corners at North & New Streets.
