SPECIAL MEETING
March 12, 1959
A special meeting of City Council was held Thursday, March 12, 1959 with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Mundy, Turner and Zartman.
LEGISLATION
Council discussed bills to be introduced into the State Legislature to provide for annexation procedure and additional borrowing capacity for the City of Dover.
Methods of annexation considered were direct annexation by action of the Legislature, annexation by petition and annexation by referendum. Direct annexation by the Legislature apparently is prohibited by an existing statute which provides that the Legislature increase or extend the limits of no municipality until a referendum had been held approving the action. Members of the Legislation have indicated they will not approve legislation providing for annexation by petition. All that is left is to provide for extension of the City limits by referendum. Council decided that a bill should be prepared providing for annexation by referendum and also by resolution of Council at the time of the election. The bill will be prepared by City Solicitor Buckson.
Council also discussed and approved the preparation of bills providing for borrowing funds by issuing revenue bonds for City activities which are self-sustaining or profit producing, by action of City Council, and providing for borrowing by issuing bonds for which the general faith and credit of the City is pledged limited in total amount by a percentage of property assessment within the City and approved by referendum of the voters. These bills, prepared by City Solicitor Buckson, will be submitted to Mr. Lester Washburn, New York bond attorney, for study and approval before they are introduced into the Legislature. On motion of Mr. Holpp, seconded by Mr. Davis, Council directed that City Solicitor Buckson and City Treasurer Neylan visit Mr. Washburn in New York to discuss the bills.
SEWAGE PLANT AND SEWER SYSTEM
Mr. Ward reported that Dr. Kaplovsky and Mr. Harmeson of the State Board of Health desired to meet with City Council to discuss a study recently completed of the sewage facilities of the City of Dover and certain recommendations which they make. The time of the discussion will be at the meeting of City Council on April 27.
