REGULAR MEETING
August 11, 1958
The regular meeting of City Council was held Monday, August 11, 1958, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Mundy, Turner and Zartman.
The meeting was opened with prayer by Reverend Kellogg.
MINUTES
The minutes of the last special meeting were accepted as read and had been approved in writing by Mayor Haman.
REPORTS
Report of the Chief of Police was accepted as read.
Report of the Alderman was accepted as read. Checks in the amounts of $119.00, $443.30 and $104.50 were remitted to the City.
Report of the Acting Alderman was accepted as read. A check in the amount of $399.00 was remitted to the City.
Report of Cash Receipts for July was accepted as read.
Report of Budget Expenditures for the period ending June 30, 1958, was accepted as read.
Report of City Manager was accepted as read.
PLAQUE - ARMY RESERVE CENTER
Council received a request that the City of Dover furnish a plaque for the newly constructed Army Reserve Center, however the request was denied.
RICHTER & MEYER - SEWER
The request of Richter & Meyer, owners of the shopping center located at the intersection of the North Little Creek Road and the Dual Highway, was discussed by Council. Richter & Meyer desire to close off the outlet to a series of pits in the easterly corner of the shopping center sewage system and divert the sewage from the shopping center straight to the highway through an existing twelve (12) inch line, than down the highway in a northerly direction to the North Little Creek Road and attach this line to the line which the City has laid on Division Street by extending that line across the Dual Highway.
It was pointed out that one eating establishment is located in that area, and that such establishments are always a source of grease and should be adequately provided for by installation of sufficient traps as would conform to the requirements of the City.
The recommendations of the Utility Committee were that the sewer tap should be made in accordance with City of Dover specifications, that a tapping fee of approximately $5,300.00 be charged, all work to be done at the expense of Richter & Meyer, and that existing rates for sewer rents should apply.
On motion of Mr. Fromm, seconded by Mr. Holpp, approval was given for the sewer tap in accordance with the recommendations of the Utility Committee and to conform with City of Dover specifications, including provision of adequate grease traps.
ELECTRIC RATE - KENT GENERAL HOSPITAL
In view of the recent rate change electric service, Kent General Hospital requested that Council consider the rate to be charged, the previous billings having been made at two cents per kilowatt hour under a special arrangement by Council. The matter was referred to the Utility Committee for further study.
BUSH-ROBINO AGREEMENT
Mr. Robino and his attorney were heard by Council. Am estimate of cost of installation of streets, curbs and gutters, sanitary sewers and storm sewers, including excavation of streets and design cost was submitted by Mr. Robino, Developer of the Bush lands. Estimate of the completed job would be approximately $65,000.00. Figures submitted would embrace Monroe Terrace, Sunset Terrace, Dover Street and West Street.
On motion of Mr. Fromm, seconded by Mr. Davis, the City Solicitor was authorized to prepare an agreement between the City of Dover and Mr. Robino, the Developer, permitting the installation of streets, curbs and gutters, sanitary sewers and storm sewers by the developer with original cost of installation to be paid by the developer. Such installations would be at a unit price agreed upon by the City of Dover and the Developer and in accordance with City of Dover specifications. Payment of that portion applicable to the City of Dover would be made on or before July 30, 1959, if the developer has been successful in completing the forty-four units as outlined in the original proposal. Should funds be unavailable at deadline date, the Mayor and City Treasurer are authorized to arrange financing of that amount nor paid out of current income. The City of Dover will not pay its share of the improvements or installation of utilities covered by this agreement on any street to which the City does not have title.
Mr. Bush and his attorney, Mr.Twilley, were heard by Council relative to the installation of curbs and gutters and the paving of Monroe Terrace, sometimes called new Street.
Mr. Bush submitted a proposal whereby the City of Dover would settle the condemnation suit out of court, said settlement to equal the portion of cost to Mr. Bush for installation of such curbs, gutters and paving of Monroe Terrace relative to that property owned by Mr. Bush.
On motion of Mr. Davis, seconded by Mr. Holpp, the proposal was referred to the City Manager and City Solicitor who will prepare a report to be submitted at the next meeting of Council.
POWER PLANT - BOILER REPAIRS
The Acting City Manager reported that a written agreement had been accepted by the City of Dover and Delaware Power & Light Co. whereby all necessary repairs to the boiler at the Dover Power Plant could be made, and that the Kuljian Corporation, Philadelphia, Pennsylvania, had been instructed to proceed with the necessary repairs.
