SPECIAL MEETING

March 24, 1958

The special meeting of City Council was held Monday, March 24, 1958, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Fromm, Hayes, Holpp, Mundy, Turner and Zartman.

MINUTES

Minutes of the Meeting of March 10 were accepted as read, with the exception that a copy of an agreement between Harley Taylor and the City of Dover will be added to the minutes.

REPORTS

Report of budget expenditures to February 28 was accepted as read.

Report of the Fire Recorder for February was accepted as read.

PURE OIL CO.

The Pure Oil Co. withdrew its request to construct a gasoline station at S. Governors Avenue and Waples Avenue.

TRUCK BIDS

Bids were received and opened as follows for a line truck:

            Holden and Mundy                 $5882.00

            C. F. Schwartz                         6877.60

            Bolan Motors                           8110.00

            Kent County Motors                6143.00, add $275.00 for special feature

On motion of Mr. Holpp, seconded by Mr. Carroll, Council authorized purchase of the truck from the low bidder, after tabulation of the bids.

RICHARDSON PROPERTY

City Solicitor Buckson reported that final settlement had been made in the purchase of the Richardson property by Dover, and the deed had been recorded.

DIVISION STREET ALLEY ORDINANCE

On motion of Mr. Hayes, seconded by Mr. Carroll, Council by unanimous vote adopted the following ordinance:

AN ORDINANCE RELATING TO THE REGULATION OF TRAFFIC ON UNNAMED ALLEYS SITUATE IN THE CITY OF DOVER AND LYING BETWEEN DIVISION STREET ON THE SOUTH, FULTON STREET ON THE NORTH, QUEEN STREET ON THE WEST, AND NEW STREET ON THE EAST.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. Traffic upon that part if the City of Dover being un-named alleys lying between Division Street on the South, Fulton Street on the North, Queen Street on the West, and New Street on the East, shall be only in a Northerly direction on the portion of the alley extending from Division Street to the intersection of the alley extending from New Street to Queen Street, and traffic upon that alley extending from New Street to Queen Street shall be only on a Westerly direction on that portion of the alley extending from New Street to the intersection of the alley extending from Division Street to Fulton Street.

Section 2. It shall be the duty of the City Manager of the City of Dover to secure and have erected suitable signs or markings indicating the direction of traffic as soon as may be conveniently done upon the passage and approval of this Ordinance.

Section 3. Any person convicted of the violation of any of the provisions of this Ordinance shall be fined not less than Five ($5.00) Dollars nor more than Twenty-five ($25.00) Dollars and/or shall be imprisoned not exceeding thirty (30) Days.

BUILDING LINE ORDINANCE

On motion of Mr. Zartman, seconded by Mr. Mundy, Council by unanimous vote adopted the following ordinance:

AN ORDINANCE RELATING TO THE BUILDING LINES AND THE ERECTION OR ALTERATION OF BUILDINGS WITHIN THE CITY LIMITS.

Be It Ordained By The Council Of The City Of Dover:

Section 1. That Chapter XI of the Ordinances of the City of Dover relating to Building Commission be and the same is hereby amended by adding at the end of Section (3) Three of said Chapter XI a new paragraph to be known as Paragraph “g” as follows:

            g. Where the common or established building line if the street, block, or section where such building or structure is to be built, constructed, altered, or repaired is not definitely established by existing structures or by deed, plat, or otherwise, or where the established building line is effected by the widening or improvement of street or streets along which said building or structure is or is to be located, the Council of the City of Dover may establish such Building Line as it deems proper after notice to set forth the location of the proposed Building Line and the time and place of the meeting at which the establishing of the Line will be considered by the Council.

“Building Line” is the line between which and the property line no building or other structure or portion thereof may be erected above the grade level. The Building Line is considered a vertical surface intersecting the ground or such line.

UTILITY COMMITTEE

            LINCOLN PARK

            The Utility Committee has received a request from Dover Builders that in the development of Lincoln Park they be permitted to install septic tanks on the laws in front of sample houses which could be connected to City sewer when such is available. These proposed sample houses, 3 to 5 in number, would be located some 1800 feet from the beginning of a sewer extension. Council wishes to encourage the development but is reluctant to approve septic tank installation within the City. Council’s power to prohibit septic tanks was discussed, as was relocating the sample houses, or constructing the required sewer facilities upon the developer furnishing the City a performance bond guaranteeing construction and connection to the sewer of a minimum number of houses within a prescribed period of time. The City Manager will confer again with the builders.

            SEWER DIVISION STREET

            The Utility Committee discussed the extension of sewer lines east of the power plant on Division Street and the request of Richter and Meyers to extend a line under the dual highway o serve their properties in the area of the Acme Market. The Committee recommended that future outside areas served by City sewer be required to accept annexation to the City when contiguous and desiring City sewer service. Mr. Davis moved that Richter and Meyers be permitted to extend the sewer line according City specifications at their expense provided in a written agreement they assent to become annexed to Dover when their area becomes contiguous and Dover desires annex. Mr. Fromm seconded the motion. Discussion revealed that at present Dover could annex adjacent areas only as a result of a favorable referendum and a written agreement could not bind a secret ballot. The City Solicitor will prepare for Council sample annexation bills for presentation to the State Legislature. On motion of Mr. Carroll, seconded by Mr. Holpp, the motion of Mr. Davis was tabled.

            ELECTRIC METER DEPOSITS

            The Utility Committee recommended that deposits be required for electric furnished new commercial accounts in an amount equal to the estimated monthly bill, plus or minus 10%; that after three years deposits be refunded to accounts with good credit records; that on residential accounts the deposit required be the monthly average of the previous 12 months billings, with a minimum of $10.10. On motion of Mr. Carroll, seconded by Mr. Davis, Council authorized the above policy.

ENGINEERING CONSULTANTS

The Utility committee recommended that The Kuljian Corporation be retained as engineering consultants to plan additional power plant capacity. Council authorized Dover to hire the firm recommended by the committee.

SILVER LAKE

Council discussed boating regulations for Silver Lake and the recommendations of a group interested in boating which included licensing boats by City Police. Mr. Fromm informed Council that a committee appointed by the Dover Recreation Council would also have recommendations for improvements to the bathing areas which might be considered together with boating regulations. On motion of Mr. Davis, seconded by Mr. Zartman, Council appointed a committee of the City Manager, Chief of Police and City Solicitor to prepare an ordinance for Silver Lake boating regulations, and referred other contemplated improvements to the Planning Commission.

EQUITABLE SECURITY

Equitable Security Trust Co. requested a building permit to erect a temporary structure facing The Plaza in the plot behind its present banking building. The structure would be torn down when the bank is able to secure possessions of surrounding property which it has purchased for expansion purposes but at present is under lease to tenants under renewable agreements which may have as many as seven years to run. On motion of Mr. Hayes, seconded by Mr. Mundy, Council approved granting a building permit to Equitable Security Trust Co. to erect a temporary banking structure on The Plaza.

DAVIS PERMIT

W. G. Davis applies for a permit to alter his building on S. Governors Avenue just off Loockerman Street. The alteration calls for erection of a built-in canopy. On motion of Mr. Mundy, seconded by Mr. Hayes, Council approved granting a building permit to W. G. Davis.

SHANK PROPERTY

City Manager Ward discussed the desirability of purchasing from Gilbert Shank a portion of his property on St. Jones River to the rear of his home. The City now owns the east bank of the stream south of the dam with the exception of this one piece. Council authorized the City Manager to negotiate for the property.

POLICE STATION

On motion of Mr. Davis, seconded by Mr. Zartman, Council appointed the City Manager, Chief of Police, and Mayor as a committee to determine Police Department requirements on the recently purchased Richardson property.
