REGULAR MEETING

May 13, 1957

The regular meeting of City Council was held Monday, May 13, 1957, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Hayes, Holpp, Mundy, Petty, Tischer, Turner and Zartman.

MINUTES

Minutes of the last meeting were accepted as read.

REPORTS

Report of the Alderman Dempsey was accepted as read. Checks in the amounts of $186.00, $1972.300 and $20.50 were remitted to the City. Report of the Acting Alderman Shockley was accepted as read. Checks in the amounts of $627.00 and $10.00 were remitted to the City.

Report of the Chief of Police for April was accepted as read.

Report of the Fire Recorder for March was accepted as read.

Report of Cash Receipts for April was accepted as read.

AMERICAN LEGION

Council authorized the American Legion to conduct their annual Memorial Day services and parade at the triangle on Thursday, May 30 at 10:30 A.M. Council also authorized the City to present a wreath of flowers.

DOVER LIBRARY

The Dover Library Commission requested City Council to make available to the Commission on a piece of land immediately east of City Hall for the erection of a library. A plot of 120' x 120' is needed. The land is presently under long term lease to the Dover Parking Authority except for a small plot reserved by the City adjoining City Hall. The Library Commission insists that this central location is essential for a successful library facility. Council feels the matter requires full consideration, including conference with the Parking Authority and a review of future needs of the City. On motion of Mr. Holpp, seconded by Mr. Tischer, the matter was tabled until the next regular meeting of City Council.

EDGELL CONSTRUCTION

Edgell Construction Co. requests permission to operate an office and construction business on a plot of land between Mary and Clara Streets and from Pear Street a distance of 325' east. The area is presently zoned as residential. Council directed that the request be advertised as required by ordinance for a hearing to be held Monday, May 27, 1957 at 7:30 P.M.

HURLEY WATER METERS

William Hurley Jr. asked Council for permission to install single water meters to meter water consumption of three housing units located at Governors Avenue and Bank Lane and a single meter to meter water consumption in approximately 14 units on Bank Lane and Short Street, west of New St. On motion of Mr. Davis, seconded by Mr. Hayes, Council directed that the units be metered separately as outlined in the policy previously established by City Council.

SWIMMING BEACH

Paul Scotton and Kenneth Smith, requested that the YMCA recreation committee be given authorization to coordinate efforts to improve the Silver Lake swimming area be enlisting the assistance of various civic organizations and making recommendations to City Council for improvements to be made, including the establishment of boating regulations. The Junior Chamber of Commerce presently has such authorization which they have agreed to relinquish by letter to Council. Action on the YMCA committee’s request was postponed pending receipt of the letter. The YMCA committee also recommended that the City fence and light the area to prevent vandalism.

FREE PARKING

A delegation from the Mercantile Section of the Dover Chamber of Commerce appeared before Council with a proposal to provide free parking in the lots being constructed by the Dover Parking Authority. They listed the sum of $9000 as the amount required to retire the debt of the Authority, annually. They propose that the City pay one-half that cost and the merchants an equal amount. On motion of Mr. Hayes, seconded by Mr. Carroll, the proposal was rejected.

GARDEN COURT

Warren and Robert Allen, officers of Dover Garden Court, appeared before City Council to discuss the charge by Dover for the installation of water and sewer lined to that project. Dover has a suit pending for collection of the charges. Mr. Warren Allen pointed out to Council that the total charges, $8661.71, included a ten per cent overhead charge, which was in excess of cost. He further pointed out that the sewer line installed was an 18" line, although the agreement between the two parties called for the installation of a 12" sewer. He stated that the original estimate of cost for extension of sewer and water was $5000, which sum he felt was more equitable and which he asked Council to agree to with payment to be made at the rate of $1000 per year for five years. The City Solicitor will report further on the matter at the next meeting of Council.

C OF C HOLDING COMPANY

Charles Hardesty, president of the Dover Chamber of Commerce Holding Company, asked Council to consider a proposal whereby the Holding Company would donate $1000 to Wesley Junior College and be reimbursed by the City. On motion of Mr. Tischer, seconded by Mr. Hayes, the proposal was denied.

KIRKWOOD STREET CURBS

James Hardcastle, representing property owners on Kirkwood Street between Fulton and Cecil Streets presented a petition to Council requesting that curbs be installed on that block and the street improved. The request was tabled pending receipt of a survey bu City Engineer Bewick on the installation of curbs on Kirkwood Street from Division Street to Mary Street.

TEST WELL

On motion of Mr. Davis, seconded by Mr. Mundy, Council authorized payment, after July 1, 1957, of the sum of $500 toward the cost of drilling a test well, now being drilled at the Air Base to determine local water resources.

POLICE

Chief Turner discussed parking on North Street from State Street to Federal Street and granting the Water Pollution Commission movable No Parking signs.

On motion of Mr. Mundy, seconded by Mr. Holpp, Council authorized sending Lieutenant Frank Montague to Michigan State College to attend a one week instruction course in Police & Community Relations, at a cost not over $125.

Bids have been received from three dealers on a new police car with one trade-in. On motion of Mr. Tischer, seconded by Mr. Hayes, purchase of a new car was approved at a cost of $790 from the low bidder, Holden & Mundy.

The City Solicitor was directed to prepare ordinances prohibiting parking for a distance of 60' from the intersection of State & Water Street, and prohibiting parking from more than two hours on State Street at The Green.

FIRE SCHOOL

On motion of Mr. Mundy, seconded by Mr. Tischer, Council allotted the sum of $60.00 to the Robbins Hose Company to cover expenses of its members who attend Fire School.

TRUCK BIDS

Bids have been received from four dealers for the purchase of two dump trucks and trade-in of one old truck. Low bidder if Holden & Mundy at the net price of $5950. On motion of Mr. Holpp, seconded by Mr. Tischer, Council authorized purchase of the trucks from the low bidder at the price of $5950.

On motion of Mr. Carroll, seconded by Mr. Davis, Council by unanimous vote passed the following ordinance.

AN ORDINANCE PROVIDING FOR THE INSTALLATION OF WATER METERS BY CONSUMERS OF WATER SUPPLIED BY THE CITY OF DOVER

Be It Ordained By The Council Of The City Of Dover:

Section 1. Chapter III of the Ordinances of The City of Dover is hereby amended by striking out Section 5 of said Chapter and ordaining in lieu thereof the following:

            Section 5. Every consumer of water supplied by The City of Dover shall purchase a water meter from the City Manager and have the same installed at the expense of the said consumer and in accordance with specifications established by the City Manager. After the installation of a water meter as aforesaid the consumer shall pay for the water supplied according to the established rates or rents applicable either within or without the City Limits as the case may be.

Section 2. This ordinance shall be effective upon its approval by the Mayor, but in view of the great number of properties where water meters must be installed and the practical difficulties in obtaining such a large number of meters and performing the work of installation, the City Manager is hereby authorized in his discretion to designate the properties or sections of the sections of the city where meters shall be immediately installed and the properties or sections of the city where such installation shall be deferred, and to schedule the installation of meters according to the availability of materials and workmen for that purpose. In no event shall the installation of a water meter at any property be deferred to a time after September 30, 1957. A consumer of water at a property where the installation of a water meter has been deferred by the City Manager shall be excused from compliance with this ordinance until the time fixed by the City Manager for such installation at his property, and until that time such consumer shall pay the water rents due measured in accordance with previous practices. The City Manager may disconnect the water service to any property the owner of which refuses or fails to install a water meter at the time scheduled by him as aforesaid.
