SPECIAL MEETING
April 22, 1957
The special meeting of City Council was held Monday, April 22, 1957, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Hayes, Holpp, Mundy, Tischer, Turner and Zartman.
MINUTES
Minutes of the last meeting were accepted as read.
SEWER BIDS
City Manager Ward reported on the receipt of bids for installation of sewer in the meadow east of City Hall. Bids were received as follows: Edgell Construction Co. $5868; George & Lynch, $6326.90; Alex Colovero, $7267.25; Burger Construction Corp., $4822.15. On motion of Mr. Davis, seconded by Mr. Hayes the bid was awarded to Burger Construction Corporation.
SOUTH STREET ALLEY
Council discussed the opening of a 30 foot alley between South Street, Water Street, Governors Avenue and New Street, and the abandonment of a right-of-way for the same area. Property owners have been contacted about right-of-way for the contemplated alley. On motion of Mr. Tischer, seconded by Mr. Davis, the City Manager was authorized to begin condemnation proceedings if needed to acquire the alley right-of-way.
HEARINGS
At 8:00 P.M., Mayor Haman announced that the Council was sitting to consider the question of installing curb and gutter in various streets of the City and to hear owners of property and other residents of the City. Notice of hearings on the following streets have been published:
Hope Street - Governors Avenue to State Street
Westview Terrace - Wyoming Avenue to Waples Avenue
Monroe Terrace - Wyoming Avenue to Waples Avenue
Waples Avenue - Westview Terrace to State Street
Bradford Street - Wyoming Avenue to Hope Street
Ross Street - State Street to Fairview Avenue
Lakewood Place Walker Road to Columbia Avenue
Governors Avenue - Walker Road to Governors Boulevard
Clara Street - Governors Avenue to Bradford Street
New Street - William Street to Mary Street
Queen Street - Fulton Street to Division Street
All owners of property and residents were heard on the question of installation of curb and gutter on streets in the order listed above.
Although no written petition was presented, the sentiment of a majority of property owners on Ross Street appeared to oppose the installation of curb and gutter in that street. The question of installation of curb and gutter in that street was tabled to provide property owners on that street the opportunity to present their petition in writing.
David Bachman, property owner on Clara Street, requested permission of Council to personally install the curb in front of his property and asked that he be permitted to install only the straight curb which would conform to curb on adjoining property. On motion of Mr. Hayes, seconded by Mr. Turner, Mr. Bachman was authorized to install his own curb on North New Street. Council did not object, provided the curb and gutter was installed to City specifications and with the use of steel forms.
Edward Clouse requested permission to install his own curb on North New Street. Council did not object, provided the curb and gutter was installed to City specifications with the use of steel forms.
On motion of Mr. Davis, seconded by Mr. Hayes, Council by unanimous vote adopted the following resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CURBS AND GUTTERS ON BOTH SIDES OF HOPE STREET FROM SOUTH GOVERNORS AVENUE TO SOUTH STATE STREET AND FIXING THE COST THEREOF TO BE BORNE BY ADJOINING OWNERS
WHEREAS the Council of The City of Dover has held a meeting on Monday, April 22, 1957, at 8:00 P.M. Eastern Standard Time at the City Hall, in accordance with a resolution adopted April 8, 1957, and duly published in accordance with the Charter; and
WHEREAS all interested property owners and other residents of the City have been heard, and a written objection signed by a majority of the property owners affected has not been presented; Now Therefore
Be It Resolved By The Council Of The City Of Dover:
Section 1. Concrete curbs and gutters shall be installed along both sides of Hope Street from South Governors Avenue from South Governors Avenue to South State Street in The City of Dover in front of the properties of the owners named in the published resolution of April 8, 1957.
Section 2. The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of The City of Dover.

The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of the City of Dover.
