SPECIAL MEETING
February 25, 1957
The special meeting of City Council was held Monday, February 25, 1957, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Carroll, Davis, Hayes, Holpp, Mundy, Petty, Tischer, Turner and Zartman.
MINUTES
Minutes of the meeting of February 11, 1957 were accepted as read.
REPORTS
Budget report of January, 1957 was accepted as read.
Ambulance operation report for January was accepted as read.
Report of City Manager for January was accepted as read.
CHARTER AMENDMENTS
Council directed the City Solicitor to prepare bills for submission to the State Legislature which would amend the City Charter. One amendment would permit the issuance of bond anticipation noted by the City of Dover to be repaid by the proceeds of any bond sale authorized by a referendum in accordance with the provisions of the City Charter. The City would thus be able to time its bond sales with a favorable market and still obtain funds which would otherwise be available only from an actual bond sale.
A second amendment would authorized Council to appoint a committee to hear tax appeals and to report its findings and recommendations to Council. At present the Charter requires the entire Council to sit to hear appeals.
FIRE COMMITTEE
Mayor Haman announced appointment to the Fire Committee of Councilmen Hayes, Turner and Carroll.
CURB INSTALLATION HEARINGS
At 8:00 P.M. hearings were opened on the installation of curb and gutter in various sections of the City as outlined in the published resolutions of January 28, 1057. Property owners and other residents of the City were given an opportunity to be heard. Mr. Eckley Schooley objected to the installation of curbs on his property on American Avenue at Division Street on the grounds that State Highway plans for improvement of Division Street would soon cause the removal of any curb installed. He was informed that the City would take into consideration plans contemplated for Division Street when curbs are installed at its intersection with American Avenue. W. S. Taber pointed out that the curb and gutter on Pryor Street would be installed in the street right-of-way and questioned whether the property owners should pay for the improvement. He was informed of the charter provisions which permitted the assessment of such improvement costs to abutting property owners. Coleman I. Gainsburg objected to the installation of curbs and gutters on Park Avenue stating he has no provisions in his budget for such payment and that he thought the curbs were unnecessary. George Hess appeared for the Dover Special School District to determine the intention of the City about installation of curb on Smith Street. It was determined that curb would be installed on Smith Street for a distance of approximately 120' east of Pennsylvania Avenue. Most persons at the hearing favored the installation of curbs. In no case did majority of property owners in any area object.
On motion of Mr. Hayes, seconded by Mr. Carroll, Council by unanimous vote adopted the following Resolution:
A RESOLUTION PROVIDING FOR THE INSTALLATION OF CURBS AND GUTTER ON BOTH SIDES OF AMERICAN AVENUE FROM DIVISION STREET NORTH TO MARYLAND AVENUE AND FIXING THE COST THEREOF TO BE BORNE BY ADJOINING OWNERS.
WHEREAS the Council of The City of Dover has held a meeting on Monday, February 25, 1957, at 8:00 P.M. Eastern Standard Time at the City Hall, in accordance with a resolution adopted January 28, 1957, and duly published in accordance with the Charter; and
WHEREAS all interested property owners and other residents of the City have been heard, and a written objection signed by a majority of the property owners affected has not been presented; Now therefore
Be It Resolved By The Council Of The City Of Dover:
Section 1. Concrete curbs and gutters shall be installed along both sides of American Avenue from Division Street north to Maryland Avenue in The City of Dover in front of the properties of the owners named in the published resolution of January 28, 1957.
Section 2. The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of the City of Dover.

A RESOLUTION PROVIDING FOR THE INSTALLATION OF CURBS AND GUTTER ON BOTH SIDES OF PRYOR STREET FROM BUDD AND KING STREET TO DIVISION STREET AND FIXING THE COST THEREOF TO BE BORNE BY ADJOINING OWNERS.
On motion of Mr. Davis, seconded by Mr. Carroll, Council by unanimous vote adopted the following Resolution:
WHEREAS the Council of The City of Dover has held a meeting on Monday, February 25, 1957, at 8:00 P.M. Eastern Standard Time at the City Hall, in accordance with a resolution adopted January 28, 1957, and duly published in accordance with the Charter; and

Be It Resolved By The Council Of The City Of Dover:
Section 1. Concrete curbs and gutters shall be installed along both sides of Pryor Street from Budd and King Street to Division Street in The City of Dover in front of the properties of the owners named in the published resolution of January 28, 1957.
Section 2. The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of the City of Dover.

A RESOLUTION PROVIDING FOR THE INSTALLATION OF CURBS AND GUTTER ON BOTH SIDES OF PINE STREET FORM ORCHARD AVENUE TO THE DUAL HIGHWAY (U.S. ROUTE 13) AND FIXING THE COST THEREOF TO BE BORNE BY ADJOINING OWNERS.

The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of the City of Dover.

The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of the City of Dover.

Be It Resolved By The Council Of The City Of Dover:
Section 1. Concrete curbs and gutters shall be installed along both sides of Mary Street from North Bradford Street to North Governors Avenue in The City of Dover in front of the properties of the owners named in the published resolution of January 28, 1957.
Section 2. The full cost of the said concrete curbs and gutters shall be borne by the owners of real property in front of which the same shall be installed in proportion to the lineal frontage of their properties, and the said cost shall be ascertained and collected in accordance with the provisions of Section 28 (b) of the Charter of the City of Dover.

DIVISION & FOREST STREETS
On motion of Mr. Davis, seconded by Mr. Hayes, Council approved the preliminary plans submitted by the State Highway Department for the improvement of Division and Forest Streets. Council expressed a preference for the widening of the streets, where necessary, and also were willing to institute any condemnation proceedings that may be necessary. However, Council desired the State Highway Department to be informed that the City was without funds that could be used for the purchase of necessary right-of-way and to raise them thru taxation would result in an almost doubling of the existing tax rate. Accordingly, the City would appreciate any effort on the part of the State Highway Department to procure finds to defray expenses or right-of-way thru State or Federal aid.
