SPECIAL MEETING

January 28, 1957

The special meeting of City Council was held Monday, January 28, 1957, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs. Biddle, Davis, Hayes, Holpp, Mundy, Petty, Tischer and Zartman.

MINUTES

Minutes of the regular meeting were accepted as read.

REPORTS

Report of Budget expenditures for December were accepted as read.

Report of Ambulance operations for December was accepted as read.

ELECTION

The Election Board certified to City Council the result of the Municipal Election held January 21, 1957, to be as follows:

REFERENDUM

On motion of Mr. Davis, seconded by Mr. Hayes, Council by unanimous vote adopted the following Resolution:

A RESOLUTION PROPOSING THE INCLUSION OF CERTAIN LANDS WITHIN THE LIMITS OF THE CITY OF DOVER AND CALLING FOR A SPECIAL ELECTION.

Be It Resolved By The Council Of The City Of Dover:

Section 1. It is hereby proposed that the boundaries of The City of Dover shall be extended to include the lands and premises described and designated as Territory III-2 in Section 1 A of the City Charter, as amended by Chapter 314, Volume 49, Laws of Delaware, said territory being bounded on the west by the east line of South State Street, on the south by the south line of Roosevelt Avenue, on the east by the west bank of St. Jones River, and on the north by the present City boundary, the south line of a 15 foot alley running parallel to and south of Lotus Street and the extension of said line to St. Jones River.

Section 2. A special election shall be held in said Territory III-2 at Capitol Plumbing Inc., 1030 S. DuPont Boulevard, on Saturday, March 16, 1957, in accordance with Title 22, Section 101, Delaware Code, and the provisions of Section 1 A of the City Charter, as amended by Chapter 314, Volume 49, Laws of Delaware, to determine whether the said territory shall be included within the City of Dover. The polls shall be open from one o’clock P.M. to seven o’clock P.M. Each resident of the said Territory III-2 who is a registered voter upon the records of the Third Election District of the Second Representative District of Kent County and who does not own real estate within said territory will be entitled to one vote, and each owner of real property in said territory who is of the age of twenty-one years or upwards will be entitled to one vote for each One Hundred Dollars ($100) or fractional part thereof of the assessed value of said real property, subject to certain rules for special types of ownership.

Section 3. The Clerk of Council is hereby directed to make all arrangements necessary for holding said election, including the use of or access to the registration and assessment records of Kent County, providing ballots and ballot boxes, publication of this resolution and other matters required by pertinent provisions of the City Charter and other laws of the State of Delaware.

VOGEL TOILETS

City Engineer Bewick outlined to City Council the operation of Vogel toilets to which the Board of Health objects. There is a possibility of sewage entering the water system. On motion of Mr. Tischer, seconded by Mr. Holpp, Council forbade the future installation of Vogel toilets within the City, and directed that Thomas Baker survey all present installation within the City.

RIDGELY PARKING

Mrs. Henry Ridgely complained that the No Parking signs in front of her residence on The Green were ignored by motorists who desired to park there. On motion of Mr. Biddle, seconded by Mr. Hayes, the matter was referred to the Police Department.

UTILITY COMMITTEE REPORT

Mr. Ward reported on matters considered by the Utility Committee.

The Latex Steam tie and a contract based more or less on mutual assistance is about completed.

Agreement is nearly reached on a contract for supplying electric power to the International Latex installations near the railroad. Mr. ward requested Council’s approval of supplying electrical needs of Latex on both sides of the railroad under one contract. On motion of Mr. Davis, seconded by Mr. Hayes, Council authorized consolidating the billing under one contract.

The Utility Committee recommended that the entire cost of constructing the line at the end of the Whiteoak Road be borne by the applicant, Louis DeMarie. On motion of Mr. Petty, seconded by Mr. Holpp, Council approved construction of the power line providing the entire cost is paid by Louis DeMarie, who would be reimbursed at the rate of 10% of all billings on the line, until the cost is reimbursed, for a period not to exceed 10 years. The City will assume title to the line upon its construction.

William Hurley requested permission to extend a water line from the Whiteoak Road to properties owned by him on Greenhill Avenue. On motion of Mr. Hayes, seconded by Mr. Davis, the request was tabled.

POWER PLANT

Mr. Ward explained to City Council that the power plant was now ready for operation with the exception of minor steam deficiencies which could be corrected by the installation of two additional tubes and certain corrections to the induced draft fan. Union Iron will agree to install the tubes at some later date at our convenience. On motion of Mr. Holpp, seconded by Mr. Zartman, Council authorized putting the plant in operation now, with corrections needed to be made later.

MAYOR’S REMARKS

Mayor Haman expressed the sentiment of Council and himself on services rendered the City be outgoing Councilmen Stanley Petty and Millard Biddle. He praised their efforts and thanked them for their long and earnest service.

Mr. Haman also welcomed the newly-elected Councilmen Crawford Carroll and Francis L. Turner who attended the meeting as observers.

Mayor Haman also expressed the appreciation of Council and himself for the long cooperation rendered by the members of the Press who were present, Harry C. McSherry and Charles Baker, and congratulated Mr. McSherry on the eighth anniversary of his radio news reporting program.

RADIO

On motion of Mr. Davis, seconded by Mr. Mundy, Council returned with thanks the Link radio donated by the Robbins Hose Company to the City.

ORDINANCE

On motion of Mr. Davis, seconded by Mr. Mundy, Council by unanimous vote adopted the following ordinance:

AN ORDINANCE ESTABLISHING A HISTORIC OLD DOVER DISTRICT AND REGULATING THE STYLE OF BUILDINGS HEREAFTER CONSTRUCTED OR ALTERED THEREIN.

Be It Ordained By The Council Of The City Of Dover:

Section 1. A Historic Old Dover District is hereby established in The City of Dover consisting of all those portions of the said City lying within 150' of the right of way lines of the following streets measured at right angles to said lines:

                        The Green;

                        State Street from Loockerman Street to South Street;

                        Bank Lane from The Green to Governors Avenue;

                        Court Street from The Green to Federal Street;

                        Water Street from State Street to East Street.

Section 2. No person shall construct, erect, emplace, modify, alter or remodel any building within said Historic Old Dover District without first submitting detailed plans and specifications for such work to the Council of The City of Dover and receiving the approval of said plans and specifications by the said Council. The Council shall carefully examine said plans and specifications with particular attention to the external appearance and style of the building proposed to be constructed, erected, emplaced, modified, altered or remodeled, and if the said appearance and style are in keeping with those of other buildings in the said District and suitable for the said District, approve the same, but if the Council finds that the appearance and style of such building will not be in keeping with those of other buildings in the said District or suitable for the said District it shall disapprove the said plans and specifications and return them to the applicant with a statement of the objections or deficiencies found to exist. No person shall construct, erect, emplace, modify, alter or remodel any building within the said Historic Old Dover District in accordance with plans which have been disapproved by the Council.

Section 3. Any person convicted of a violation of this ordinance shall be fined not more than One Hundred Dollars ($100.00) or, in default of payment of such fine as shall be imposed, imprisoned for not more than thirty (30) days.

Section 4. Each day of the presence of existence of any building in violation of this ordinance shall constitute a separate offense for which the person responsible may be charged and punished in Section 3.
