REGULAR MEETING

July 9, 1956

The regular meeting of City Council was held Monday, July 9, 1956, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Biddle, Davis, Hayes, Holpp, Mundy, Petty, Tischer and Zartman.

MINUTES

Minutes of the last special meeting were accepted as read.

REPORTS

Report of the Alderman Dempsey for June was accepted as read. Checks in the amounts of $198.00, $264.80, $41.25 and $2180.35 were remitted to the City. Report of the Acting Alderman Shockley was accepted as read. A check in the amount of $172.30 was remitted to the City. Report of Budget

Report of the Chief of Police for June was accepted as read.

Report of Cash Receipts for June was accepted as read.

DELINQUENT ACCOUNTS

Council requested a report of electric accounts delinquent two months or more and water accounts delinquent two quarters or more at its next meeting.

SILVER LAKE

On motion of Mr. Tischer, seconded by Mr. Davis, Council directed that a committee be appointed to recommend such regulations as are needed for Silver Lake bathing and boating areas and to enforce present ordinances. City Manager Ward, Chief of Police Turner and Councilman Mundy were appointed to the Committee.

The matter of improving the recreation area near the colored bathing beach was referred to this committee for study and recommendation.

CITY ORDINANCES

The City Solicitor was directed to study and report on a method of indexing and codifying City ordinances and on the possible cost of such a project.

CITY MANAGER REPORT

Report of the City Manager was accepted as read.

CAPITOL GREEN GARBAGE

Council was asked what the City would charge for collecting garbage and trash from 204 units in the Capitol Green development. Council discussed the problem of collection and disposal. On motion of Mr. Petty, seconded by Mr Hayes, Council declined to make a bid on collections of garbage and trash in this area.

FREAR DAIRY ELECTRIC

Frear Dairy intends to put into operation a truck operated by an electric battery. They asked whether electricity to recharge the battery could be purchased on an off peak rate. The request was referred to the Utility Committee for study and recommendation.

BUDGET

On motion of Mr. Hayes, seconded by Mr. Biddle, the following Budget was adopted by unanimous vote. Wage increases, or other changes, will be handled by supplementary appropriations.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. That the amounts herein named, aggregating One Million, Seven Hundred Thirty Thousand, Forty-eight Dollars and Seventy-five Cents ($1,730,048.75), or so much as may be necessary, are hereby appropriated from current revenues for the use of the several departments of the municipal government, and for the purposes hereinafter mentioned for the fiscal year beginning July 1, 1956 and ending June 30, 1957, as follows:

Section 2. The City Manager is hereby authorized, without further approval of City Council, to make interdepartmental transfers up to 10% of the amount herein appropriated to any department.

NEW HOTEL

City Manager Ward reported that the Dover Hotel Corporation had submitted for its new structure east of City Hall. On motion of Mr. Petty, seconded by Mr. Davis, Council authorized the issuance of a conditional building permit.

LIVINGSTON BUILDING PERMIT

Arthur Livingston requested a building permit to erect a house on the rear of his lot on Pine Street and on which he already has a residence. On motion of Mr. Davis, seconded by Mr. Tischer, the request was tabled for further study.

POLICE CAR

Chief of Police Turner reported on bids he had obtained on the purchase of a new police car, with a trade-in of a present car. Bids were as follows, net:

            Matthews Motor Company                                         $851.90

            Bolan Motor Company                                                895.00

            Holden & Mundy                                                        950.00

Council discussed the experience of the City on relative maintenance costs of carious make cars and decided that the best interest of the City would be served by purchasing a car with lower maintenance costs. On motion of Mr. Tischer, seconded by Mr. Petty, Council awarded the contract for furnishing a police car to Holden & Mundy on the bid of $950.00.

ORDINANCE DISORDERLY CONDUCT

On motion of Mr. Holpp, seconded by Mr. Hayes, Council be unanimous vote adopted the following ordinance:

AN ORDINANCE AMENDING THE ORDINANCE REGULATING THE USE OF MUNICIPAL SWIMMING BEACHES WITH RESPECT TO THE SPEED OF VEHICLES OPERATED THEREIN.

Be It Ordained By The Council Of The City Of Dover:

Section 1. The ordinance adopted June 11, 1945, entitled “An Ordinance Regulating The Use of The Municipal Swimming Beaches Under The Supervision of The City of Dover and Providing Rules For The Use Thereof and Penalties For The Violation of Such Rules”, is hereby amended by adding at the end of Section 1 thereof a new paragraph designated “o”, as follows:

(1) No person shall drive or operate any vehicle at a speed greater than fifteen (15) miles per hour in or over any lane, drive, street or alley in the lands of The City of Dover set aside by the said City for swimming or recreational facilities.
