REGULAR MEETING
May 10, 1954
The regular meeting of City Council was held Monday, May 10, 1954, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Biddle, Davis, Helm, Holpp, Mundy, Petty, Smith and Tischer.
MINUTES
Minutes of the last regular meeting were approved as read.
REPORTS
Report of the Chief of Police was accepted as read.
Report of the City Manager was accepted as read.
Reports of the City Alderman and Acting Alderman were accepted as read. Checks in the amounts of $1665.65 and $332.50 were remitted to the City.
Budget report was accepted as read.
WATER TANK
City Manager reported on the painting and repair of the water tank on Division Street.
SACKARACKIN AVENUE ALLEYS
By unanimous vote, Council passed the following resolution abandoning the alleys designated with the reservation that the City retain permanent easement for installation and maintenance of utilities in the abandoned alley right-of-ways.
A RESOLUTION VACATING CERTAIN ALLEYS NEAR SACKARACKIN AVENUE IN THE CITY OF DOVER.
WHEREAS the Council of the City of Dover on the 12th day of April 1954, adopted a Resolution favorable to the vacating of the alleys hereinafter described; and
WHEREAS after proper notice given in accordance with the Charter of The City of Dover the Council heard the residents of the City and owners of City and owners of property affected who appeared before it at the City Hall on Monday, May 10, 1954, at 7:30 P.M., the time set in the aforesaid Resolution; Now Therefore
Be It Resolved By The Council Of The City Of Dover In Council Met:
Section 1. That the following alleys situated near Sackarackin Avenue in a development known as King’s Highway Villa in the City of Dover, as dedicated tot he use of the public by the filing on September 18, 1911, of a plot of said development in the Office if the Recorder of Deeds of Kent County in Deed Record Book C, Volume 10, Page 482, be and the same are hereby vacated and abandoned.
All that certain 10 foot alley lying north of Sackarackin Avenue and extending from the easterly line of State Street on said plot, shown as King’s Highway, in an easterly direction to lands marked on said plot “Woodland Meadow”;
All that certain 10 foot alley extending north from Sackarackin Avenue to the aforementioned 10 foot alley adjoining Lots 1, 2, and 3 on the west and Lot No. 10 on the east;
All that certain 10 foot alley lying north from Sackarackin Avenue and extending from the easterly line of State Street, shown on said plot as King’s Highway, to the 20 foot street east of Lot No. 33;
All that certain 10 foot alley extending south from Sackarackin Avenue to the aforesaid 10 foot alley, adjoining Lots No. 4, 5, and 6 on the west and Lot No. 7 on the east;
All certain 20 foot street or alley extending in a southeasterly direction from Sackarackin Avenue, east of Lot No. 33 and running through lands marked “Park” and “Woodland Meadow” on the aforesaid plot.
The City of Dover hereby reserves and retains the right and easement of the use of the aforesaid alleys for the installations and maintenance of sewer, water and electric lines, or utility lines of any nature.
Section 2. No person will be deprived of property in consequence of the vacating of said alleys, and therefore no compensation is awarded.

BAY ROAD WATER LINE
Gordy Construction Co. asked the City under what conditions it would extend its water lines to a proposed development on the Bay Road 1.1 miles south of the South Little Creek Road. Mr. Sheridan of the Collins Development Co. explained to City Council plans for proposed development between the South Little Creek Road and the Gordy Development. Council is also aware that the Dover Special School District propose to build an elementary school near the intersection of U.S. Route 13 and the South Little Creek Road. Council discussed the matter at length ans defined its policy as permitting extension of water facilities to such developments. The City Manager will study the entire matter, discuss the situation with the developers and report back to City Council at a special meeting to be held Monday, May 17, 1954.
LUTHERAN CHURCH ALLEY
The Luther Church requested the City to abandon a portion of an alley between Lotus and Pine Streets east of Park Avenue in order that they may extend Church Buildings. In exchange they will dedicate to the City for use as an alley a 20' strip of land opening from the present alley to Pine Street.
By unanimous vote, Council passed the following resolution:
A RESOLUTION PROPOSING THE VACATING OF A PORTION OF AN ALLEY EXTENDING IN AN EASTERLY DIRECTION FROM PARK AVENUE BETWEEN PINE STREET AND LOTUS STREET IN THE CITY OF DOVER.
Be It Resolved By The Council Of The City Of Dover In Council Met:
Section 1. The Council of The City of Dover favors the vacating and abandoning of a certain 15 foot alley lying between Pine Street and Lotus Street and extending in an easterly direction from the easterly line of Park Avenue for a distance of 80 feet, as dedicated to the use of the public by the filing on or about December 1, 1923 of a plot of South Dover Heights in the Office of Deeds of Kent County, Delaware, in Deed Record Book M. Volume 12, Page 218, provided that if the said portion of said alley shall be vacated St. John’s Evangelical-Lutheran Church of Dover, Delaware, a Religious Corporation of the State of Delaware, shall convey tot eh City of Dover on fee simple a strip of land to be used to vacated in a northerly direction to Pine Street with a width of 20 feet, being the easterly portion of Lot No. 59 as shown on the aforesaid plot.
Section 2. The Council of the City of Dover will sit at the City Hal to hear objections to vacating the said alley and to award just and reasonable compensation to anyone who will be deprived of property thereby on the 14th day of June, A.D. 1954, at 7:30 P.M.
