REGULAR MEETING

October 12, 1953

The regular meeting of City Council was held Monday, October 12, 1953, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Biddle, Davis, Helm, Holpp, Mundy, Petty, Smith and Tischer.

MINUTES

Minutes of the last regular meeting were accepted as read.

REPORTS

Report of the City Manager was accepted as read.

Report of the Chief of Police was accepted as read.

Report of City Alderman was accepted as read. A check in the amount of $1408.65 was remitted to the City.

PARKING SPACES

Short’s Taxi requested the removal of a parking meter on S. Governors Avenue and the marking of the space for a taxi stand. The Chief of Police was directed to investigate and report back.

The Chief of Police was directed to investigate and grant to Ellis motors the proper width of curb for a driveway into its used car lot.

CITY HOUSING

Council directed that the City-owned housing on King’s Highway be painted.

PARKING METERS

A request from the Chamber of Commerce that the parking meter ordinance be extended to cover evening shopping hours during the Christmas season. The matter was tabled until the November meeting.

AUDIT REPORT

Acceptance of the annual audit report was postponed until October 26.

LIABILITY INSURANCE

Council approved purchase of liability insurance, subject to review of the policy by the City Solicitor, for the following coverages: Electric lines, bodily injury, $25,000/50,000 - $601.12; property damage, $25,000/50,000, - $394.40; Streets and sidewalks (including trees), bodily injury $20,000/40,000 - $590.52; property damage, $25,000/50,000 - $257.52. The insurance will be purchased through John F. McDonald.

GARDEN COURT WATER LINE

The City Solicitor was directed to check the agreement between the City and Garden Court apartments and to proceed with such steps as are necessary to obtain collection of the amount due for extension of water and sewer facilities.

WATER SYSTEM - EDGEHILL ACRES

Acceptance of the water mains by the City from the Edgehill Acres development of Richter and Meyers was postponed until a later meeting.

ORDINANCE

By unanimous vote, Council passed the following ordinance:

AN ORDINANCE REQUIRING CERTAIN PRECAUTIONS WITH RESPECT TO UNUSED REFRIGERATORS.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. No person shall place, keep, or leave any refrigerator not in regular use in any place accessible to children within the City of Dover unless the door of such refrigerator shall have first been unhinged and detached therefrom the latch or closing device removed from the door thereof.

The term “refrigerator” is hereby defined for the purpose of this ordinance to mean any box or container designed for the storage of food or other articles at low temperature.

Section 2. Any person convicted of a violation of this ordinance shall be fined not more than One Hundred ($100.00) Dollars or upon failure to pay such fine as shall be imposed shall be imprisoned for not more than thirty (30) days.

By unanimous vote, Council passed the following ordinances:

AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON THE NORTH SIDE OF DIVISION STREET BETWEEN STATE STREET AND KING’S HIGHWAY.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. From and after the passage and approval of this ordinance it shall be unlawful for any person to park any vehicle on the North side of Division Street between State Street and King’s Highway.

Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine as may be imposed shall be imprisoned not more than five (5) days.

AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON THE NORTH SIDE OF HOPE STREET BETWEEN GOVERNORS AVENUE AND STATE STREET.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. From and after the passage and approval of this ordinance it shall be unlawful for any person to park any vehicle on the North side of Hope Street between Governors Avenue and State Street.

Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine as may be imposed shall be imprisoned not more than five (5) days.

AN ORDINANCE PROHIBITING THE PARKING OF VEHICLES ON CERTAIN PORTIONS OF NEW STREET BETWEEN NORTH STREET AND LOOCKERMAN STREET.

Be It Ordained By The Council Of The City Of Dover in Council Met:

Section 1. From and after the passage and approval of this ordinance it shall be unlawful for any person to park any vehicle on the following described portions of New Street between North Street and Loockerman Street:

That part of the westerly side of New Street within forty (40) feet in a northerly direction from the intersection of the western curb line of New Street with the northern curb line of North Street;

That part of the east side of the New Street within forty (40) feet southward from the intersection of the east curb line of New Street with the extended northerly line of the alley running from New Street to Queen Street.

Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine as may be imposed shall be imprisoned not more than five (5) days.

GARBAGE COLLECTION

The City Manager was authorized to change garbage collection days within the City of Dover as he sees fit in order to provide better collection service.

CHANGES TO CITY HALL

Council approved changes dividing the lobby of City Hall into three parts, one of which will be occupied as the office of the Chamber of Commerce.

By unanimous vote Council passed the following resolution:

A RESOLUTION PROPOSING THE VACATING OF A CERTAIN TEN FOOT ALLEY RUNNING FROM BRADFORD STREET IN AN EASTERLY DIRECTION BETWEEN LANDS OF THE BAPTIST CHURCH OF DOVER AND LANDS OF ELIZABETH CLARK TO A SEVENTEEN FOOT ALLEY.

Be It Resolved By The Council Of The City Of Dover In Council Met:

Section 1. The Council of the City of Dover favors the vacating and abandoning of a certain ten foot alley running from Bradford Street in an easterly direction between lands of The Baptist Church of Dover and lands of Elizabeth Clark to a seventeen foot alley in the City of Dover, and more particularly described as follows, to-wit:

Beginning at a point in the easterly line of Bradford Street at a corner for lands of The Baptist Church, said point being 73 feet in a northerly direction along the said easterly line of Bradford Street from the intersection thereof with the northerly line of Division Street; thence running with lands of The Baptist Church of Dover in an easterly direction parallel with the northerly line of Division Street by a course marked on the plot hereinafter mentioned as North 78 degrees 45 minutes East a distance of 125 feet to a point in the westerly line of a seventeen foot alley marked on said plot as East Alley, another corner for lands of said The Baptist Church of Dover; thence with the westerly line of the aforesaid East Alley in a northerly direction a distance of 10 feet to a point, a corner for lands of Elizabeth Clark; thence with said lands of Elizabeth Clark in a westerly direction parallel with the northerly line of Division Street by a course shown on said plot as South 78 degrees 45 minutes West a distance of 125 feet to the place of beginning; being a part of a ten foot alley laid out and dedicated to the public on a plot of Fisher and Bockman recorded in the Office of the Recorder of Deeds of Kent County, Delaware, in the year 1877 in Deed Record Book W, Volume 5, at Page 461, said alley being marked and designated on said plot as South Alley.

Section 2. The Council of the City of Dover will sit at the City Hall to hear objections to vacating the said alley and to award just and reasonable compensation to anyone who will be deprived of property thereby on the 26th day of October, A.D., 1953, at 7:30 P.M.
