REGULAR MEETING
August 11, 1952
The regular meeting of City Council was held Monday, August 11, 1952, at 7:30 P.M. with Vice Mayor Tischer presiding. Councilmen present were Messrs Book, Helm, Holpp, Mundy Petty and Smith.
MINUTES
Minutes of the last regular and special meetings were accepted as read.
REPORTS
Report of the City Manager was accepted as read.
Report of the Chief of Police was accepted as read.
Report of the City Alderman and Magistrate Dempsey were accepted as read. Checks in the amounts of $1050.95 and $10.00 were remitted to the City.
ORDINANCES
By unanimous vote, Council passed the following ordinances:
AN ORDINANCE REGULATING THE PARKING VEHICLES IN FRONT OF THE CITY HALL ON DOVER PLAZA AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. From and after the passage and approval of this ordinance it shall be unlawful for any person to park any vehicle for more than fifteen(15) minutes between the hours of 8 A.M. and 6 P.M. of any day except Sundays and Legal Holidays on the North side of the Dover Plaza in front of hte City Hall between the parking lot exit on the East side of said City Hall and the alley running along the West side of City Hall.
Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine shall be imprisoned not more than five (5) days.

AN ORDINANCE AMENDING AN ORDINANCE ENTITLED “AN ORDINANCE REGULATING THE PARKING OF VEHICLES IN FRONT OF THE POST OFFICE PROPERTY FRONTING ON DOVER PLAZA AND FIXING PENALTIES FOR VIOLATION THEREOF.”
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. That the ordinance entitled “An Ordinance Regulating The Parking Of Vehicles On Front Of The Post Office Property Fronting On Dover Plaza And Fixing Penalties For Violation Thereof,” passed February 12, 1945, as amended , be and the same is hereby further amended by striking out all of said ordinance and inserting in lieu thereof the following two Sections:
“Section 1. That from and after the passage and approval of this ordinance it shall be unlawful for any person to park any vehicle for more than fifteen (15) minutes between the hours of 8:00 A.M. and 9:00 P.M. of any day except Sundays of Legal Holidays on either side of the street, a part of the Dover Plaza adjoining the property if the United States of America upon which the Post Office Building is erected, running from Federal Street in the City of Dover in a westerly direction to the lands late of Henry Ridgely, now of Wesley Methodist Church, in said City of Dover.
Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine shall be imprisoned not more than five (5) days.

AN ORDINANCE LIMITING THE TIME FOR THE PARKING OF MOTOR VEHICLES ON CERTAIN STREETS OF THE CITY OF DOVER AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
Be It Ordained By The Council Of The City If Dover In Council Met:
Section 1. From and after the passage and approval of this ordinance it shall be unlawful for any person to park any vehicle for more than two (2) hours between the hours of 8:00 A.M. and 6:00 P.M. of any day except Sundays and Legal Holidays on the following streets of the City of Dover:
Both sides of North street between Federal Street and New Street, except those portions thereof where parking is entirely prohibited;
Both sides of Bradford Street between Minor Street and Reed Street;
Both sides of State Street between Loockerman Street and Reed Street, except that portion thereof where parking meters are authorized and installed;
Both sides of the Dover Plaza between Loockerman Street and Federal Street, except those portions thereof where parking is limited to fifteen (15) minute parking periods or prohibited entirely.
Section 2. Any person convicted of a violation of this ordinance shall be fined not less than One ($1.00) Dollar nor more than Twenty-five ($25.00) Dollars or upon failure to pay such fine shall be imprisoned no more than five (5) days.

By unanimous vote, Council passed the following ordinance:
AN ORDINANCE TO AMEND THE PARKING METER ORDINANCE OF THE CITY OF DOVER, PASSED NOVEMBER 10,1947, BY EXTENDING THE TIME OF LIMITED PARKING ON FRIDAYS.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. That Section 2 of the parking meter ordinance of the City of Dover, passed November 10, 1947, as amended, be and the same is hereby further amended by striking out the words “between the hours of 8:00 A.M. to 6:00 P.M. on Saturdays” and inserting in lieu thereof the following words:
“Between the hours of 8:00 A.M. and 6:00 P.M. on Mondays, Tuesdays, Wednesdays, Thursdays, and Saturdays, except Legal Holidays, and between the hours of 8:00 A.M. and 9:00 P.M. on Fridays, except Legal Holidays.

CLARA STREET TO LATEX
Max Feller, Vice President of International Latex, requested the City to sell to International Latex that portion of the Clara Street right-of-way situated between the west side of Pear Street and the Railroad, a strip of land approximately 60' x 300'. A price of $500 was quoted. Latex intends to build a large warehouse which will cross the strip. Council tabled the matter until the next meeting for further study.
REED STREET * AMEND ONE WAY LAW
Council directed the City Solicitor to prepare an ordinance making Reed Street a two way street between Kirkwood St. and Railroad Avenue.
WAREHOUSE FENCE
Council awarded the contract for furnishing and erecting a wire fence around the warehouse property to the low bidder, Cyclone Fence Division of U.S. Steel.
PENNSYLVANIA RAILROAD PROPERTY TO CITY
Council authorized the City Manager to notify the Pennsylvania Railroad that the City would accept a deed from the Railroad for the Park plot and a strip of land adjoining the right of way south of Forest Avenue.
CITIZENS PROTESTS
John Lepore appeared before Council protesting the action extending parking meter regulation to 9 P.M. on all Fridays.
Anthony Hammond and George Baker appeared before Council to protest relocating the bus stop at Bank Lane and Governors Avenue.
GARDEN COURT SEWER AND WATER
Council discussed the account due from Garden Court Apartments for sewer and water lines extended by the City. The City paid the original cost, totaling $8661.71, which was to be reimbursed by Garden Court Apartments over a five year period. Mr. Warren Allen proposed that Garden Court pay off the claim at the rate of $100 per month and that the City credit $26.00 per month to the claim from the proceeds of sewer rents collected, until the claim is retired. Mr. Allen is further interested in settling title to the water and sewer lines and in the question of tapping fees against those who make use of the line in the future. Council tabled the discussion.
COMMITTEE ON POLICIES GOVERNING EXTENSION OF UTILITIES
Council directed that a committee be appointed at its next meeting to study and recommend policies governing extension of sewer, water and electric utilities.
RESTMERE DEVELOPMENT
Council authorized the use if the City of Dover sewer facilities by the Restmere Development located west of U.S. Route #13 and north of the Whiteoak Road. Actual construction and extension of sewer lines is subject to approval of City Council.
HEARING COMMITTEE
Councilmen Mundy, Petty and Helm were appointed to serve as the Hearing Committee for the months of September, October and November.
WATER LINE CONSTRUCTION
Council authorized the City Manager to begin construction with City crews of water lines authorized by the referendum approving the bond issue covering the cost. Mr. Ward proposed to begin construction at a point of 600' north of William Street on Pear Street and work south on Pear Street toward Division Street.
ORDINANCE
By unanimous vote, Council passed the following ordinance:
AN ORDINANCE REGULATING THE DRILLING OF WELLS WITHIN THE CITY OF DOVER AND ADJACENT THERETO WITHIN ONE LIME FROM THE CITY LIMITS AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
WHEREAS by Section 19 of the Charter of The City of Dover the power of the Council of The City of Dover to adopt ordinances relating tot he health of the population of the City or to prevent the introduction or spread of infections or contagious diseases or nuisances affecting the City extends to the area outside of the City limits and within one mile form said limits; and
WHEREAS an abundant supply of uncontaminated water is vital for the health of the population of The City of Dover and any interference with said supply of uncontaminated water is a nuisance which affects the entire population of The City of Dover;
Now Therefore Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. No person, firm, or corporation shall dig, drill, or otherwise excavate any well more than one hundred fifty (150) feet deep below the surface of the grounds within the limits of The City of Dover or within an area outside of the limits of The City of Dover and within one mile from said limits unless the express permission of the Council of The City of Dover by resolution properly adopted shall have been obtained for the digging, drilling, or excavation of said well.
Section 2. Any person or the members of any firm or the officers of any corporation who shall be convicted if violating the provisions of this ordinance shall be fined not less than Twenty-five ($25.00) Dollars nor more than One Hundred ($100.00) Dollars and in default of the payment of such fine shall be imprisoned not more than thirty (30) days.
Section 3. The existence of any such well more than one hundred fifty (150) feet deep which shall be dug or drilled within The City of Dover or within one mile from the City limits without the permission of the Council as hereinabove provided is hereby declared to be a nuisance affecting The City of Dover, and each day that such well shall continue to exist shall constitute a separate offense punishable as provided in Section 2 of this ordinance.

AN ORDINANCE REGULATING THE DRILLING OF WELLS WITHIN THE CITY OF DOVER AND PROVIDING PENALTIES FOR VIOLATION THEREOF.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. No person, firm, or corporation shall dig, drill, or otherwise excavate any well more than one hundred fifty (150) feet deep below the surface of the ground within the limits of The City of Dover unless the express permission of the Council of The City of Dover be resolution properly adopted shall have been obtained for the digging, drilling, or excavation of said well.
Section 2. Any person or the members of any firm of the officers of any corporation who shall be convicted of violating the provisions of this ordinance shall be fined not less than Twenty-five ($25.00) Dollars nor more than One Hundred ($100.00) Dollars and in default of the payment of such fine shall be imprisoned not more than thirty (30) days.
Section 3. The existence of any such well more than one hundred fifty (150) feet deep which shall be dug or drilled within the City of Dover without the permission of the Council as hereinabove provided is hereby declared an interference with and obstruction of the City water plant and a nuisance and each day that such well shall continue to exist shall constitute a separate offense punishable as provided in Section 2 of this ordinance.
