REGULAR MEETING

April 14, 1952

The regular meeting of City Council was held Monday, April 14, 1952, at 7:30 P.M. with Mayor Haman presiding. Councilmen present were Messrs Book, Davis, Helm, Holpp, Mundy Petty, Smith and Tischer.

MINUTES

Minutes of the last regular and special meetings were accepted as read.

REPORTS

Report of the City Manager was accepted as read.

Report of the Chief of Police was accepted as read.

Report of the City Alderman and Magistrate Dempsey were accepted as read. Checks in the amounts of $1080.95 and $20.00 were remitted to the City.

ASSESSMENT APPEALS

The committee of councilmen which heard assessment appeals reported recommendations to Council which were accepted as follows:

            E. Herman Dill, 319 N. Bradford St., Assessed $7200; Change, none.

            John Vane, 63 Sackarackin Ave., Assessed $5300; Change, $5150.00.

Edward Clause, Hotel Bell, Assessed $8500; Change, $8000.

            Hiram B. Donohue, 15-17 N. Gov. Ave., Assessed $6000; Change, $5700.

            Olive Covington, 9 N. Gov. Ave., Assessed $3900; Change, $3500.

            Pennsylvania Railroad, Assessed $45,000; Change, none.

            Texas Company, Assessed $12,000; Change, none.

            Carrie Hayes, 35 N. Gov. Ave., Assessed $4800; Change, $4000.

            H.C. Helm, 105 Loockerman St., Assessed $18,000; Change, $16,000.

            Alice Taylor, 20 N. Bradford St., Assessed 45400; Change, none.

TAX RATE

Council set the tax rate for the year 195 at $1.25 per $100 of assessed valuation. The rate was set following discussion of a tentative budget.

WAREHOUSE REPAIR

Council authorized the immediate repair and fencing in of the City warehouse property at a cost not to exceed $15,000. Council directed that bids be solicited on the warehouse repairs.

ORDINANCE

By unanimous vote Council approved the following ordinance:

AN ORDINANCE REGULATING THE DIRECTION OF TRAFFIC UPON REED STREET BETWEEN GOVERNORS AVENUE AND WEST STREET IN THE CITY OF DOVER AND FIXING PENALTIES FOR VIOLATION THEREOF.

Be It Ordained By The Council Of the City Of Dover In Council Met:

Section 1. From and after the passage and approval of this ordinance all vehicular traffic upon Reed Street between Governors Avenue and West Street in the City of Dover shall proceed in a westerly direction, and it shall be unlawful for any person to drive or operate any vehicle in an easterly direction upon said portion of Reed Street.

Section 2. Any person convicted of the violation of this ordinance shall be fined not less than five ($5.00) Dollars nor more than Twenty-five ($25.00) Dollars and upon failure to pay such fine and the costs of prosecution shall be imprisoned not more than ten (10) days.

By unanimous vote Council approved the following ordinance:

AN ORDINANCE TO AMEND AN ORDINANCE PASSED ON June 14, 1937, REGULATING THE PARKING OF AUTOMOBILES AND OTHER VEHICLES ON THE STREETS OF THE CITY OF DOVER.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. The ordinance entitled “An ordinance regulating the parking of automobiles and other vehicles on the streets in the City of Dover,” passed June 14, 1937, as amended by an ordinance passed May 9, 1949 be and the same is hereby amended by adding at the end of Section 1(a) of said ordinance the following words:

 

            Reed Street - North side, West from Governors Avenue

Council approved the following ordinance by a vote of 7 ti 1, Councilman Petty voting No.

AN ORDINANCE TO AMEND AN ORDINANCE PROHIBITING PARKING ON CERTAIN PORTIONS OF REED STREET IN THE CITY OF DOVER.

Be It Ordained By The Council Of The City Of Dover In Council Met:

Section 1. That Section 7 of Chapter IX of the ordinances of the City Of Dover be and the same is hereby amended by striking out the first paragraph:

It shall be unlawful to park any vehicle on Reed Street between Governors Avenue and West Street except on the North side of said Street.

RESOLUTION

By unanimous vote, Council adopted the following Resolution:

A RESOLUTION GRANTING AN EXCLUSIVE FRANCHISE TO J. CLEMENTS BOWDLE TO OPERATE A LOCAL MOTOR BUS SERVICE OVER THE STREETS OF THE CITY OF DOVER AND FIXING THE TERMS AND CONDITIONS THEREOF.

Be It Resolved By The Council Of The City Of Dover In Council Met:

Section 1. The term “local motor bus service” is hereby defined for the purposes of this resolution as the transportation of passengers for valuable consideration by motor buses from any place within the limits of the City of Dover to any other place within the limits of the City of Dover, provided that the said term shall not be deemed to mean the operation of school buses for the transportation of school children to and from the public schools within the limits of the City of Dover.

Section 2. That the exclusive franchise to operate a local motor bus service over the streets of the City of Dover be and the same is hereby granted to J. Clements Bowdle for the period of 25 years.

Section 3. The said J. Clements Bowdle shall forthwith file with the City Manager a schedule of the routes of the said motor bus service within the City of Dover, the times of operation of said buses, and the rates or fares charged therefor; upon any change of said schedules of routes, times and fares, a revised schedule shall immediately be filled with the City Manager the said fares, a revised schedules of routes, times, and fares shall be given reasonable publicity by means of newspaper advertisements, posted signs, or otherwise to the end that the people of the City of Dover shall be fully informed thereof and able to make maximum use of the said motor bus service.

Section 4. The said J. Clements Bowdle shall maintain and keep in effect all times insurance with a reputable insurance company authorized to do business in the State of Delaware to provide for payment of any final judgement recovered against him for bodily injury to or death of any person or loss of or damage to property of others resulting form the operation of said motor buses in amounts not less than those set forth in the order of the Public Service Commission of Delaware dated October 10. 1951, being Order No. 87 of said Commission, Docket No. 53, granting to the said J. Clements Bowdle the right to privilege of operating motor vehicles for the transportation of persons in and near the City of Dover.

A certificate of the insurer showing that liability insurance of not less than the aforesaid amounts is in effect shall forthwith be filed with the City Manager, and said certificate or renewals thereof shall at all times be kept on file with the said City Manager.

Section 5. The motor buses operated under the authority of this franchise shall receive or discharge passengers on streets in the City of Dover only at street intersections and shall stop for that purpose at said intersections as near as possible to the right hand curb line.

Section 6. The motor buses used by the said J. Clements Bowdle in providing the aforesaid local motor bus service shall be kept clean and sanitary.

Section 7. This franchise is not transferable or assignable without the express consent of the Council of the City of Dover.

Section 8. The requirements of Section 2 to 7 of this resolution are hereby expressly declared to be conditions upon which this franchise to operate a local motor bus service over the streets of the City of Dover if granted; upon a determination after a public hearing that the said J. Clements Bowdle has failed to comply with any of the conditions set forth in Sections 2 to 7 of the resolution or that he has failed to provide reasonable ans adequate motor bus service within the City of Dover, this franchise may be revoked or suspended; otherwise the said franchise shall remain in full force and effect for the aforesaid period of 25 years from the date of the approval of the resolution.

BUILDING PERMIT

Following due public notice as required by City ordinance, Council authorized Franklin W. Kinnamon to open a woodworking shop in the rear of his residence at 812 S. Bradford Street.

GARTON SEWER LINE

Council directed the City Manager to secure estimates on the cost of installing an 8" sewer line to serve the area of Columbia and Fairview Avenues. Estimates will be secured on extending the sewer on Columbia Avenue and, alternately, in a dedicated alley west of Fairview Avenue from William Street to Columbia Avenue.

PARKING METERS

Council tabled a proposal for extension of the use of parking meters.

BUS STOPS

Council approved for use as bus stops, parking space as presently designated for the purpose.

CITY OWNED HOUSING

Council directed that supervision of City-owned housing be placed under direction of the City Manager.

Council directed that all funds of the City Housing project be transferred by Thomas E. Baker to the City Treasurer and that the funds still be reserved for slum clearance. Councilman Petty voted No.

SPECIAL MEETING

Mayor Haman called a special meeting of Council for April 28, 1952.

DAYLIGHT SAVING TIME

Council directed that City offices be opened and closed one hour earlier beginning the last Sunday in April, until the last Sunday in September.

Council adjourned at 11:30 P.M.
