REGULAR MEETING

June 11, 1951

The regular meeting of City Council was held Monday, June 11, 1951, at 7:30 P.M. with Mayor Storey presiding. Councilmen present were Messrs Book, Carroll, Culver, Holpp, Mikell, Petty, Smith and Wilson.

MINUTES

Minutes of the last regular meeting were accepted as read.

REPORTS

Report of the City Manager for May 1951 was accepted as read.

Report of the Chief of Police for May 1951 was accepted as read.

Report of the City Alderman was accepted as read.

A check in the amount of $1018.90 was remitted to the City. A check in the amount of $228.40 was remitted to the Council by Justice of the Peace Clarence Dempsey.

AMERICAN LEGION CIRCUS

Council granted the American Legion a permit, without cost, to hold a circus in Dover Monday, August 13, 1951.

ELECTRIC RATE, CARNIVALS, ETC.

Council directed that carnivals, circuses, etc. sponsored by civic, veteran, and charitable organizations be billed for electricity consumed at cost price. Such rate will also include overhead costs.

GASOLINE TANK - HOLY CROSS CHURCH

Council authorized Holy Cross Church to install a gasoline pump and tank at the rear of its Bradford Street property, provided the installation is made in accordance with City ordinances.

NURSING HOME - 331 N. STATE STREET

D. S. and Dorothy Mathis requested permission to open a nursing home at 331 N. State Street. A majority of property owners in the block concerned opposed the business, requiring Council to forthwith deny the request.

CHICKEN HOUSES - S. BRADFORD STREET

Property owners on S. Bradford Street between Waples and Wyoming Avenues petitioned City Council to order the removal of chicken houses in that area owned by Mr. R. E. Norris. The City Solicitor was directed to determine the authority of the City in the matter. The Health Officer and the Fire Marshall were directed to inspect the property and report back to City Council.

OUTDOOR MARKET

Council denied permission to an applicant to open an outdoor market on S. Governors Avenue near the J & M Diner.

The City Solicitor was directed to prepare an ordinance controlling outdoor markets or stands.

STORM SEWER AT HIGH SCHOOL

The Dover School Board offered to supply needed materials to install approximately 280' of storm sewer at the Dover athletic field provided the City supplies the labor. Council agreed to provide the labor to install the sewer, provided the School Board will agree to purchase an additional 350' of storm sewer at a later date which the City will install.

EQUIPMENT PURCHASES

Council authorized the purchase of a dump truck from the low bidder, Kent County Motor Co.

Council authorized the purchase of a tractor and mower from the low bidder, B. Carroll & Sons.

Council authorized the purchase of a sedan from the low bidder, Bolan Motors, to replace the damaged Police car.

ELECTRIC LINE EXTENSIONS

Council approved the extension of electric service to the William Hope, James Satterfield and Lewis Masten farms. The customers will pay all costs of the line extensions. The amounts paid by Mr. Hope and Mr. Masten covering the cost of line extensions on public roads will be repaid to them by a $15.00 credit allowance on their monthly bills. The minimum bill to each of the three customers will be $15.00 per month. The lines will be extended only if materials can be secured for the job.

LIBERTY BELL REPLICA

Council rescinded its former action authorizing the installation of the Liberty bell replica in the triangle at the north end of Dover. Councilman Petty will attempt to find another location within the next thirty days. If no location is found within that period the Liberty Bell will be relocated on the City-owned plot at Division Street and Pennsylvania Avenue.

RICHTER & MEYER WATER

Richter & Meyer requested the City to provide water to their development east of Dover in which they will install water pipe. Council deferred action on the request until the City improvement program is considered.

ELLIS PARKING SPACE

Council denied the request of Mr. Ellis for a reserved parking space to be used by his town truck in front of his residence on South Governors Avenue.

SOLICITING ORDINANCE

Council directed the City Solicitor to prepare an ordinance to control soliciting within the City of Dover.

COMMITTEE OF 39 REPORTS

Council will meet Monday, June 18, at 7;30 P.M. to consider the reports of the Committee of 39 on the City Improvement program.

A RESOLUTION TO BORROW THE SUM OF ONE HUNDRED THOUSAND ($100,000.00) DOLLARS FOR THE AMORTIZATION OF RECENT CAPITAL EXPENDITURES MADE OUT OF THE OPERATING FUNDS OF THE CITY OF DOVER.

WHEREAS, it has been necessary for the City of Dover during the past year to make certain large expenditures for repairs to the incinerator, for the repair and rebuilding of the street lighting system and for replacement of worn out equipment of the said City, all of which said expenditures have been in the nature of capital expenditures; and

WHEREAS, the said City has made the said expenditures out of the general operating funds of the said City; and

WHEREAS, it is desirable and necessary for the said City of Dover, in order to carry on its normal functions, to reimburse the general operating account of the said City for the said capital expenditures; Now Therefore,

Be It Resolved By The Council Of The City Of Dover In Council Met:

Section 1. That the City if Dover shall borrow the sum of One Hundred Thousand ($100,000.0000 Dollars, to be repaid within ten (10) years, for the purpose of reimbursing the general operating funds of the said The City of Dover for emergency capital expenditure made from the operating funds of the said City, in accordance with an act of the 116th Session of the General Assembly of the State of Delaware entitled “An Act To Amend Chapter 158 of volume 36 Of The Laws Of Delaware, Entitled ‘An Act Changing The Name Of “The Town Of Dover” To “The City Of Dover” and Establishing A Charter Therefore’, By Authorizing The Said City to Borrow A Certain Sum Of Money For Emergency Capital Expenditures Upon Resolution Of The City Council”, approved by the Governor of the State of Delaware June 5, 1951.

Section 2. The Mayor of The City of Dover is hereby authorized and empowered to borrow said sum of One Hundred Thousand ($100,000.00) Dollars from such bank, trust company, or other lender and upon such terms, interest, and conditions as he shall deem advisable and in the best interest of the City of Dover, to be repaid, however, within ten (10) years, and to execute in the name of The City of Dover such bond or note as shall be required, whereupon the faith and credit of The City of Dover shall be pledged for the payment thereof.
