REGULAR MEETING
November 13, 1950
The regular meeting of City Council was held on Monday, November 13, 1950 at 7:30 P.M. with Mayor Storey presiding. Members present were Councilmen Behen, Carroll, Culver, Lofland, Mikell, Petty, Smith and Wilson.
MINUTES
Minutes of the last regular meeting were accepted as read.
REPORTS
Report of the City Manager for October 1950 was accepted as read.
Report of the Chief of Police was accepted as read.
Report of the City Alderman was accepted as read. A check in the amount of $1527.20 was remitted to the City. Magistrate Maurice Carrow of Camden informed Council that he would forward to the City $140 collected in fines and $1.70 in jail fees.
ELM TERRACE PETITION
A petition from residents on Elm Terrace requesting that an existing alley south of that street be opened was referred to the City Manager for further investigation as to approximate cost.
NO PARKING AREA
Council granted the request of Dr. Rhoslyn J. Bishoff for a no-parking space in front of his office at 114 S. State Street.
EXTENSION OF MINIMA STREET
A letter from Vera G. Davis stated that she would dedicate the land if the City would extend Minima Street from Hazletville Road to Forest Street. The matter was referred to the City Manager for investigation as to cost.
STREET LIGHTING
City Manager Agner reported on the progress on street lighting on Pennsylvania Avenue and Hazel and Rodney Roads. Council directed that the underground cable for the lights be installed in the street rather than inside the curb line.
POWER PLANT
City Manager Agner reported that power was now being generated at the City plant and that, as in the past, a block of current was being purchased from Delaware Power & Light Company.
DUMP
City Manager Agner reported on efforts to obtain a location for a new City dump. An agreement completed by the City has been forwarded for the signatures of Joseph Ciccone and wife. This agreement in the form of a lease requires payment of a rental of $10.00 per month. A second agreement has been completed between the City and Fred W. and Anne M. Erdle. Use of the present dump will be discontinued by the City when the Ciccone agreement is completed.
WATER LINE EXTENSIONS
City Manager Agner reported on requests for extension of City facilities to various developments.
Council agreed to the extension of water lines to the Edgehill Development east of Dover as requested by George Meyers, provided there is no cost to the City and the lines installed meet the approval of the City.
Mr. Allen Hart requested the extension of water and sewer facilities to a proposed development on the Hughes property between William Street and Walker Road, to include 50 to 75 housing units for rental. Mr. Gus Konschak requested the extension of City facilities to a development on Sunset Terrace.
Council directed City Manager Agner to inform Mr. Hart and Mr. Konschak of the City’s contemplated improvement program, that the City has not the funds to extend such facilities at present, but if they would pay for the extension of such facilities, this Council would be willing to consider reimbursement of costs incurred by them, if a bonding program to finance capital improvements is approved in a City referendum.
ORDINANCE TO DEFINE TAX DELINQUENTS
The City Solicitor was directed to prepare an ordinance stating that in qualifying to vote under the requirements of the City Charter, a citizen is a delinquent taxpayer when his City taxes are not paid in full on or before December 31 immediately preceding the City election held on the third Monday in January.
USE OF COUNCIL ROOM
Council granted permission to the 2403 AAA Training Group ORC to use the Council Room for meetings on the 2d and 3d Wednesday night of each month for as long as the room can be made available.
ELECTRIC LINE PICKERING BEACH
A request was made to City Council to extend electric lines to Pickering Beach. City Manager Agner and Mr. Stumm were named to negotiate with those desiring the line.
CHRISTMAS DECORATIONS
Council approved use of City crews and equipment to erect street decorations for the Christmas season.
SALARY FIRE HOUSE CUSTODIANS
Council approved salary increases of $2.50 per week for fire house custodians, effective at the end of each six months until the maximum of $50.00 per week is reached, providing such increases are recommended by the Fire Chief.
SALARY FOR POLICE
Council approved a $5.00 per week increase in the salary of police officers, raising by that amount the maximum pay of lieutenants, sergeants and patrolman and approved the addition of a full time colored patrolman to the force. Civilian employees were granted the 7½ % raise granted other city employees.
BIDS ON STREET SURFACING
The following bids were received for street surfacing:
Pleasanton & Edgell - $3360.30
Delmarva Asphalt Co., Inc. - $3845.50
Council approved award to Pleasanton & Edgell, providing written guarantee is given that the surfacing will remain in good condition until June 1, 1952.
HOSPITAL POWER AND WATER
The committee studying power and water now supplied without charge to Kent General Hospital reported progress to date. Council agreed that following further study a proposal could be made by the committee to the Hospital that bills will be rendered at regular rates with provision being made for cash donations to the Hospital of sums equal to that paid the City over and above the cost of supplying power and water.
SLAUGHTER STREET SIDEWALKS
City Manager Agner reported that within the next few weeks sidewalks will be installed on Slaughter Street. Council directed that curbs also be installed.
BUS CENTER CASE
Council authorized the City Solicitor to settle the suit brought against the sale of the bus center site and authorized the payment to James E. Turner of $1500 as reimbursement for cost of plans, fill dumped on City land, and counsel fees.
LOTUS STREET SIDEWALKS
Council directed that property owners of Lotus Street who have Not complied with its order of May 8, 1950 to install sidewalks be directed to complete installation of sidewalks within 30 days. Upon failure to comply the City will install sidewalks and bill the cost thereof to the property owners.
ORDINANCES
By unanimous vote of all members Council pass the following:
AN ORDINANCE REGULATING THE SPEED OF MOTOR VEHICLES OPERATED UPON FOREST STREET AND DIVISION STREET BETWEEN THE WESTERN LIMITS OF THE CITY OF DOVER AND THE PENNSYLVANIA RAILROAD.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. From and after the passage and approval of this ordinance it shall be unlawful for any person to operate any motor vehicle at a speed in excess of 25 miles per hour upon that portion of Forest Street in the City of Dover between the western limits of the said City of Dover and the Pennsylvania Railroad and on that portion of Division Street in the City of Dover between the intersection of Division Street with Forest Street aforesaid and the Pennsylvania Railroad.
Section 2. Any person who violates the provisions of this ordinance shall upon conviction thereof be fined not less than $10.00 nor more than $25.00, or upon failure to pay such fine as shall be imposed shall be imprisoned not more than 10 days.

By unanimous vote of all members, Council passed the following:
AN ORDINANCE TO AMEND AN ORDINANCE REGULATING THE PARKING OF AUTOMOBILES AND OTHER VEHICLES ON THE STREETS OF THE CITY OF DOVER.
Be It Ordained By The Council Of The City Of Dover In Council Met:
Section 1. The ordinance regulating the parking of automobiles and other vehicles on the streets of the City of Dover passed June 13, 1937, as amended by an ordinance passed May 9, 1949, be and the same is hereby further amended by adding at the end of Section 1 thereof a new paragraph, as follows:
It shall be unlawful for any person or persons to park, place, or keep any motor vehicle, carriage, wagon, or other similar vehicle upon the west side of Governors Avenue and upon the east side of New Street within twenty feet of the intersection of the driveways or entrances leading from the parking lot adjacent to the Acme Super Market to the said Governors Avenue and New Street between Loockerman Street and Reed Street in the said City of Dover.
