REGULAR MEETING

September 12, 1949

The regular meeting of City Council was held on Monday, September 12, 1949 at 7:30 P.M. with Mayor Storey presiding. Members present were Messrs. Behen, Carroll, Culver, Lofland, Petty, Smith and Wilson.

MINUTES

Minutes of the last regular meeting were accepted as read.

BUSINESS IN RESIDENTIAL SECTION

Action of Council of May 10, 1948 denying Lillian A. Rogers mission to open a beauty shop at her home at 18 S. State Street was rescinded.

Council granted Lillian A. Rogers permission to open a beauty shop at her home at 18 S. State Street.

RAILROAD CROSSING GATES

Council rescinded the action of its last regular meeting directing the Pennsylvania Railroad to remove crossing gates and install watchmen at the Forest and Division Street crossing gates and install watchmen and postponed action until its next regular meeting at which time the matter will be further considered.

FRIENDS OF OLD DOVER TO CARE FOR CITY LOTS

Max Terry, representing the Friends of Old Dover, requested the City not to sell its lot at Pennsylvania Avenue and Division Street. The “Friends” stated that the lot was used by children for play, and proposed to maintain it as well as an adjoining triangular plot owned by the City, if the City retained possession. Council accepted the proposal of the Friends of Old Dover and rescinded its former action directing that the lot at Pennsylvania Avenue and Division Street be sold.

NO PARKING AREA - DELAWARE NEWS COMPANY

The Delaware News Company requested a no parking space on New Street between Loockerman and North Streets. Council directed the City Manager to check the area and report back at the next regular meeting.

CITY MANAGERS’S REPORT

Report of the City Manager was accepted as read.

CHIEF OF POLICE’ REPORT

Report of the Chief of Police for August 1949 was accepted as read.

REPORTS OF ALDERMAN AND DEPUTY ALDERMAN

Reports of the Alderman and Deputy Alderman for the month of August, 1949 were accepted as read. A check from the Alderman in the amount of $984.15, and from the Deputy Alderman in the amount of $154.35, were remitted to the City.

ORDINANCES

City Council directed the City Solicitor to prepare the following ordinances:

An ordinance allowing and limiting parking on the East side of New Street between North Street and Bank Lane to horse drawn vehicles.

An ordinance directing the City Manager to assign a number to each taxicab to paint the assigned number in numerals at least 8" in height and easily discernible on both sides and on the rear of the vehicle.

An ordinance requiring restaurants and eating establishments to be inspected and approved by the City Board of Health prior to conducting any business within the City of Dover.

LOADING AND UNLOADING TRUCKS ON LOOCKERMAN STREET

Council directed the City Manager and Chief of Police to survey trucking companies to attempt to determine what hours would be most suitable in which to limit loading and unloading of trucks on Loockerman Street.

PERMIT TO INSTALL GASOLINE TANK

James H. Wood was granted permission to install a gasoline tank and pump in the rear of his home on North Bradford Street, providing the installation meets the requirements of City ordinances.

CITY OWNED REAL ESTATE

The following bids were received on the house and lot comprising part of the old Mill property on King Street offered for sale by the City’

                        Robert E. Lewis          -          $4100.00

                        William Smith            -          $4150.00

Council rejected both bids and directed that the property be offered for sale at public auction prior to its next regular meeting. The sale shall not be final until approved by Council.

REQUEST FOR PARKING AREA

G. Leslie Gooden requested that reserved parking space be granted to occupants of No. 8 The Green. Council denied the request.

TAX DISCOUNT

Council authorized the allowance of discount on 1949 taxes to Morris Simon and Clara B. Radish, who claimed that tax bills were not delivered. Mr. Lofland objected.

USE OF BASEBALL PARK FOR FOOTBALL GAMES

Council approved use of the baseball park by Dover High School and Delaware State College for football games. Bleacher seats may be moved providing they are restored to their present condition at no expense to the City.

PAUL COOK BUSINESS

Council directed that Paul Cook discontinue his business at the rear of his home on South Bradford Street within ten days or suffer prosecution.

STREAM CONTAMINATION

City Manager Brown reported his findings and recommendation on stream contamination by sewage overflow. At Division Street very little contamination resulted from sewage overflow. Removal of the dam south of Legislative Hall would result in tidal action to Division Street but wold do little to better the situation. An additional sewage line constructed at the Loockerman Street pond would decrease the overflow but could not carry all storm water because the normal volume of flow was too great. The additional line would cost approximately $2000. He recommended that the project be postponed until the next fiscal year. Council accepted the report.

SIDEWALK CANOPY

Vernice Jenkins requested permission to erect a canopy over the sidewalk at her store on Loockerman Street. Council denied the request.

PUBLIC HOUSING

The Public Housing Administration offered to the City of Dover 20 Veterans Housing Units now under its jurisdiction and sponsored by the City of Dover. Council directed the City Manager and City Solicitor to enter into negotiations with the Public Housing Administration, and directed further that in the event the housing units were acquired, all profits realized from rentals be set aside from slum clearance in the City of Dover.

ORDINANCE

By unanimous vote, Council approved the following ordinance:

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. It shall be unlawful for any person, firm, association or corporation to park any motor vehicle, carriage, wagon, truck or other vehicle in any of the alleys of The City of Dover, and the penalty for violating this ordinance shall be the same as the penalty set forth in Section 5 of an Ordinance regulating the parking of automobiles and other vehicles on the streets of the City of Dover, passed June 14, 1937.

ORDINANCE

By unanimous vote, Council approved the following ordinance:

AN ORDINANCE TO AMEND SECTION 3, CHAPTER VII, OF THE ORDINANCES OF THE CITY OF DOVER

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF DOVER IN COUNCIL MET:

Section 1. Section 3, Chapter VII of the Ordinances of the City of Dover is amended to add:

Section 3a. Hereafter it shall be unlawful for any person, firm, association or corporation to store or handle fuel oil for their own requirement or for the purpose of sale in excess of 550 gallons, without first obtaining a permit therefor from the City Manager or his duly authorized representative, specifying the name of the permittee, the location of the premises where fuel oil is stored or kept and the amount of the fuel oil desired. Any tank or tanks erected or constructed by virtue of said permit shall be erected or constructed in accordance with the rules of the National Board of Fire Underwriters as recommended by the National Fire Protection Association.

ORDINANCE

Council directed the City Solicitor to prepare an ordinance making King Street a one way street, traffic to move from south to north only, between Division Street and its intersection with State Street.

TRAFFIC LIGHT

Council directed the City Manager to have a traffic light installed at Division and State Streets.

TRAFFIC ON GOVERNORS AVENUE AND LOOCKERMAN STREET

Council directed that on the four corners of Governors Avenue at its intersection with Loockerman Street parking be prohibited for a distance north and south to permit four lane traffic. Two inner lands shall be marked off for left hand turns only.
